Yea, but it's funny how that works. Saw a woman on ID-HD, Amber Cummings. She married a nazi-pedophile. He would beat the shiat outta her and her daughter and she was worried that he would eventually abuse their daughter. She was going to kill herself, realized that doing that would leave her daughter alone with him, waited until he fell asleep and shot him twice in the head. Turns out he was working on building a bomb in the basement and was gonna try to blow up the president.

She admitted to the murder, and the judge sentenced her to 8 years. BUT since she had already been living in hell for the past 10 years, he commuted the sentence and she walked.

California's penal code also says that children under 14 cannot be charged with a crime without clear proof that "they knew its wrongfulness."

With literally millions of pages of law and regulation to live by we should have that as a general rule. Adults can be presumed to know the common law crimes.

I remember this story with the kid; it's an odd one because you really can't tell why he did it. Was it because he turned out just like daddy? Somehow I doubt he was thinking about doing the world a favor when he pulled the trigger. But, maybe.

This sounds like a good way to handle such things: acknowledge the crime and its seriousness, and save leniency for the sentencing phase.

Damn; little guy never stood a chance of leading a normal life.

No matter how certifiable his dad was; he ended up shooting his dad. At the very least; the kid should be sentenced to a lot of counciling. Whether that be in an institution or an outpatient deal should depend on his level cooperation.

I don't know that it is based on your "job" as much as your "career"/expertise. Yeah, nobody should call themselves an "unemployed fast food cook", but, an actual career seems different.

I mean, I am a computer programmer, and have been for 15 years, so, if I was unemployed, I'd call myself an "Unemployed computer programmer". Someone who has been a plumber for 20 years let's say, I'd say that was his area of expertise , I have no problem with saying they are an "Unemployed Plumber". If he was a plumber for 6 months, I'd agree, that is different. Didn't read the article, so, don't know which is true.

Well, it wasn't done by someone older, now was it? Imagine that, different situations are different, who woulda thunk it? Were I on the jury, my sole concern would be the mental health of the defendant, and what trial outcome is most likely to give him the help he obviously needs. As for the deceased, it's just unfortunate that his mother didn't smother him in the crib. Some people need killing.

I hear ya and I understand. I just find it interesting/notable that there's a cultural obsession with categorizing people by how they make money. It's usually the first question someone asks when you meet them - 'What do you do?' Not, say, 'What's your philosophical bent/political alignment/family background', etc.

This, my wife died and I had to defend my custody against her mother who had disowned her only child when she married "Outside the Faith." She found some sleezeball attorney who got a hearing based on the fact that I am not Jewish and could not be trusted to raise my child "correctly."

/Thankfully one of the ladies at the Synagog my wife attended is one of the area's best family law attorneys.

I don't know if it's legally possible, but I hope the judge strips the prosecutor of his job. Can that be done?

This child should have in-patient care until he is deemed healthy enough to be placed with a very carefully chosen foster family - preferably one that is interested in adopting eventually. I would not let a family, however well-meaning, skip fostering and go directly to adoption. As he suffered unusually and the state failed to protect him, I think he should have government funded tutoring, college, technical school, or other job training. Requiring him to go to weekly therapy sessions until he is, I don't know, maybe 18 or 21 is probably a good idea as well if for no other reason than he might need a safe place where he can break down and cry from time to time.
