Someone being a tool about service? *Boom* ex parte application for substitutional service, or to have service declared effective--which apparently happened, but far too late. Some of the delay seems like a failing of counsel.

Be glad to:

a) The author of a comic called "The Oatmeal" posts letters from the derptard lawyer (that will be the subject of the thread) which are basically threatening to sue The Oatmeal's creator for asking another site (that the derptard lawyer) represents to plz take down stuff they did not have permission to copy. Much lulz are had at expense of derptard lawyer's attempts at essentially an extortion game.

b) Collossal derptard lawyer (who is a troll and a half) tries to sue The Oatmeal for making fun of him, fails.

c) A second cartoonist (who is a fan of The Oatmeal) starts making parody comics making fun of collossal derptard lawyer.

d) Collossal derptard lawyer tries to, in turn:
i) Sue the second cartoonist for trademark violation (the lawyer is such a collossal douchecanoe that he trademarked his own name) in yet ANOTHER extortion attempt
ii) Tries to get the guy fired from his job at a Walgreen's (claiming he was doing non-work stuff at work)
iii) In general, tries to make the second cartoonist's life a living hell.

e) Second cartoonist gets some help from lawyers from a number of well known free speech organisations, and (in layman's terms) basically asks the judge to rule that the second cartoonist did nothing wrong (because you can legally make fun of someone) and to throw the case out and to legally declare the derptard lawyer a Douchecanoe of the First Order. (Of funny note here--one of the lawyers who is helping out the second cartoonist also defended Larry Flynt's famous parody advert taking the piss of Jerry Falwell. Second Cartoonist Is In Good Hands.)

f) Lawyers for second cartoonist try to send notices to the derptard lawyer to the effect "Hey, we're suing your ass for damages because you're being a douchecanoe". Derptard lawyer goes to some extreme, and quite possibly not legal, and definitely non-lawyerlike means of avoiding getting the "we're suing you" papers in hopes he can make the case go away:
i) When they tried to mail him the "we're filing suit" papers via certified mail, he mailed them back in envelopes.
ii) When the lawyers for the second cartoonist hired someone to deliver the papers in person, the first time they were refused and the second and third times...well, the derptard lawyer made sure he wasn't at home.

g) Lawyers for the second cartoonist finally catch the derptard lawyer as he's leaving court (from another case) and give him the "we're suing you" papers--which means that the derptard lawyer will have to show up in court within 21 business days to let the judge know what he's going to do about it.

h) If the lawyers for the second cartoonist are smart, they'll talk to the judge about a few things that could well mean that the derptard lawyer doesn't get to be a lawyer anymore :D (Avoiding legal service when an attorney--that is, trying very, very hard to NOT receive those "we're suing you" papers--could be a factor in a future disbarment hearing, methinks.)

Yeah, but... this is Florida we're talking about here. It has its own Fark tag. Now granted, Arizona sorta does as well, but they're known more for being gun-toting racist assholes. This guy being a complete and utter whiny pussy in their state I can't see ending very well for him.

Not only that, but (if memory serves me right) the Aforementioned Derptard Lawyer is actually licensed in California, which has a remarkably low tolerance level for legal sillybuggers by attorneys (Florida is actually one of the more lenient jurisdictions for scummy lawyers, to be honest).

Jack Thomson also pretty much only really stuck around because he had close friends among dominionists in the Florida legislature, which is not quite so true for Carreon (once upon a time he did have some cred in First Amendment lawsuit circles, but he's well and truly pissed away that goodwill at this point). The real impression I get with Carreon is that he's playing a legal version of Internet Tough Guy, whilst not realising that judges in a lot of jurisdictions frown upon this.

(Pretty much what made Carreon back down from his lawsuit against the author of The Oatmeal was that the EFF stepped in and made it very clear that if he tried anything they were going to file charges against him under California's anti-SLAPP law (which is very strict, and lawyers who file a SLAPP lawsuit can in fact be disbarred as a sanction under the law). I expect he settled in Arizona hoping to have a more profitable legal environment, but unfortunately for Carreon, Arizona also has an anti-SLAPP law that, much like California's, gives defendants the right to petition the court to not only dismiss the case but to explicitly sanction the attorney who filed the SLAPP. As it turns out, the lawsuit against Carreon was filed in San Francisco district court--meaning that California anti-SLAPP laws come into play.)

(The derptard lawyer also threatened to file suit "in Arizona, California, or Florida" or in the author's home state (which is apparently California, sucks to be Carreon)--and all three have SLAPP laws (Florida's by far being the weakest, pretty much restricted to government lobbying and prohibiting SLAPPs by HOA owners against their membership). California...pretty much has set the benchmark re anti-SLAPP regulation and action in the courts, and I think Carreon may well find his life becoming interesting in the Chinese sense if he carries on (pun intended).)
