JerkStore: I am 100% OK with trolling the media. It's their farking job to check facts, but instead they all want to get the first "scoop" and rush blindly into reporting not just distortions, but outright lies. So fark them, their credibility, and their integrity. They sold out to the dollar years ago, and this is the result.

Bear in mind that if they can get something so easily checked completely wrong, what's their score on the stuff that's more subtle?

FACT CHECK PEOPLE ... if they can have Jim Cantore sitting in Battery Park or standing on the Jersey Shore at ground zero of landfall, why the HELL can't NBC send one of their people to go check if the NYSE is underwater. If first responders were involved, well, they can go fark themselves if someone says the Empire State Building just fell and they go all herpity derpity because they believe some anonymous Twatter account ...

As long as first responders are using twitter, or are forced to respond to it, I'd say it needs some kind of protection status.

Its like calling up radio station hoaxes during an emergency. People can and have been prosecuted for it, particularly if what they said led to someone losing life or property.

The analogy of crowded theater fails. The reason you can't yell fire is people will die in the resulting trample. Plus you're broadcasting that information. Posting it online when exposure isn't guaranteed isn't the same as broadcasting.

Furthermore, emergency services using Twitter is ridiculous. They have lines set up to handle emergency claims and complaints, if he called 911 to report this, I'd agree that he needs to face legal action, but posting it online isn't the same thing.

The issue is when police, fire, emergency are all actively using twitter and soliciting the public to use twitter to report emergency.

At that point it stops being fun social media and starts being a "fire in a movie theater" or "fake calls to 911" type of situation.

Situations in flux, and I do see some good arguments on all sides. In no way am I trying to suggest The Onion -- first amendment protected speech, hosted on its own parody site -- is involved in this.

But the cops and fire dept are taking emergency info by twitter. It changes its meaning a bit.

Any asshat can call in a fake 911.

Thats pretty much what he did, in the context he did it in.

Not necessarily.

If he tweeted" @FDNY the NYSE floor is flooding" then that might be something to consider. If he tweeted that the NYSE floor is flooding and people are trapped needing rescue, then it would be a problem.

I would find it incredible if first responders went out to every report of flooding and damage. They're too busy trying to get to fires that are raging out of control or people who are trapped and in danger.

In a situation like Sandy, when it's gee, NYSE is flooding, the first thought is, add another place to check on when the winds die down because the whole damn town is flooding.

I think we're overlooking one important fact here: The guy said it was "confirmed." Confirmed, people. That means that not only is it true, somebody went and made SURE it was true. This guy could have gone the "I have it on very good authority" or "True fact:" route, and we'd have believed him because, I mean, who lies on Twitter? But he doesn't roll that way. He made sure it was true, or got someone to do it for him (it's not clear which) and TOLD us that it was confirmed. That makes it extra-truthy. Confirmed. Get your facts straight. Those reports of a dry trading floor are obvious media fabrications. It was CONFIRMED. On TWITTER. Really, who are you going to believe?

Making an appeal to tradition for sites like The Onion, then blaming your opinions on the use of a medium by the government does not jibe.

This situation would have done no harm as units are attached near NYSE who can check on this in a heartbeat. The area is kind of a big deal. At best this qualifies as a false 911 report, and that is stretching the feasability of that argument quite thin.

The government using a completely privatized service such as Twitter, which has not established a legal emergency protocol, has dick to stand on if information fails. This is yet another public shaming for no purpose beyond political placating of the greyhaired Jitterbug-using, 56.6k with AOL set who do not understand how communication works.

Oh... And that sweet spot subset of individuals who want to armchair lawyer or be the righteous voice spewing nonsense to the masses.

It's not, though. The guy who tweeted didn't make a request of any authority. None. The actual analogy here is some dumb jock making a joke in a college cafeteria. Authority overheard him, and rather than doing any sort of due diligence, took it as God's Own Truth and got embarrassed by their own stupidity. Then we get people like Generation D who want to make it into a Constitutional issue on stupid grounds.
