I think part of it is that teabagging has a role in online games and that crap where it's a humiliation thing and a lot of farkers are responding to that effect - "this wasn't sexual assault", etc. But if you start claiming that difference you get into a slipperly slope. What if it had been a female fan? What if it had been his dick instead of his sack, pressed to dudes lips instead of his face? I don't think you can say this OBVIOUSLY isn't a thing, because you're taking it in the context of "bros being bros in sports" and not the act of one person forcibly rubbing his junk on someone else's face.

And also agree with others that the "its your fault for being drunk and passing out" excuse has been run to death in rape discussions and there's plenty of precedent that that excuse is BS. Dude could've been passed out from a stroke or something for all Sacky Jack knew. Always telling to see who rushes to demean the victim instead of acknowledging the teabagger was an asshole manchild with adjustment issues. If he had just drawn something dumb on dude's face we would still be an asshole but laughs could've probably been had eventually.

I know I wouldn't chuckle it off if some sweaty alabama fan (shudder) had deigned himself hilarious enough to do this. I would be thinking of IAmRight's link about fatal scrotal crushing. Which would be a sweet band name.

You could say that about any person who has ever been the victim of any crime while in an intoxicated state. There are people on this earth who will take advantage of people in an weakened state. Apparently, when it comes to Alabama fans, that includes putting a scrotum on you as a display of your dominance over another person because a team you like bested a team your victim liked in a sport while you sat on your fat, drunk Bammer ass finger-banging your sister in the plaza level of the Superdome contributing not a goddamn thing to the outcome of the game that made you decide the world needed to see your bare junk on some idiot's neck in a Krystal burger at 3:00 a.m.

I think you people are confused by the assumption that fault is an either/or question. Could the victim have done something to prevent this from happening to him? Yes. Does that make it his fault? No. Could he have prevented it from happening at all? That depends whether or not there would've been another passed out fan of the wrong team waiting for a teabagging.

I think what's confusing people about the sex offender possibilty is that his motive was not sexual gratification. Of course, this is not required in order for someone to be guilty of sexual assault, but I can see why people might think it is or should be.


Oh I agree with you. The rohypnol comment is just my bad attempt at humor. Still don't drink enough to pass out in public. If that's what you feel you need to do then stay home, go home or make sure you're with friends you can really trust if they're drunk too. I remember the cruel shiat my friends and I did to each other. Stuff that you had to be good friends to get away with. We didn't do shiat like this though, much less to a stranger.

Yeah your right. I see that a lot, especially with kids that they think anything is ok if their social circle does it, or its not specifically illegal that its ok and consequence free. Nope. Really good article. Both dudes are pretty good guys. The teabagger might have gotten away with it if he just apologized to the guy. Also pointed out in the article, he is going to a boot camp facility and will not have to register..

I'm glad there are folks out there that can tell the difference between a stupid drunken "prank" and a sexual assault.

I think the guy does deserve some jail time though, which apparently he got.

Lack of sexual intent on the part of the perp doesn't mean the victim wasn't sexually traumatized by the act. Before you go full wharrggggrrbblll! and say something stupid like "someone could say be sexually traumatized by me opening a soda bottle in public," it is not merely that the victim was traumatized, but that the victim was both assaulted and sexually traumatized and it is reasonable that he is sexually traumatized.

As a defense attorney, I'm wondering what this guy's prior record was. This act was not about sexual gratification, nor was it violent. It was a drunken prank. With no prior record he would have most probably been placed on probation with a strict no alcohol rule.

There definitely are some aggravating factors, the fact that it was broadcast doesn't help but I don't think the defendant had any control over that. Also, he may have gotten a bit homered, an LSU fan doing this to a 'Bama fan probably wouldn't have been treated as harshly.

Why not some financial restitution and community service? Everybody wins. Except the prison industry.

I think they should have the guy wear his Bama fan gear and film a short video of him sewing LSU clothing for the homeless in New Orleans. But that would probably be cruel and unusual punishment, so instead we should send him to prison for regular ass-raping.
