I know it sounds crazy, but if they have video, it may be obvious to the jury if the blink is deliberate. My mom died of ALS and blinking was her final method of communication. I communicated with her that way for months.

It's a local story to me & from what I remember at the time, the blinks on the video were slow deliberate ones, clearly different from a normal 'blink'. It was also an obvious attempt at communication. If it isn't, hopefully a jury will be able to realize that, but with all the other evidence it is pretty clear that the police got the right guy. His lawyers whining about it is just what they are supposed to do. Much like a dog peeing on a hydrant, the defense is supposed to complain about evidence that will convict their client...

Well kids, i know half of us are mystified and scared by the Method, but the obvious question is whether the cops/da/whatever had the goddamn common sense to introduce a control or two. And how sad is it that this reporter didn't ask whether or not the vic was shown pictures of people who didn't potentially shoot him? That would be the thrust of my entire farking article.

I have a funny feeling "reasonable doubt" might be the defense's path of least resistance. It *should* take a lot more than this to convict someone of murder. Hell, it should take a lot more than a single witness' testimony.

Thanks, and yeah, I wouldn't be amazed if the video is pretty damning. The tag and question mark weren't meant out of undue sketicism; it's just that it's rather unusual testimony, and it's not certain what will happen.

If it had been one of those things where a supposed "communication facilitator" is assisting someone's hand a across an input pad, I would call bullshiat - there's been ample debunking of those. My only concern with the blinking video is that the jury be allowed to see all of the interviewing that was done, to make sure this wasn't cherry-picked (no "out-takes").

I have to assume the dude was on some pretty strong pain medication, probably intravenous morphine in that situation. The prosecution is going to have to prove that he was medically capable of testifying, lucid, etc. and back that claim up with evidence. And since the communication was limited to blinksies, that evidence is going to be tough to produce. In contrast, all the defense has to do is provide a simple list of medications amounts, strengths, times of administration, and an expert witness to testify that the dude was so looped he would have identified his cat as the shooter.

That's how it would go on Law & Order, anyway.

Sorry about your mom.

My sister had to communicate like that for a while after she was shot in the neck. She was paralyzed from the neck down and intubated, so she could only blink until they installed the trach.

Sorry about both of those... Reminds me of a sad case of someone I knew who got partly paralyzed during a risky but necessary tumor excision (at the rear base of his skull, IIRC).
