The headline of the article says claim dropped. The body of the article says the state Attorney General denies liability on behalf of the state, which he would do no matter whose fault the shooting was, and does not say the claim is dropped.

Which is it?

I would hope that the parents of this family understood that this lawsuit would put them pretty high up on the Douchebag list. I hope everyone is adult enough not to take it out on the child who didn't ask for any of this, but a little public shaming for the greedy parents isn't necessarily a bad thing.

I saw a different article saying that Pinsky dropped the suit after getting over 50 death threats.

I'm sure the family heard everybody talk about the douchebags that were filing the lawsuit and decided it was in their best interest to drop everything.

/I agree, the scumbag lawyer hoping to cash in on this national tragedy probably thought he would be burned at the stake for filing such a obvious money grab. Crappy lawsuit even considering the ones in the past.

Wat?
I don't get it

Anyway, are there lower parties to the suit?
You usually name multiple defedants in a lawsuit like this.

I think its sick that the parents would try to score bucks off of this tragedy. The school had all
possible safeguards in place. It's not like the gunman just walked right through an open door
or anything.

Government is completely unaccountable for its own decisions, incompetence, and the inevitable failures, yet this is exactly who the liberal-fascists want to have total control over all aspects of our society. Walk in to your lawyer's office and tell them you want to sue the state. Go right ahead. You'll be mocked, ridiculed, and laughed right out of their office.

2013-01-01 05:26:05 PM
The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire at Sandy Hook Elementary School, according to the claim.

Pinsky's claim said that the state Board of Education, state Department of Education and state education commissioner had failed to take appropriate steps to protect children from "foreseeable harm" and had failed to provide a "safe school setting."

Is there any lawyer that could defend even the filing of this lawsuit?

Can a lawyer examine the Connecticut ethics rules and make a reasonable case this lawyer should be disbarred?

I haven't read any of the threads on this, so it may have been already pointed out, but there's an interesting note about this asshole of an attorney. Every morning on the Today show, when they go outside, there's a creepy looking Unibomber dude holding up a sign and he's always standing right where he knows they're going to stand. The sign is for a lawyer. Irv Pinsky, the same douchebag that brought up this suit. So if you ever need a lawyer and want to give him a call, you can look for his number on the Today show every morning. Still.

Anyone involved in filing this suit should be smacked upside the head repeatedly. It's horrible that anyone would even entertain the notion, let alone file a suit.

If "Jane Dow" is claiming the shooting was "foreseeable harm", that means she sent her kid intentionally into said harm. That's child endangerment, and she needs to be put in jail, and her kid taken away from her.

Be careful of the get rich quick lawsuits.

Captain PTMB With regards to lawyers, Shakespeare was right.

Lawyers point out that line's uttered by Dick The Butcher, a bad guy in "Henry VI", thus an affirmation of lawyers. Now with Dogbert, you can argue that Shakespeare thought cops were dopes, & his glowing portrait of Henry the VIII is way outta line with history, but The Bard's patron Queen Elizabeth the 1st was Henry's daughter so Will S. sold out

Oh its much worse than that, the little girl in question wasn't killed, wasn't wounded, didn't even SEE THE SHOOTING. She heard it over the intercom. And for that, they're suing for $100 million, doing their best to destroy the sympathy people had for them.

The King created the courts. It would be repugnant to use the courts, that the King has kindly given to us, in order to accuse him of being wrong. Wouldn't it?

Their kid actually survived. It says their child heard stuff over the intercom. I'm sure they'd be suing for $1 billion if their kid actually saw anything, and maybe $100 billion if their kid died.

My immediate assumption when I heard about the suit was that its true nature was to ultimately get the state (and probably federal) court to rule on the legality of assault weapons in Connecticut. I'd hate to think that it was just a publicity stunt.

2013-01-01 06:17:24 PM
I'd sue the perp.  Or in this case, the perp's estate.

2013-01-01 06:18:59 PM
Sure. Let's turn all schools in high security prisons, with TSA agents at every bus stop groping the kids twice a day. Or even better, let's make cult training compounds out of them, so they won't have to leave any more and possibly be harmed on the 10 yard walk from the bus stop to the car.
Then they'll be safe, protected by the State.

2013-01-01 06:24:28 PM
I suspect there isn't even an actual "Jane Doe" client. Any attorney knows you can't sue a state without it's consent, unless you have a solid 1983 claim against a named officer for violation under color of authority. It sounds more like this scumbag is grandstanding and either has no client at all, or else lied to some real parents about what he was up to. I'd hate to think he was colluding with someone so evil they'd whore themselves out like this; but I suspect it was more ignorance on the part of the parents who had no idea you couldn't sue the state for emotional damages.

Of course, some people would like it better if you could just sue the state willy-nilly any time anything bad happened; but that's why the 11th Amendment was written in the first place.

When they install the airport porno-scanners in elementary schools, will the TSA employees be arrested for kiddie porn?

Actually, their kid was one of the survivors. That's what makes this so sick. 20 first graders get shot
down in cold blood and instead of dropping to their knees and thanking whatever deity they believe
in (or not) that their child made it out alive, they see farking dollar signs.

If it were a parent who lost their kid, I could actually understand lashing out in anger like that. They still wouldn't have a case against the state, but I could understand the urge to just hurt someone or something in retaliation.

In this case, according to TFA, "The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom".

God forbid this kid ever discover a Playstation.

You'd have better luck going after the gun owner's estate, seeing as he was unemployed and living with mom.

Had she lived, if she had knowledge of his mental illness (whether she knew the extent or not) and did not secure her weapons to prevent his access, I'd give it to you.

turbocucumber: Sure. Let's turn all schools in high security prisons, with TSA agents volunteer armed citizens like former service members, retired police, Joe Blow CCW etc. at every bus stop groping the kids twice a day. Or even better, let's make cult training compounds out of them, so they won't have to leave any more and possibly be harmed on the 10 yard walk from the bus stop to the car.
Then they'll be safe, protected by the State 2nd Amendment.

FARKING. LAWYERS.

That is all.

2013-01-01 06:46:55 PM
Maybe someone clued the family in on the fact that by broadcasting that over the intercom (which would normally be turned off) that it gave teachers an opportunity to prepare their classrooms by locking their doors, etc.

Sounds almost like their talking points were written be Wayne.

"Although the investigation is still under way, we are aware of no facts or legal theory under which the State of Connecticut should be liable for causing the harms inflicted at Sandy Hook Elementary School," the statement added.

Yep, the state has no duty to protect you or your kids.

2013-01-01 07:21:29 PM
Too soon?

He would have to sue the individual school district.

He could go after the mother's estate. better hurry up with that probate.

I'm sure there will be more law suits eventually...

2013-01-01 07:22:29 PM
Who is to blame? The real person to blame is dead, that's the breaks, sorry. Maybe sue the big bang cause lead was created then and the a%swipe murderer used lead in his bullets. Another thing, "If video games don't affect people, it's just some thing they see it doesn't affect them"  Then why do the big corporations advertise on television it's just something we see, it doesn't affect us, yet they spend billions every year.
