I would say yes, lets say you vote the day of the election and when you walk out of the polling center and you're hit by a car or something and die. You voted before you voted was officially counted.

I don't see why not: the vote was valid (and he was alive) when it was cast.

And it wouldn't have to be his last vote either.

No it should not count and legally does not, although the number of votes which this affects is so small that it really doesn't matter.

If he lived in Chicago, his vote could still be counted. Same goes for the next election.

Obama's Grandmom did the same thing. Cast her vote early and then kicked the bucket.

I think the Government is too disorganized to be able to remove a ballot of a recently deceased person, with the way things are going they would likely remove all Democrats becuase of one person saying "YOU ARE DEAD TO ME! I HAVE NO RIVALS!"

They also noted there aren't enough resources to sift through and confirm the pulse of everyone who has voted prior to election day so it will most likely be counted anyway.

It shouldn't but I have no doubt it will. I would hope that any vote not at the polling place be treated as provisional and counted only after being cross checked. The actual election isn't until the first Tuesday in November and if not alive at the time your polling place opened then your vote should be purged.

But of course that won't happen.

If the early vote was done in a legal manner, then I say it should stand. I can understand the concern, but to take back a vote already cast I suspect would be opening quite the can of worms. I just hope the poor fellow didn't leave any hanging chads.

Sure, this time it was an honorable member of the military, but what if you have a sect that's going to commit suicide, and has like, thousands of members, and they all vote for, say, Americans Elect. Now let's say there's hundreds of these all over the US, and they all cast an absentee ballot and then proceed to do their thing with cianyde or a gunshot or watching fox news or whatever all at the same time?

Do you really want people that won't be around to be subject to Sharia Law / having their job sent to China / whatever the hell that party wants to do, to choose your next president? It's a slippery slope.

Actually the earlier article stated that whether or not his vote would count depends on when his official death certificate is filed and received by the state. If it is received before election day, then no. if it is received after election day, then yes.

Also, this is why, when Obama's grandmother died two days before the election in 2008, her absentee ballot counted. Her death certificate was not received by the state until several days after the election, so her vote was valid.

There is accountability w your name in absentee balloting here. The state must be able to tell if someone voted early so that name is not on the poll books come Nov. 6. (I'm a voter assistance official in the election that's why I know this info.)

If Hawaii receives the death certificate before Nov 6, yes, technically they are supposed to remove the ballot.

Thing is, CNN just released a story that Hawaii residents don't vote. I think a chunk of that comes from the fact that, by 1pm here, news organizations are already calling winners on the East Coast, so then it really doesnt matter who we vote for in national races.

This election will be a whopper though, as we are voting for a new U.S. senator to replace Dan Akaka and a new U.S. rep to replace Mazie Hirono (she's running for senator).

The article answers that question. If you die before the actual election day, your early ballot is invalid. However, those that do the counting must receive a copy of your death certificate before they try to find and remove your ballot.

It's REAL easy to explain the "does his vote count" now that he is dead argument.
If he voted for Romney then, NO WAY does his vote count.
If he voted for Hussein Obama, not only does his vote count, it is counted at least twice.

Are you kidding? If you die before inauguration your vote shouldn't be counted! The hell do we care about some dead guy's opinion on who he wants running the country? HE DOESN'T HAVE TO LIVE UNDER THEM! More pertinently let's say that between election day and inauguration we lose like 5% of Obama supporters and so now the country is 47% Obama 51% Romney 2% Ron Paul. Well, we're swearing in a new President who, at time of entry to office, has the vote of 47% of the country!

Then we remember the electoral college doesn't work that way and the change could still manage to not affect who becomes President.

My Uncle Bill was a staunch Conservative,
and voted straight Republican
until the day he died in Chicago.

Since then he has voted Democrat.
