MrBentor: It is a bizarre policy the government has. In my second job I am a part time caregiver. (Yea- as much as a troll here, I am not a totally bad person... I do have a good side.) So some of my DPs have used medical marijuana for the control of pain and symptoms. It is common for them to significantly cut the amount of pharmaceutical drugs they take and face less side effects. I see it over and over.

One of my DPs went from 20 to 8 medications, and doesn't have to take powerful pain prescriptions that makes her like a zombie. But no - the government would rather pay $2,000 a month more out of their already tight Medicaid budget... and accept more frequent emergency room visits due to problems caused by those medications - and take someone who is progressing in therapy and trying to become productive again - returning them to back less than useless blob that sleeps 18 hours a day and can't move. Some of the medications are just to stop the side effects of other medications, which on their own have side effects. Yes, medical marijuana is far from perfect and has side effects too; it is more effective than a many "legal" drugs with less harm.

What's the choice next? - put the DP in a nursing home with round the clock care (very expensive), or allow her to be somewhat independent in her own apartment with just a small number of a few-hours-per-day cargivers? With the reduction in medications and pain pills through the use of medical marijuana products - there is a path to self-sufficiency and possibly to become productive again in some way.

Locally under state law, the state department of health and welfare understands this, despite the pressure from the federal government. The state is taking a more pragmatic approach to what is in the best interest of the disabled person. Ya, in theory as a "mandatory reporter" I could be on the hook federally for allowing a patent to take certain healthcare decisions in to her own hand - I also have to take point of view of what is moral and right in this case. There is a difference between what is "Lawful" and what is "Legal." What the fed is doing may be "legal" but it is "not lawful."


The real reason for all the bullshiat? All of the expensive and stupid alternatives to pot that you mention are somebody's bureaucratic empire. Fewer drugs? Lower costs for care? My God, man, there are careers at stake here!

The more I read the more I lose any sympathy I might have had for her.

First: this is all she is losing " housing voucher", she rents from her aunt and uncle, it is not like they will be tossing her out!

Second: the voucher is from the feds, the state and county and city can give her anything they want, the housing program is federally funded but locally administered and she can not participate in it any longer, but she can partake of any other program not funded by the feds.

Third: renting from relatives, refurbishing the entire property, and saving the "$93 in support for him that she receives each month", to buy him a car no less in 15(?) years! Who feeds and clothes this child?

Finally: "The renewal form asked for her medical expenses, and she gave it to them, including the receipts she could find for medical marijuana after getting a medical marijuana certification eight months ago. She says it helps with her pain." She told on herself but I bet she gets so much help from her "landlords" that it should be counted as income under HUD rules and should be reported to the IRS( it is doubtful any taxes would ever result from this but it is the law and it's your tax money she is getting)
She said ""I didn't know it was wrong for me to turn in my medical [marijuana] expenses when they asked me to - because they tell you not to be fraudulent," Weber says.", it's also fraudulent to accept all those things folks give her like helping with child care, food, taxi service, all those little things that add up to oh, I don't know, maybe $93.00 a month support!! 

Oops, I forgot all about her child's father? Who is he? Does he have any money? The government does not like to pay for stuff if you have any resources that can be used! Where does she get her money from? What ever happened to the guy who was driving? So many questions!?

I think they meant Supplemental Security Income or Medicaid. Since she didn't have a lengthy work history, she could have gotten SSI, which is normally reserved for physically or mentally disabled people from birth, like the blind or extremely retarded. SSI will usually come with provisions for Medicaid. But she worked long enough to make her require SSD. She qualified for SSD, but to qualify for Medicaid you have to meet a poverty requirement. Her SSD payments are probably preventing her from getting Medicaid.

Prigg v. Pennsylvania, 41 U.S. 539 (1842). In 1865 we only settled what a State can do about it if they don't like it.

Yeah I couldn't figure that one out either, unless she actually get no support from the father, and that $93/mo it said she got for him is actually part of the Disability payments. In order for her to only get $93 a month from the father while she's getting something like $750 a month in disability, he must have income of $500 a month or less.

I have a question I've never thought to ask before: I've never done weed (long story, etc.), but I've never heard users rant about how it 'dulls pain'. Lots of lovely descriptions of the things it does, but dulled pain isn't ever on that list.

Until someone has 'chronic' pain.

Does it actually do shiat to pain, chronic or otherwise? Because you never see a pot head stab himself in the nads and go 'sweet dude'.

I support the government enforcing laws as they are written therefore giving credence to those laws. If a law results in an unintended circumstance that corcumstance then provides force to rewrite or change that law. Absolutely. I don't particularly agree with a good deal of government activities but I'm one voice and one vote. The only way for laws to be taken seriously is if they are enforced seriously. Lack of discipline in governmental execution has allowed for rampant corruption, waste and fraud. Due to these factors we arrive at where we are today. With such allowed incompetence we get laws that are not based on logic and understanding but laws such as we are ruled under at present. The federal government is not and should not be your buddy and you should not receive special treatment simply because you are sympathetic. However, as I previously stated public outcry over the various results of the laws can change those laws. What should the government be doing other than applying the laws that are written to direct the operation of the government?

This is FARK. The legality of any particular action is a minor technicality. All that matters is whether or not FARKers agree with the law. If they do, then a story like this gets a "meh." If they don't then pointing it out makes you a complete fascist/authoritarian asshole. As an added bonus layer of complexity, if they like the person involved, then said law (whether they like it or not) should be selectively enforced such that the person doesn't have to suffer the consequences of having violated it.

Medical marijuana helped to reduce this woman's Oxycontin usage. That is amazing! Oxycontin is a very serious and very dangerous drug. I used to take this medication, in high doses, for Cluster headaches, Migraines and Trigeminal Neuralgia. The medication turned me into a human paperweight. My husband went out of his mind trying to deal with me drugged up all the time. But it was the only way to keep me from killing myself from the pain. Eventually, I found doctors who had alternatives to Oxycontin. The alternatives worked and I got to be a human being instead of a human paperweight. The alternatives included a treatment that totally eliminated my need for Oxycontin as well.

Oh gods yes, it dulls pain. It dulls it in a way that the opioids never manage. You aren't nauseous and taking more drugs to counter the side effects of it. In fact, hello appetite. I would kill (ok not literally) for oil production of it here so I could get a measured amount without smoking - cooking is too variable, and I don't want to be out of my gourd. It's an amazing drug but I can't use much as I need to work and, despite its legality here (on the spot fine for possession of reasonable amount for home use), getting caught would potentially ruin the one job I have found that accepts a very disabled woman in chronic pain. And is a joy to work in. I have to smoke it, and I have asthma, so that causes issues. But, oh, on bad times at home, what a relief to feel almost normal again...

Injured nerves often "leak", firing without being told to. When this happens with pain nerves, it causes pain. It's called neuropathic pain, or "phantom pain", because it's a false signal not created by a pain sensor. But believe me, it feels real to your brain.

It's practically universal among amputees and people with major spinal injuries. And pretty common among people like me who've been in less traumatic accidents.

Don't get me wrong I think that what is happening to her sucks but??

To feel pain in your finger, millions of nerve cells pass the pain message from one to the next, in an unbroken chain from your finger to your brain. One nerve cell fires, and that stimulates the next one in the chain to fire, and so on.

Injured nerves often "leak", firing without being told to. When this happens with pain nerves, it causes pain. It's called neuropathic pain, or "phantom pain", because it's a false signal not created by a pain sensor. But believe me, it feels real to your brain.

It's practically universal among amputees and people with major spinal injuries. And pretty common among people like me who've been in less traumatic accidents.

I know about constant pain, I had my hand crushed 20 years ago today. Have had about 16 surgeries so far and it still hurts everyday!

I think there should have to be a criminal conviction under federal drug law before the federal housing assistance can be terminated for her using an illegal drug. They found out because she gave them her receipts. The agency should be allowed to decline to count those expenses for the purpose that the receipts were submitted but they should not be allowed to make or act upon a unilateral determination of fact that a federal criminal law has been violated.

Nope - They (feds) don't need a criminal conviction to do that. They can use civil procedure and administrative procedure which dosn't require a convicition, only an infraction; or, in some cases alligation. It is then up to the person to defend and prove that nothing "wrong," or beg and appeal. The (inclusion) of the receipts was eveidence enough, and therefore an "admission of fault," this giving the agency the power to act in any manner it chooses.

MrBentor, I think you are misunderstanding the term "mandated reporter". That has to do with reporting suspected dependent abuse. A Client's use of med mj is hardly abuse and you are not mandated to report it.

Lotta derp in these comments. But this woman made a lot of poor choices as well. Spending $10k on a house you do not own? Self-Reporting illegal activity to her housing authority? My understanding is you are not allowed to save over 2k if you get subsidized HUD housing or medicaid, but I may be wrong on this. Not that that rule makes much sense.

Ultimately, zero tolerance ties the hands of the local authorities. Zero tolerance laws are terribly misguided. I do hope they're able to amend this before she gets evicted, but I've seen people evicted from second 8 for less. And other second 8 users who should be dropped from the program but are not.

Its not the end of the world if she does get evicted. She can get benefits again in 3 years according tfa.
