There must be an element of cold-bloodedness not present in a 2d-degree killing. Which means he cut the guy's arms off AFTER he was dead.

I wonder if we're maybe in violent agreement about this? If he intentionally carried a knife to go find a particular person and kill them with it, that shows he intended to use the knife on him. Dismemberment is torture, unless he is being charged with just defiling a dead body.

I'm just saying what that statute says. Whether you can prove it (or not) in court is a whole 'nother matter. It's just that "malice aforethought" is NOT the definition of 1st degree murder, is all. And no, dismemberment wouldn't be torture unless the victim was alive when he was being dismembered. An attorney can plausibly argue that just because you have a knife, doesn't mean you intended to KILL the victim; although the DA is going to argue you certainly weren't going to just annoy him a little bit (hence the whole "Implied malice (intent to cause grievous bodily harm)" clause).

Oh, and get used to this--I've got my bar exams coming up at the end of February and I am GOING TO PASS THIS TIME GODDAMN IT.
