I agree that these allegations are probably fake. But Sesame Workshop cannot and should not take responsibility for an employee's private actions. The accusers may go after them, but their lawyers need only say: fark off.

So far all three of these alleged underage gays say met Clash in a gay chatroom. If they were underage and hanging out in chatrooms, they knew what the deal was. To come back 12 years later and make accusations is ridiculous. No judge should even hear their cases; they should be summarily dismissed.

People in positions like this really should be more careful. Being gay is enough liability (in the eyes of some people). Having hookups is a liability for anyone. Having gay hookups when you're the frelling voice of Elmo is pretty unwise, regardless of the ages.

Hoping this gets taken care of with a minimum of collateral damage.

I like how the lawyer had him file as a John Doe -- trying to signal that his client should be treated like a rape victim. May be technically justifiable because they say the victim was 16, but that was 13 years ago. Of course his real name will be outed. And their story is that the 16 year old met Elmo because he (the victim) was trolling for men. Case sounds like a real stinker.

When this first came up (no pun intended) it was Elmo puppeteer in underage sex scandal, so the first thought was that he was bagging 10 year olds that were on the Sesame street set. Hang him high!

Then as you actually read past the headlines, it was 16 years olds, they met in a gay chat room, they got together for consensual sex, and now it's like...well not so sure what the issue is

I'm not defending criminal activity, but it's interesting to note that 16-year-olds wont get you into trouble in some surprising countries.

In Canada, for example, so long as you're not in a position of authority or trust over the person, 16 is the legal age of consent. Doesn't excuse any lawbreaking that may have occurred, here, but it opens the door to discussions about when a person's physchological abiity for intelligent "consent" really kicks in. I'd lean towards later, rather than earier.

If that's the story that Clash wants to go with - that he's the real victim because these kids got him horny - then he's going to be on a fast bus to prison.

Ironically Romney didn't kill Big-bird but Obama killed Elmo. I suspect this whole thing started when The Obama campaign went after Romney over the Big-bird thing and people started looking at what Big-bird and the others make. Once the realized that Elmo had to be making 300k plus the race was on to see who could file a lawsuit the fastest. He's not deigning doing it just arguing the age. But if he was 40+ and deliberately scouting kids that latest looked boyish then I think he deserves what he gets. Not convinced the guys suing him are truly victims but he is a sicko.

He also wasn't using his position to initiate these encounters (which is what most molestors do) he did although it would seem enage in sex with a few minors of the age of 16 who were willing partisipants. Unless there is evidence of some intent to find 16yr olds and or continued relations after having become aware of their age i dont see something worth a lawsuit. As for not going to the police its obvious they lack evidence, and or are looking only for a pay day.

Know how I know you were never sixteeen? If eighth graders can be horndogs, a third-year high school student is plenty able to consent to all sorts of things. They just shouldn't be consenting to it with people three times their age.

These young people were allegedly in a gay chat room that existed for the purpose of soliciting sex. They deliberately went there with the intention of finding a specific thing. At issue here is that Clash, again allegedly, took full advantage of the situation by going there himself to pick up. It's like the girl who shows up prom a purse full of rubbers and no underwear on: She's hooking up with somebody, but it's still wrong for her to end up in the handicapped bathroom with the librarian.

It's alleged he took advantage of young people, but let's not polish the halo on these alleged victims too brightly here because they were almost certainly fully aware of what they were doing.

From a legal perspective regarding New York state law? I don't disagree. That wasn't my point. My point was that to compare this to Catholic priests who are molesting 11-year old choir boys? No idea. It was until recently the case here that a fourteen year old could consent to non-anal sex with anyone other than someone with whom they had a relationship based on trust, authority or discipline. That's since been adjusted to sixteen with a near-age exemption for teenagers that's somewhat complicated and mostly doesn't apply to adults, and I sincerely doubt the anal part would ever be upheld by even a superiour court judge.

Actually the age of consent in Canada _is_ 16 unless there's a "position of trust or authority" situation (teacher, doctor, etc), a "relationship of dependency", or if the relationship is "exploitative". Then the age of consent is 18. Lots of US states have a similar thing if their general age of consent is under 18. And most places, including Canada, also have "close in age" exceptions, also known as "Romeo & Juliet" laws.

I often stop to wonder in this crazy time that we live in what impact the number of people who absolutely despise Elmo (you know, before these allegations even) have on this sort of situation. Seriously. I do. With everything else up in the air, I really don't see any more crucial question to be asked in this PR miasma we sometimes accurately dub "the court of public opinion".


What I do know is that- true or not- this man no longer has a career.

Not because it's fair, or because it makes a lick of rational sense, but because the concept that childrens' performers can and very often do have sex lives outside of their careers is something the American public copes with about as good as any herd of prepubescent teenagers discovering their dad's stash of Playboys for the very first time does.

It's interesting to me that the guys aren't reporting these low-level crimes to the police (in Maryland, where Clash is from, 16 is the age of consent, and 15 is a fine and/or up to 1 year in jail, don't know about other states). Instead, they're going to the media and filing high-dollar lawsuits.

Let this be a lesson: always check government-issued IDs before sleeping with a random hook-up with anybody who looks under 21.

Yes, because the burden of proof in a criminal case is higher than the burden of proof in a civil case. If they have sufficient evidence that a jury is 90% sure that they were underage, that is way more than enough for a civil case, but not enough for a criminal case. That they can't get to a 99.999% sureness level doesn't suddenly mean they have no evidence, or that they're lying or just looking for a payout.

In Canada, for example, so long as you're not in a position of authority or trust over the person, 16 is the legal age of consent. Doesn't excuse any lawbreaking that may have occurred, here, but it opens the door to discussions about when a person's physchological abiity for intelligent "consent" really kicks in. I'd lean towards later, rather than earier.


18's only the age of consent for arranging hookups across state lines in the US, Statutory rape and exploitation of a minor are in themselves matters of state law, and in most states the age of consent is 16 or 17. I believe in the state in question it's 17.

Is there a time qualifier for 'obscure' on FARK? I think if a reference has gone unreferenced after 30 minutes it should qualify as 'legitimately obscure'.

If I was 16 and slept with men much older than me (actually I did), I might count it as a stupid decision later, but I wouldn't try to make it a crime for anyone,. ESPECIALLY if I'd been out looking for it. I may have been naive, but I still made my own decisions. And I don't think these young men were "naive" either.

Yeah, but now make yourself a republican who wanted Mitt Romney to win, and have a lawyer tell you that you could make a quarter of a million dollars by claiming you were molested.

Thunder is right. If the lawyer in this case was doing his job he already tried to sell it to the DA's office and they told him no for the reasons mentioned in this thread.

BTW when a lawyer wants to use the threat of criminal prosecution to bolster a civil case, there is a fine ethical line the lawyer has to tiptoe along -- roughly, she can try to involve the cops, but can't use that to pressure the defendant.

It doesn't apply to Canada. The age of consent is 16, meaning it's perfectly legal for a 95 year old man to have sex with a 16 year old. There's a separate position of trust provision that applies until 18, but a gay chatroom hookup isn't going to involve a position of trust.
