Even where it is legal, employers can still fire you for smoking it. Now if it's a state where you can get a prescription and you HAVE a prescription, it might count as medical discrimination. Except I think those are federal antidiscrimination laws and the fed doesn't consider that prescription valid. If it's recreationally legal (Washington), and no prescription is needed, then they CAN still fire you for it, especially in states with no right-to-work laws (where they don't have to legally justify why they fired you), after all, they can require you can't use TOBACCO products as a term of employment too.

But there's no widely available test for the SYNTHETIC pot. Tests do exist but these commercial testing labs are slow to adopt new things. The industry never relied on addressing rational concerns anyways, so it's not hard to continue indefinitely testing for just THC metabolites and ignore the synthetic tests because there's a lower profit margin.

I actually smoked some of this when it first came out. It worked almost exactly like normal weed. The problem was strength, as it varied from brand to brand. And smoking too much sucks. Just like normal weed, you can smoke so much you feel your heart pounding, etc. But then they went and banned the first chemical used, so they changed it, and it kept changing until it's not remotely like the original stuff, and probably much worse for you. There was a short window it was actually pretty good, and cheap as hell. I'll probably grow a third arm out of my back or something, but whatever.

I'd much prefer real pot to simply be legalized, because it was nice having something I didn't worry about being pulled over with, and I could even fly with it.

A couple of years ago my bro got me a 3-gram bag of pure JWH-018. A tiny amount was enough to get very high. A little more than that was enough to get way too high. One night after taking a small puff, I lay in bed and watched my consciousness wink out like an old TV. I literally thought I had died. "So that's how it happens," I thought. Then I thought "Aw, HELL no!" and got up. I learned to be careful with it, and it lasted me almost two years. Not as fun as the real thing, but it definitely got the job done. When I ran out I was glad to be done with it, and I haven't missed it since (about 3 months ago).

In case someone has not noticed yet, the dumb ass author is referring to bath salts. Obviously their extensive research did not turn up the difference between pot, Marinol, and blended street drugs.

I understand that the battle for widespread legalization of marijuana is just beginning, but this is an area that needs to be addressed soon. I suppose that first there needs to be a test that can show if you are still under the influence of marijuana or not, as the current tests can detect use long, long after full sobriety has returned.

For the record, I think it's bullshiat that employers can refuse to hire or fire someone for using tobacco, which is completely legal, as well. If you want to ban smoking on your premises, go for it, but an employer should have absolutely no say in what an employee does in their personal time as long as the activity is legal, doesn't interfere with work, and doesn't bring bad publicity to the employer.

Showing up to work high should be a terminable offense just like showing up to work drunk, but smoking a joint at home the night before and arriving clear headed and sober in the morning shouldn't be treated any different from having a couple of beers the night before and arriving clear headed and sober in the morning.

When Spice first showed up in my area they were way more expensive than good bud. $20 a gram, strictly by the gram. Or you could go to the weed store 2 blocks up and get 2 grams of sticky icky fresh out of the jar for $25.

They did offer an appreciable high for one looking to replicate a "stone" without failing a drug test, but the tolerance built up very fast IIRC, and the price made it prohibitive unless you smoked very little/had plenty of disposable income. The high also had a shorter duration versus real weed, you had to smoke it more often if you were a habitual user.

Now that Washington has legalized it and they are making regulations for the market, I'm hoping to see more states I follow suite. I predict they will, and used WA's regs as a baseline for their own.

WTF is synthetic pot? I've tried Marinol and those capsules were so strong I felt like I had eaten a brownie. Anyone that takes Marinol without regular experience smoking marijuana beforehand is in for a baaaad trip. Seriously. I can't believe my stage 4 stricken mother with cancer was prescribed this stuff ($738 for 30 pills) by one of her oncologists. He didn't believe in the merits of regular medical marijuana since it was an evil drug, so he prescribed Marinol.

I understand where that argument comes from, and IMO it steps far over the line in terms of how much control over your personal life an employer should have.

If someone can't get their job done because they are sick all of the time, fire that person. Don't try to control lifestyle choices just to help the bottom line - it's fascist.

As far as health care costs go, that's one price we pay for living in a free society. If someone wants to live on a diet of McDonalds and Marlboros until they're on oxygen and unable to fit through the front door, that's their choice. Yes, it means that we all have to pay a little bit more in terms of health insurance to keep them alive, but it's worth it to know that we live in a society where someone can make that choice.

So, the fake synthetic pot remains illegal in Washington State, you can and will get busted for that. In fact now that the state has no requirement or power to go after and punish people for marijuana, they will be focusing those resources on other, still illegal, products, like synthetic. or smak, or meth, etc. The only thing the state will be doing is investigate that the taxes were recorded and paid at each step of production and that quality and sourcing regs are met. It is likely the fines and punishments for synthetics will go up because of the competition to the now (at the state level) legal stuff on a taxable basis.

So... under State laws in Washington, marijuana is now legal, why use fake?

Besides under the implementing state regulations (WAC) that are to be written to implement the statute (RCW), there will be certification and testing requirements for the strains of pot being grown and sold. The growers will be required to prove the quality and strain of marijuana they are producing.

/Yes Mary, I understand it is still all illegal under federal jurisdiction. We are just talking about at the State and local level.

i don't disagree and wouldn't work in a place that regulated legal off work behavior. others will. Samsonite luggage has been no smoking anywhere or when for years now. IIRC when they put it in they helped folks quit. don't quit smoking quit them, that was the choice. many stayed. personally when i found out they did that i stopped buying their products and encouraged others to not buy them.

i have a real problem with making it illegal to smoke in restaurants and bars. especially bars. want a smoke free bar? open one, get your smoke free friends to go there.

i smoked until i ended up in the hospital with a COPD exacerbation a year and a half ago. still hang out with folks that smoke. and those that don't too.

In regards to the comments about employers and employees using pot. Employers are still permitted demand that employees do not use marijuana, they are still free to test employees and fire at will. That doesn't change. As a matter of fact there are now companies that test their employees for tobacco use and demand that the workers do not smoke as condition of being employed with them. Tobacco use is a grounds for termination. That likely won't change with pot users.
