If I were king, this cop would have to pay the citation himself AND spend a week interviewing inmates at a supermax and writing a report on what they did to get put into supermax and how stopping that kind of crime is his job, not writing citations to 3 year olds.

Will the 3-year-old now have to register as a sex offender?

2012-11-06 09:39:15 AM
I'm just curious, what was the 3 year-old's mens rea at the time of the incident.

Seriously stupid on the part of the cop. A 3 year-old does not have the mental capacity to understand that urinating in public is wrong.

2012-11-06 09:58:48 AM
If the kid doesn't pay the fine, will they throw him in jail?

2012-11-06 10:05:48 AM
I know as a society we haven't decided if letting a 3-year old urinate in public is ok or not, but I'm pretty sure we can all agree that a $2500 is just a bit excessive.

2012-11-06 10:05:54 AM
In the UK, the kid is below the age where they can be prosecuted for anything. This is only a story if your country has draconian outdated laws. Do you have workhouses for poor people as well?

There seems to be more to this story than reported:

I said we are on our property and he said it's in public view," said the boy's grandmother, Jennifer Warden.

But they point out the street is actually quite rural, yet the Wardens who live on two and half acres say this one officer parks at the end of their street daily. So they asked why.

"It's a public street and he wants to, so he can," Jennifer Warden said.

Something smells here, it sounds like the officer has a personal beef with the family. Or thats his lunch spot

Yes, they're called prisons.

According to TFA, the cop sits at the end of the street but he was able to get to the lawn before the boy could actually urinate.

Why the heck is he parking there and staring at little boys??

Sounds like the officer (who for some reason is not named in the story) has an axe to grind with that family.

It's the same here. The youngest age in the US is six, and that's only in North Carolina. A large number use common law definitions, which is seven. Most have it at ten or higher.

Yup, cop must've got shot down by the mom to go to a prom or something. Even if he's not a grudger, he's the type of cop that just lost himself a raise for the negative pr he just brought upon the town.

As someone said in the comments this is the case where the crime happened too, although a citation is needed:

In the first place, you can't charge a child under the age of 8 for any crime--Under Oklahoma law they are incapable of committing a crime. Secondly, you can't charge a parent for a crime committed by a child. The only way you can charge a parent is if they told the child to commit a crime or they facilitated in some way for the child to commit a crime. THIS DUMB **** COP NEEDS TO BE TERMINATED. This is a blatant abuse of authority and any expenses incurred by this family should be recovered from the city.

Little boys pee on everything. My coworker's son was peeing in the heater vent in his room. My neighbor's grandkids pee behind the bushes on their lawn during daylight hours. Or that's what I understand when I hear the grandma yelling, "It's light out! Go pee behind the bushes!" I grew up in the country, so I peed on anything I wanted to: off bridges, on small animals, on the side of the barn, whatever.

My mom made me pee in the yard all the time when I was a kid.. it kept me from tracking dirt and mud across the house when I was outside playing all the time..

Did they get a ticket for letting the kid play outside too?

2012-11-06 10:20:25 AM
Oh the police, with deficits so bad they will cite anyone for anything.

Bonus points for peeing off bridges onto small animals

Back in the old days of my childhood our backyard was where me and all the neighborhood boys played football and baseball. My mom didnt want us running in and out of the house so if we got thirsty we drank from the outside faucet and when we had to go, we pee'ed into the bushes. Now, the first thing would probably get my mom arrested for child neglect and the second thing would get us arrested for indecent exposure. What the hell has happened to us as a society? I also wore an onion on my belt and if you got a injury playing outside you rubbed dirt on it and "walked it off".

I really can't see this being upheld in court. If I were the mother I would be in the library researching the legality of fining the parent over the actions of a three year old, plus taking advantage of the free legal advice of a lawyer (you know, that free first counciltation) so that when I saw a judge I could argue how the ticket is illegal.

Downside: ticket might successfully get dismissed, cop, however, might take a closer watch over the residence.

That is part of the reason why I think this is going to get dismissed in court. I have known people who were caught in the act of public urination and none of them were fined more than $500.

Evidently he's camped out there everyday, so not much risk in that regard.

What all you Farkers can learn from this story and take home no matter where you live is that pull-ups are a waste of freaking money. They do not help with potty training and they're expensive.

Waste. Of. Money.

Fire the cop. Period. I don't care how many years of service, record, anything. This man is not a public servant. He is a small-minded little prick who should not have any power over anyone's life.

Still would make somebody vomit, that's for sure. Someone around me once urinated in the fire while camping and it did not smell nice.

Is it possible to get a restraining order against a cop? This story really does make the cop seem like some sort of creepy stalker - there's no way you can intervene when a 3 year old wants to pee, unless he wants to pee on you or you're hovering over his shoulder.

It sounded to me like the order of what happened was:
1) Cop parked at the end of the street
2) Family living up the street complained
3) Cop busts kid peeing.

2012-11-06 10:45:36 AM
Yeah, this cop obviously has some kind of vendetta against this family (or is a pedo sitting there watching little boys - WTF is that about?).

I could maybe understand a warning/citation/whatever if this happened on a busy sidewalk or something (but still nowhere near a $2500 fine - it's a 3 year old FFS), but in the kid's own yard in a rural area? Ridiculous.

Cop should be fired.

"Little boys pee on everything."

Several years ago, we had a friendly Mexican family living next door. They didn't know any English, but they always smiled and threw their hand up in the air with a loud & friendly "Hi!!!" whenever they saw us. The adults and kids all did the same thing.

I was heading down my street on my way home from work one day, and the neighbor kid, maybe 5 years old, had his bike out in the street, just pissing all over it from stem to stern. As I pulled into my driveway, he threw his free hand (the one he wasn't aiming his willy with) up in the air, smiled and shouted "Hi!!!!" at me, still hosing down his bike with gusto.
