If your bones are that fragile, you probably shouldn't even be *in* an amusement park... or around any kind of crowd, or riding an escalator, or taking the subway, or walking up/down stairs, or...

Glad they ruled the way they did. If you're too stupid to avoid injury on bumper cars, just stay home and wrap yourself in bubble wrap so the rest of us can still enjoy stuff.

People such as this woman should not have children. I'm not saying that I support eugenics or anything, but stupidity like that should somehow naturally preclude reproduction.

Monday's decision extended a legal doctrine that has limited liability for risky sports, such as football, to now include recreational activities.

You have to admit that it's pretty bad when you have to get lawyers together to make a law to protect folks from being sued over recreational activities -- when the lawyers themselves started the practice in the first place.

Until the 80's, we didn't sue people every time they farted. Common sense actually existed. Now, you get sued if you look at someone the wrong way.

Upside:  No.NJ has oodles of hardcore seasoned ambulance volunteers, well-heeled funeral home owners and now-grown children that know what true pain and suffering on a bright summer day is all about. Thanks Action Park!

PS: law suit pay-out free! those farkers skipped on paying taxes and most anything else they were responsible for just shy of what it took to keep the admission booth up and running.


I've read the wiki entry Link and I have a question about the operation. Obviously it was very bad, and then Intrawest came in in 1998. It seems to have been sold back to the previous owners in 2010. How is it since then?

There's a long history of "assumed risks" in amusement park rides.

In the case of Murphy v. Steeplechase Amusement Park (1929) Murphy fractured his kneecap after attempting to climb "The Flopper," a conveyer belt that patrons were challenged to try to climb to the top of. It was surrounded by pillows. Murphy tried to climb it but fell off, broke his kneecap and sued.

Then-Judge Cardozo essentially said, "What did you expect from a ride called 'The Flopper'?" and ruled that Murphy had assumed the risk.

It's because of "what? Coffee is hot?" issues like this that I do support eugenics, although that's a five-dollar word for "labour gulags of the dim".
