I am from Long Island.

My son's room was walled off from the garage.

I wanted to have a cinderblock partition to prevent an accidental acceleration from a car crashing through the wall. I was overruled & plain particle board was used.

Luckily, all is moot as Hurricane Sandy completely destroyed my house. The End.

I see, so that's how the city plans to avoid responsibility for the child's death. Next step, press charges on the family - to be eventually dropped if the family can afford a lawyer and force the city to actually go down the chain of ownership to find when the modification happened. And, just like that, it's now all about the fault of the family/house/structure/owners and nothing to do with a careening city bus.

The fact that the porch was converted from a porch to a bedroom without a permit has no relevance, unless you are telling me that as a result of a permit applicaction the city would have said "no, you cant convert it to a bedroom. A bus might crash into it and kill a kid." I have no doubt they would have said no to such a conversion but I find it highly improbable that concerns about a vehicle hitting the house and killing the occupant of the bedroom would have entered into the equation at all.

This is just one of those shiatty things that happens in life. The kid may just as well have been killed by a plane falling into his bedroom in the back of the house, or if the bus had more momentum and he were in a different spot, killing him in the front room.

More importantly, what business is it of the city if you convert YOUR OWN porch to a bedroom? That is the homeowners call. Screw the permit requirements. Government needs to get the heck out of peoples lives and quit being so unnecessarily intrusive.

This isn't some HOA pink-flamingo thing. Building codes are primarily there for safety reasons-- for example, structural strength and proximity to roads, to name two. Would the boy be alive if he was in a real room and not a tacked-on shack? Maybe yes, probably not. It got hit by a damn bus. Does that mean you should WARBLGARBL if it gets mentioned? No.

I don't think anybody would have actual objected the the concept, but the permitting makes sure it's done in accordance with code, which makes it safe. Otherwise you might wind up with a hack job on the wiring that catches the house on fire, walls that fall down in a stiff breeze, sub par framing that spreads fires more easily, and so on. Some of those issues can lead to big problems for your neighbors when houses are crammed close together like that. Still, no building code for domestic housing would have protected against bus crashes, so this is still completely and utterly irrelevant.

The law doesn't work that way. For example, if I'm at fault in a car accident with an unlicensed driver. It doesn't suddenly become the other guys fault because he wasn't supposed to be driving.

When I buy or rent i don't want to worry that people can do whatever they want to a house without any codes. Building codes are a public safety issue. Your libertarian world is a place like Haiti.
