So... According to what he says the cops became angry when they found out he was innocent and threatened him with arrest. What the hell for and to what end I do not know, presumably he would have still spent a nasty time in a cell until the judge let him go back to a trashed house.

/It really strikes me that it sounds like some parts of the US have very third world police.

In other news, lots of police in lots of places are goddamn idiots.

The guy really should have videotaped them despite the sergeant's protest. That way when they DID take his camera, delete his video and detain him while they tossed his house he'd have a better case. I'd hate to see a labor of love get trashed by a bunch of goons just so I could prove a point but I can't say I wouldn't let it happen. It really interests me to learn why they wanted to search his house in the first place.

This is good information to have on hand since I've been trying to find some small scale yet attractive hydroponic set ups of my own. My apartment gets crappy light and what little I get on my balcony still results in somewhat yellowing herbs. I would also very much like to grow my own tomatoes indoors but only if the cops would let me.

I am actually kind of worried about this.

We got a medical marijuana discount for our grow light (because the guy working the store so awesomely put it, " we shouldn't penalize you for just growing tomatoes" but when our landlord did a walk through in preparation of us re-signing our lease, she straight up did *not* get that yes, we pay for a room full of plants to be lit up and no, we don't smoke any of them.  But we do eat over half of them.

Sigh.

/on the plus side, SO made fresh rosemary pasta which was kickass...

So, for all the people who whine 'Why don't the cops go out and actually do their job instead of catching speeders'...this is what it looks like when cops aggressively try to root out crime. Not saying it is right or wrong, but when you want police to be more aggressive in investigating leads (and yes, a significant investment in grow lights, etc. correlates to a grow house often enough to be suspicious), this is what you get.

Neither defending nor condemning the polices's action.

I have two grow lights and MULTIPLE SHELVES full of fertilizer.  Sure, you could go upstairs and see my MULTIPLE BOOKSHELVES of gardening books and boxes of seeds, but FERTILIZER OMFG.

Every cop involved in that home search should be fired and charged with crimes sufficient enough that they can never find law enforcement work for the rest of their lives.

I'd say it is more than "some parts" and most of the time the cops in these type of situation are black.

I've been illegally threatened by black cops a few times. I would have asked for their badge numbers to press the issue, but I was worried if I did I'd end up abused worse.

We actually buy most of our (liquid) fertilizer (which is pretty much all we buy now since we've got a decent compost up and running) at hydro shops, because they tend to have really good fertilizers for container/small space gardening for some odd reason.  Almost like people had to grow plants in hidden indoor areas with limited space...

or vehicle search. a cop detained me in the snow on the side of a road in arizona in shorts and a t-shirt for an hour one time. i was f-ing freezing and i developed a cold. all so he could mess up the organization of my DRUG FREE possessions packed into my truck. test-bully-high school losers grown up forsure.

We can debate about the tone and tenor of the searching seargent all day, but have no real info (just one side of the story).

It comes down to this, police obtained information that a private citizen had was using equipment in type and quantity usually consistent with growing marijuana, and not usually consistent with growing anything else. Is that, in your opinions, sufficient for a search warrant?

I will give you some hypotheticals. A person disappears. A vague acquaintance of that person is seen buying an unusually large amount of rope, duct tape, drop clothes, and lime. The police ask to go inside that persons house, but he declines. Should the police just drop the issue.

You house is broken into. Someone spotted a white van across the street from your house. They see people standing about, but did not see anyone going into your house or break any other law. The van is owned by someone with a history of breaking and entering. Police question him, he declines to let them in, should they be able to search.

This is not a trap or a trick question, I am trying to honestly assess most people's position on the balance between respecting individual rights and enforcing the law.

It's Georgia.  I haven't heard that you can be arrested for having grow lights and fertilizer, but we have other strange laws here.  I'm still pissed that you can't carry your ice cream cone in your back pocket if it is Sunday.  And why the hell CAN'T I put my donkey in my bathtub?!!

Seriously though, it wasn't too long ago that oral sex with your spouse was considered sodomy here in Georgia.  It was finally changed when one man's estranged wife used it to have him arrested to get custody of their sons.  He spent 18 months in prison.

State v. young the supremes said that you need a warrant to use FLIR cameras. Don't remember the details but a lawyer in California put a Christmas tree under some grow bulbs in an empty house. The house was later raided because an informant said he bought pot there
