Putting him in jail will create a dependant personality. A criminal record will kill any chance for anything more than a base wage. Jail time will simply mean higher risk of reoffending.

Ordering a juvie to do chores, and to learn from his mistakes; to give him a chance; wow. That is how it SHOULD work.

Prison? What is it for any more? NOT rehabilitation. No. Purely punitive. And that is not what it was originally intended to be.

We presently have a 300 year old punishment system and are wondering why it doesn't work.................................................................. .................

Though I agree with your sentiment when it comes to juvies, there is really no consistent original intention other than to remove them from society for awhile. Whether it is for punitive or rehabilitation reasons has changed so frequently and the management decisions so localized to the particular region, generalities like this don't apply really well.

I have to agree with you. Send people to prison/jail for any reason other than protecting society, and it simply creates a better criminal. After a person has a record, it's damn near impossible to get a good job where the boss is fair with you (because they know they can exploit the fact you are on parole... so in essence you get punished twice for one crime). We need a better system in place. Just brainstorming here, so don't all kill me at once, but...

For people that need to be incarcerated for the safety of society:
1> Imprisonment (obviously)
2> Treatment (psychological)
3> Instruction (test for their strong points and train for that skill)
4> Release program that assists them in gaining employment when released, and put a program in place so that they may report exploitation by an employer

For people who cannot be rehabilitated:
1> Imprisonment (again, obvious) - solitary cell for the most violent/dangerous
2> Treatment if possible
3> Well, there is no 3... see 1

For people who are not a real danger to society:
1> See what this judge did
2> There is no 2

Since I'm bored of the "too much vs too little punishment" argument right now I decided to google "applurse" and see what happened. There are more results than one might initially expect, though the most fun has to be an article which opens with the disclaimer "Electronically Translated Text". Here's an excerpt:

What I would suggest is a good old fashioned ass kicking from the person/people who were robbed. And maybe a whack on the nose with rolled up newspaper for all who cant check their own spelling. Can I get a harumph?

No mention of restitution. Doing chores around the house is insufficient. His mom and dad are not the victims here yet they are reaping the benefits. Family, including mom and dad, should be made liable to make the real victims whole again. Consequences don't need to be imprisonment but they should be more substantial then making sure you put away your socks and underwear, clear the table after dinner and take out the trash.

Yeah the victims got dicked over. Amends should be made to them as well. He should be made to do some community service as well.

I guess they don't have a Constitution that forbids "cruel and unusual punishment". Judging from the look of him, I'm glad. Maybe they could try being a little more cruel and unusual. Add cleaning out the cat's box to his chores.
