You do realize that coffee is regarded as safe for human consumption by the FDA, right? It becomes different when you sell it "pure" or mixed in with other medicines ("No-Doze"), and that "pure" caffiene is considered a pharmaceutical agent that can only be marketed for conditions it's considered effective and approved for, right?

Marijuana, on the other hand, has been a Schedule I/Schedule II drug (Marinol) for most of the 20th and all of the 21st century. Medicinal dispensaries get away with selling it because they don't market it as safe and effective for treating an illness, disease, or condition, and it's treated as an "off-label" drug by the FDA for those purposes. It's illegal to advertise it, but not illegal for a doctor or intermediate practitioner to recommend for the condition.

On the other hand, the FDA can come down hard on commercial recreational sales of the drug because it was never approved for general sale as "safe for human consumption", and is not an OTC medication. In addition, it cannot fall under the realm of a "dietary supplement" because it is considered a prescription substance.

It doesn't matter about an ethical debate. Ethically, if you want to touch on it, there is a major problem with pushing substances for conditions it is not proven to be effective in treating by research. Nor was it intended to spark an ethical debate. I was meerly pointing out why I have said decriminalization is going to be FAR easier than retail sale for recreational use or commercialization as a recreational substance alongside grandfathered substances like ethanol and tobacco.

Like if I were homebrewing again, I couldn't sell my beer, but I could charge $5 for an empty cup and give the beer away for free.

I'm not so sure he's aware and I don't think the law works like that. If you're advertising a weed tour, and say that weed is included in the price, then you're selling weed. If you advertise it as a regular tour which is weed friendly, and then give out weed along the way, that would be fine.

Of for crissake. Some of you are paranoid and obtuse. The guy is conducting a tour, the price is for the tour. Weed samplings are complimentary gifts. He f*cked up by announcing to the media that the weed was included in the price; had he phrased it as complimentary samples it would have been better.

Based on his appearance, his quotes in the article, and this^ other article, I don't get the sense that Robert Flatt has a very good concept of the new law. (Nor, from my research, does he have any prior experience running tours.) Yeah, I don't know anything about Marijuana. An ounce sounds like almost nothing at all to me so I wouldn't think that would be enough to share around an entire tour group. But I have no basis for judging, so if you say that would work then I have to believe you on this one. Sounds like he found a loophole. There is still the issue of how each location gets another legal ounce in time for the next tour, but I think the police will give even that a pass until the licenses are out there and in use, then they will go after a guy like this if they think he isn't purchasing from a legal retailer.
