So lean men should not be allowed on juries.

Did the researchers exclude jurors like they would on a real jury? Did people volunteer for this study? If either of those conditions are true then this study isn't a real representative of a jury.

Fat people, ugly people, people who are too short or too tall, people who have the wrong skin color, people whose glasses are too thick, people who are bald or balding, especially women, women who are mannish, men who are effeminate, etc.

On the other hand if you are young and beautiful not only are you more likely to get away with crimes but you are also more likely to get a job, make more money, and be considered nice.

That's the way of the world and we have known about it for a while now.

Not sure if I believe this study. The thing with science is, sure, this published study seems to indicate that men, especially lean men, tend to "convict" obese females more than they would lean females, when given the same facts about an alleged check fraud crime.

But this is just one study, with a unique set of case facts for a specific crime, with specific pictures, using an at best imperfect approach (guilt or innocence was decided after reading a paragraph, not after a trial with evidence, the defendant in the flesh potentially answering questions, other testimony, etc.) Now, if more studies testing this association are done and the effect can be reliably replicated, then I'll believe it.

And if it is true, the advice is pretty straightforward: If your client is an obese female, with all else equal, screen out lean men as potential jurors!

Don't be depressed, Slate writer. The science was probably bunk and you're also probably not reporting it very well because you want to spin it into a sound byte for use in feminist misanthropy.

2013-01-11 01:05:58 AM

Apos: ......whereas tubs of lard of the male persuasion would be acquitted?

As covered previously above and in TFA, yes, the association was specific to obese females. There was no statistically significant difference in the "convictions" of obese and lean males.

But again, this study is deeply flawed and is only one piece of data. It is way too premature to make any firm conclusions about this phenomenon.

Yeah, pretty  much all of this. OF COURSE, with everything else being equal, then sure, fat chicks could get a raw deal. The problem, of course, is that in a real live trial, everything else is not equal. I'd be willing to bet that a fat, scared, crying chick would get a much lighter sentence than, say, a thin, beautiful, but cold and heartless appearing chick, for instance....or a fat, evil-looking man.

Lawyers have known for centuries it's all in whether the jury perceives the defendant as sympathetic...not in whether they think he or she is skinny enough.

I like how the author was going on and on about how men think obese women are vile and evil. I bet any money what's really happening is the men are cutting the cute chicks a break.

Also, don't hold your heads too high, ladies. As far as I can tell, weight isn't as big an issue to women as it is to men.  Try throwing tall and short men at the female jurors and see if there's still no bias.

2013-01-11 01:57:59 AM
I would be interested to see how this study played out with different crimes as I would imagine each crime is likely to play to particular biases. If a similar study was done where the crime was rape or stealing veggies from a supermarket the fat gals would probably be less likely to be convicted. The skinny men likely more so.

The best study I've read was a test on how much women lied in studies. The study asked about sexual history and the only identifying factor was the color of paper the test was printed on. The tests were collected and the subjects were attached to "lie detectors" which they were told would detect lieing and they could be identifiedvas liars. The new tests were filled out and the results compared. The male subjects' results didn't change significantly while the females' sexual history increased in all parameters. So they were willing to lie even anonymously but told the truth when threatened with exposure as liars.

The important take away is that women will routinely lie to appear more politically correct. Anybody who doesn't think some creepy, fat neck beard isn't going to be sent up for whatever he's charged with by a jury of women is clearly insane.

2013-01-11 04:29:17 AM
Study only had one picture of each type -- e.g. there was only one overweight female. How do they know that it was the weight difference, and not hair color, or ethnicity, or any of the other differences, since there was only one of each? Perhaps the true discriminating factor wasn't present in the male set of photos.

they are talking about verdicts not sentencing.
we see it here on Fark every single day practically... if you are heavier than perfect, then you get called all sorts of hateful names under the guise of "helping" that person overcome some perceived issue of overeating and self-esteem. The worst offenders here are likely the young slim Farkers (just like in the real world btw). Human nature is human nature regardless if its reality or internet. Young slim males take no other factors into account other than "calories in vs out" because they are ignorant and don't care anyway. A possible solution to this would be to let nobody under 40 or so serve in a jury period. Once a person has aged a bit and gained some real world experience (wisdom), they are better equipped to weigh evidence in a more impartial manner... Given human nature, younger crowds are led around by their emotions and genitals.

/The above statement, while I believe to be true is IMHO, not something i can cite... just observation.
