Well kids, i know half of us are mystified and scared by the Method, but the obvious question is whether the cops/da/whatever had the goddamn common sense to introduce a control or two. And how sad is it that this reporter didn't ask whether or not the vic was shown pictures of people who didn't potentially shoot him? That would be the thrust of my entire farking article.

It's a local story to me & from what I remember at the time, the blinks on the video were slow deliberate ones, clearly different from a normal 'blink'. It was also an obvious attempt at communication. If it isn't, hopefully a jury will be able to realize that, but with all the other evidence it is pretty clear that the police got the right guy. His lawyers whining about it is just what they are supposed to do. Much like a dog peeing on a hydrant, the defense is supposed to complain about evidence that will convict their client...

Thanks, and yeah, I wouldn't be amazed if the video is pretty damning. The tag and question mark weren't meant out of undue sketicism; it's just that it's rather unusual testimony, and it's not certain what will happen.

If it had been one of those things where a supposed "communication facilitator" is assisting someone's hand a across an input pad, I would call bullshiat - there's been ample debunking of those. My only concern with the blinking video is that the jury be allowed to see all of the interviewing that was done, to make sure this wasn't cherry-picked (no "out-takes").

I have a funny feeling "reasonable doubt" might be the defense's path of least resistance. It *should* take a lot more than this to convict someone of murder. Hell, it should take a lot more than a single witness' testimony.

I know it sounds crazy, but if they have video, it may be obvious to the jury if the blink is deliberate. My mom died of ALS and blinking was her final method of communication. I communicated with her that way for months.
