(Daily Mail)   You are a manager at a top New York hotel and you go into labor and give birth in a room. Does the hotel: A) insist the EMT crew go out the side door so as not to bother guests, B) dock you for the hours missed, C) fire you, or D) all of the above?   (dailymail.co.uk) divider line 108

The side door thing was stupid on the hotel's part, however federal law doesn't provide for paid maternity leave (whether it should or not is another question), and I'm pretty sure New York isn't one of the states that requires it either. It's entirely up to the discretion of the employer in most parts of the country. If she's a full time employee and worked through her entire pregnancy, it seems like she ought to have sick leave to use. As for the termination, the hotel is in trouble if they terminated her for the reasons she stated mainly because federal age discrimination laws kick in at 40. But unless she as some corroborating evidence, it seems like it would be a hard thing to prove.

I think it's a picture taken from the High Line. The High Line is pretty interesting. It's an elevated rail line turned into an urban park.

The hotel is known for giving walkers on the High Line a view of people having sex.

Tan was fired earlier this year after being accused of stealing boxes from her office -- a charge she denies.

Stealing boxes.... no, that can't possibly be a false corporate excuse.

Gee, even from the wildly one sided complaint drafted by a plaintiffs' lawyer, that thing sounds fishy as hell.

She called her husband, who came in from Jersey, who delivered the baby in a room.

Hmmm. It was easier to come in from Jersey than take the elevator to the lobby? Gotcha.

The Standard Hotel is an espically douchetastic hotel. In its effort to edgy it comes off as really kitschy in my opinion.

That being said, if she was an independent contractor she should have had a contract. But I'd assume most managers are salaried and in NYC we do have a time that has to be alotted for childbirth (I think for men too). But I'm assuming she is somehow hourly. Really sucks for her.

Not worth a bookmark. One guy with a shirt off, and two chicks that are so blurry you can barely make out a butt. It's probably NSFW (cause it says exhibitionists in the link), but not worth much at all.

Well naw, if she's the mother of two over forty, unless they're twins, she's 80+. Of course she doesn't have the physical attributes to work in the hotel.

me too. Why not call 911 instead of expecting her hubby to get through all that traffic to take her to the hospital? Or, I don't know, maybe a cab. I hear there's a lot of them in NY, especially hanging around large hotels. Why was she on the 15th floor? And just because she's a mother of two, suddenly the theft charges aren't legit? Two sides to every story and her side stinks.

I could bring and likely win a sex discrimnation suit alleging she was fired because of her pregnancy which is a HUGE no-no under Federal law (and even if she had no other leave, if the hotel met the employee threshold , she should have gotten her 12 weeks under the FMLA)

Sybarite: The side door thing was stupid on the hotel's part

The hotels I've worked at in my life all had similar rules like that...ostensibly to give the person being taken out by paramedics some privacy, but in reality because they wanted to avoid having other people get bothered by it. Stupid rule, maybe, but good luck arguing that with any policy makers.

That said, the story here just sounds...wrong. I can buy her being up in a guest room (it never says what type of manager she is, but I'd best Housekeeping or Front Desk), so that part is fine, but her husband has time to go from Jersey to Manhattan and ends up delivering the baby himself? No one called 911 during that time? No paramedics showing up to do that themselves before the husband? Something in the timeline there just seems off.
