His head is definitely feeling it in the morning--with that kind of blow, he could make a case for concussion which would invalidate much of the remaining "sobriety" tests. It won't save him from the .15 BAC though.

I sure did. Sure, they threatened me with all that, but a friggin' PD was able to get me off scott free, because the state had no evidence to prosecute. Therefore, no penalties. Got my license back, and they got nothing. It's not like I was swerving all over the road or anything. I pulled out of a gas station parking lot with my lights off once, California stopped at an intersection the other.

Yeah, it's generally a bad idea to consent to the breathalyzer test. There are consequences for refusing--it almost guarantees you will be arrested, and you will probably have your license suspended, for example. It also lets the prosecutor argue to the judge/jury "Of course he refused! He was drunk and he knew it!" On the other hand, if you're not driving erratically and you appear on the video (if there is one) to have good balance and aren't slurring your words, a jury is less likely to think that you were impaired. The results of the breathalyzer only measure blood alcohol content, not whether or not you can drive safely. But the government has complete control over the machines, they won't let your lawyer do any independent testing on them to determine their reliability, their reliability is attested by some dumb cop who doesn't actually know how they work, so if the results are wrong, you have no way of proving it. Nowadays, it's fashionable for judges to give officers the OK to draw blood from DUI suspects, which they can do without your consent if they get a warrant. You have to hope that the blood tests at least are done at a reputable lab, but of course the labs are on the government's payroll.

Normally when I'm sober I can only tolerate so much from a drunk person. There was one instance where I couldn't help but be amused though. My friend and I were in a diner and a drunk lady came up to us and started going on about how my friend looked like a young Obama. Yadda yadda yadda, then she asked for his autograph on a napkin with the request that it say Obama, he signed it Obama Jr. she was ecstatic and then she left.

Damn, I was reading a grear article that outlined how the whole refusing of breathalizer test was actually a big problem for police because it was causing a huge lack of evidence to get DUI convictions to stick. Essentially the article was saying districts where going with no-refusal blood test. While these blood test do require an officials signature, said officials desk was being staffed 24 hours a day.

So yea, refusing breath test may currently up your chances and a no DUI conviction, you will soon be getting a needle in the ass instead.

Personally I can' believe breathalyzers can be refused. It is like the most non-invasive test out there to boot.

I never been popped for drinking and driving but like most other people who drink I have gotten behind the wheel before when I probably shouldn't have and I probably will again (but not as often as when I was younger).  I've already made up my mind that if I ever do get stopped I will refuse the field sobriety tests and the breathalyzer.  If by law I have to submit to either a breathalyzer or blood draw or automatically lose my license I will opt for the blood draw.  I will also ask for a second vial for my keeping.  Having never done a blood draw I don't know if that's an option but I will ask.  I do not trust breathalyzers or the police.  I figure with a blood draw there will be no grey area and I'm guessing it will probably take at least several minutes or more longer to do the blood draw than a breathalyzer.  Every minute that goes by before they can do the draw is another minute you liver has to process some alcohol out.

Don't know if this would get me off or not but having a plan is better than doing their field sobriety tests (which ONLY benefit the police/prosecution) and taking an unreliable breathalyzer test

Exactly. I don't know of too many states or municipalities that CAN'T force a blood test. I've seen people tied down, in a restraint chair, or just plain subdued by force in order to draw blood.

If you refuse a breathalyzer test in Kansas, your license is "automatically" revoked for 1 year. I'm sure some have gotten around that rule (for instance, if the arresting officer[s] don't show up at court which HAS happened) but 99% of refusals see their licenses...disappear.

I was twice as bad as this a couple a weeks ago after our Christmas party. The only difference is I wasn't driving. I had about 7 or so 10% beers then capped it off at another bar with a 13% Bourbon County Stout. Hey, the company was buying. Staggered a few blocks to my truck parked in a friend's driveway. Woke up at 6:30 in the morning & drove home.

This thread is probably dead but everybody jumping on Tumunga for drinking and driving, unless you are a teatotaler who has never driven impaired are hypocrites.  Tumunga is just being honest about something that I will bet the majority of Farkers have done and will continue to do.  Whether you want to be honest about or not there are different degrees of impairment.  Not everybody who gets stopped by the police in a .35 Fark headline parent of the year candidate.

How is exercising his rights as defined by the law being an asshole or whatever

If only. What they actually measure (assuming they've working reliably and have been calibrated enough to measure anything at all) is the concentration of methyl groups in the sample air volume. Which is at best vaguely correlated to actual BAC unless you adjust for a whole slew of other things, like blood volume, recent respiration patterns, temperature, the presence of non-ethal-alcohol methyl groups, etc. But hey, it lets throw people in jail, so I guess it must be working.

Even ignoring the technical flaws (in measurement of impairment and of BAC and the relation of either to driving safety) I've never understood how specific laws against drunk driving, texting while driving, etc. protect me more or better than a couple of general laws against districted and/or reckless driving. Getting bad drivers off the road, regardless of the cause, seems more useful than trying to keep track of all the specific behaviors/substances/etc. that might lead to bad driving.

Even if that is true -- and it's not, but let's assume it is -- I don't see other Farkers express pride in their actions. That's the whole point. That's why people are on his case. They, at least, have the good sense to be ashamed about their poor decision, or at least to keep silent about it. He's proud.

And again, that's the whole point of why people got on his case, not because he made a poor decision. Kind of figured that was obvious.
