Enh, to be fair there are circumstances. I had a child in the hospital when I had to testify as a witness and told the judge. He told me it was fine if I left the cell on and if the hospital called to tell him and he'd let me off the stand/call a recess. The trick is to ask politely in a manner which shows you respect their authority (and have a legit need).

There seems to a whole generations of people now who think they are owed respect but won't show any to anyone and will react violently if they believe someone is disrespecting them, no matter who it is, in this case a judge and the court officers.

It seems like they would rather be arrested and go to jail than act in any way as if they accepted that someone else might have power over them. The only thing they seem to submit to is force, not the threat of force but the actual use of force.

Meh, the whole "proper decorum" thing can get out of hand. I once went to court and got pulled aside by the bailiff for not wearing a coat and tie. He escorted me into the broom closet where they kept a few blazers and ties handy for miscreants like myself. The judge looked at me like "oh, you're wearing that."

But even entering a court room without first turning the phone off is just asking for trouble. There's a traffic court judge here who confiscates them and donates the proceeds to the battered women's shelter once a month. It's amazing how many people are dumb enough to think they can talk on the phone when there's a huge sign on the door warning against it.

This woman is an asshat who deserves whatever penalty is imposed upon her. This case is also a good argument for allowing cell phone jammers in this country. Install one of sufficient power to cover the entire courtroom. Put the switch at the bench within reach of the judge. Arrogant biatch starts talking on her phone, the judge flips the switch, problem solved.

that is not a legit circumstance. who cares about some kid in a hospital ? you can't change anything from where you are so the information is not really important. this sounds made up. if it was sooooo serious, you would have just skipped court to be their for your snowflake's last breath.

You'd be surprised. I've had the pleasure of the court system twice (divorce and custody modification). You'd think people were raised in barns. There's even a sign on the court door that says "turn cell phones OFF". My ex was busted texting during our modification. The judge told her to turn it off, she told him that the phone functionality was off but she still needed to text as she was waiting to hear back from her loan officer to purchase a new car. He told her to turn it off or lose it. He glanced at me for about 3 milliseconds. In that moment we exchanged a lot. I got the modification order I was seeking.

I shudder to think what would have happened had she pulled that in the courtroom of one of the Judges I used to work for. The son of a MS Sharecropper, got himself a scholarship to college because of his mathematical genius, joined the ROTC because he needed to support his mama and his borthers and sisters, became a green beret (while black, in the late 1950's) Went to Vietnam twice, once in '62 and once as a full bird in '68. Came home quit the military put himself through lawschool, became a D and then a judge.

I tell you this to tell you that he might have been the hardest hard-ass ever to sit the bench, and someone infamous for how much he didn't suffer fools, but, frankly, he'd EARNED it.

I recall him talking to a juror who was an hour late back from lunch because there was a sale she just couldn't miss, and in his sweetest tone he asked her about what she'd bought, how much she'd saved, and then with Iron in his eye said "good. Glad you saved all that money, it'll help you pay the fine I'm about to give you" WHAM!

Worse yet was the new ADA who didn;t realize the judge's insistence on formality and decorum while court was in session. He asked the ADA if he wanted to "Voir Dire" a particular witness using a flawless french pronunciation and the lawyer, slightly mockingly, said "VWAW Whut your honor?" and in open court, before the defendant, the jury and everyone, the Judge leans forward, in this tiny quiet voice that meant to those who knew him, that he was seething "Mr Jones, please get up out of your chair, and go immediately to Mr Johnson's (the DA for the county) office and give him a message from me" The attorney, a little baffled since trial WAS going on said "of course, what's the message?" and the Judge said "Tell him that Judge X would like him to send a REAL LAWYER to his courtroom to replace you in this trial"

Question for the Americans: How can a judge immediatly hand down a jail sentence for contempt of court?

I'm not talking about this case, there was one recently where someone called the judge a dick and was sentenced to 60 days.

a) What about that freedom of speech wargarbl? You'd think that ranks higher than hurt feeling from a judge

b)What about the right to a trial? Even if you say he got it immediatly; the judge who was insulted is biased and would be exchanged for another one if it would be anything else.

Two kinds of Contempt of Court:
One is civil and can be handed down at the discretion of the judge in order to preserve decorum, enforce his orders, or deal with infractions by counsel in his courtroom

Criminal contempt is an actual criminal offense and so you get the who due process thing including a right to counsel, a formal indictment, the works

If civil contempt is used to incarcerate someone until they comply with a court order, it, in most places MUST be converted into a criminal contempt charge with a definite sentence (Civil contempt can hold you until you agree to comply with the court order) once it is obvious that the person held in contempt will not comply with the court's demand under any circumstances

The First Amendment, like all civil rights is subject to "reasonable restrictions on time, place, and manner where such restriction advance a compelling governmental interest in the least restrictive way possible"
Proper administration of justice requires a courtroom free of distractions so that evidence can be given and heard properly. Yakking on your cell phone disrupts that

The judge is a tax payer too. So that argument doesn't come close to holding up. In a room full of otherwise equals the highest ranking employee trumps all else, and that would be the situation in the court room regardless of the other legal factors that give him the ability to ban people.

Enh, to be fair there are circumstances. I had a child in the hospital when I had to testify as a witness and told the judge. He told me it was fine if I left the cell on and if the hospital called to tell him and he'd let me off the stand/call a recess. The trick is to ask politely in a manner which shows you respect their authority (and have a legit need).

that is not a legit circumstance. who cares about some kid in a hospital ? you can't change anything from where you are so the information is not really important. this sounds made up. if it was sooooo serious, you would have just skipped court to be their for your snowflake's last breath.

Um, maybe because a child cannot opt to have surgeries and other medical "things" done to him because you know they are a minor and are not allowed to make legal decisions. So an adult parent or legal guardian must make those choice and sign those papers.

Cell phone jammers are proven technology. Some countries use them to prevent terrorists from setting off bombs. In some countries they're used by businesses such as restaurants and theaters to keep people from disturbing other customers. Japan is one such country. There business owners put up a sign warning customers that a cell phone jammer is in use. In Mexico the priests at a big catholic church got tired of services and weddings being disturbed by people with cell phones. They install a cell phone jammer and the problem was stopped.

I do have to admit there is an appeal to the idea of a judge ordering the asshat with the phone to be beaten. However there would be all those messy lawsuits arguing cruel and unusual punishment and so on.

A. You have no freedom of speech in court. Everything is on record, and the defendant's right to a fair trial trumps everyone else's right to say what they want. The judge is charged with keeping not just decorum but controlling what is said so that nothing prejudices the trier of fact against the parties. If people were allowed to talk freely in court, it would jeopardize the whole reason the court is there in the first place.

B. The judge doesn't have absolute power to jail someone for contempt. Usually, he can only hand down a term of up to six months (depending on the court and the jurisdiction). More often, it's a fine rather than incarceration. The reason there is no trial is because the sentence is being imposed by the judge already.

People have tried to challenge contempt citations and demand a right to trial, but usually they don't come to much; mostly because of the nature of the charge and the way it happens: Did you talk in court? Yes. Did the judge tell you not to? Yes. And did you still keep talking? Yes. So what's your defense? Free speech! You don't have a right to free speech in a courtroom. Any other defense? Not really. OK, time served.

I've been in court with at least a hundred judges, and very few of them were egotistical. Only a couple could have earned the description "hard-assed."
