arcas: Why does California even have a state legislature? Seems every issue ultimately winds up on a ballot for a referendum vote anyway...

So they can play chicken with the budget?

Paris1127: How do they plan to enforce this? One scenario:

"Everybody stay right where you are, this is a raid!"
"Who are you people?"
"Health Department, miss. We have reason to believe there are health and safety violations being committed on this set"
"Like what?"
"Not using condoms."
"And?"
"Well, that bra looks a bit tight, let me undo that for you..."

"Damn it, Bill! This is the fifth time this week you try to do this alone, let us help this lady, ok?

BoxOfBees: I would say that anyone who opposes this measure is thinking with his other head.

Still don't get it. So California wants to require porn actors to wear condoms while filming porn? Film in Nevada. Problem solved.

I seem to recall that there are a number of reasons why moving the porn industry out of California would be problematic for the industry. They'd really rather stay in California.

For one thing, there's legal precedent that filming porn in California is legal ... it's been decided by the state supreme county, if I remember correctly. The legal status in other states of the USA is less firm.

2012-10-22 01:13:50 PM
How would something like that be enforced?

Porn shoots are all after hours in cheap motel rooms or private residences anyways, so it's not like an inspector will be able to drop by to check. Any "offending" film that comes out could easily be claimed to have been filmed outside LA county or before the law went into place. Business as usual, with one more nonsense law on the books.

How would the law apply to amateur videos where it's a legitimate couple that wouldn't be wearing protection anyways? If there's a loophole there, are the all new porn videos just going to be labeled "amateur"?

2012-10-22 01:14:38 PM
Doesn't the government know you can only get aids on gay porn sets.

But the same dummies feel absolutely qualified to have a say in who should be President of the United States.

Hope they do pass it. Then stand around wondering where all the tax revenue went.

our Legislature would have to greatly improve to be considered "dysfunctional"

They are all waiting for a Obama bailout.

San Bernardino, the bankrupt California city facing an inquiry by the U.S. Securities and Exchange Commission, masked its growing deficits by using funds meant for sewers, roads and construction to cover current expenses, according to city records.
In the year ended June 30, San Bernardino added $33 million to its $177.7 million general fund from a payroll trust fund and accounts designated for sewer-line maintenance, storm-drain constriction and other purposes, exhausting most of the special funds, according to a city budget document.

State Supreme Court, I mean. The case was People v. Freeman, 46 Cal. 3d 419, 758 P.2d 1128, 250 Cal. Rptr. 59, 1988 Cal. LEXIS 171 (Cal. 1988.

Slives: The hard-hat analogy is not that good, IMO. Hard hats on a construction site might prevent minor head injuries, but it is all the other safety measures that really prevent problems.

I think the pron industry needs to restructure their process for contracts and when actors are allowed to film. Since a lot of these folks do 'outside work', whether it is for another company outside the US, or escorting or things like that, I feel that is where a lot of the disease issues comes from. So setup the contracts so that an actor is under contract to film for a certain time, then have a time to be able to do outside work. And when they come back from the outside work, they get tested and have to wait for those results before they are allowed to start filming again.

That would make too much sense, which means it would never go anywhere.

/IIRC, some companies' contracts are set up exactly like that, but not the bigger, more exploitative players', who are more than happy to pump and dump their actors as quickly as possible. Unfortunately it's a bit of an honor system, and honor system vs cocaine orgies doesn't go far.

2012-10-22 01:28:07 PM
From what i've heard from people in the industry this law is much more than condoms. It's a need for protection on ANY genital touching. Gloves on before you can touch a vagina. Dental dams. Basically plastic between everything.

What a waste of public funds, what? California? Typical... carry on dumbfarks.
I wonder if Arizona or Nevada is bankrolling this to pass, then they can reap the taxes off this billion dollar industry.

The My Little Pony Killer: ConConHead: I'm voting no. I'm not spending money for government inspectors to go to Porn sets and make sure the boys got their junk wrapped. They can spend their OWN damn money for that.

Refusal to spending money on aneverything stupid is why California is such a shiathole.

It's more likely to just shift filming to Ventura, Riverside, San Diego, etc. Counties without this law will probably be happy if this passes.

I do not enjoy watching porn when a condom is used even though I know that is not the point. I see this as just another attempt to restrict the industry just like they are trying to get it labeled as addictive so they can get around the freedom of speech protection. It could also be a way to get their hands on some of the billions the industry generates.

2012-10-22 02:10:57 PM
i've thought up a GREAT new type of porn

have them smoke medical marijuana beforehand. and show their Dr's prescriptions for it.
then have them put on a condom, and provide drivers license, and porn licenses, etc..
this will be 95% of the porn
the remaining 5% will be them briefly sucking on a condom

Condoms for porn people is the same as head gear for boxers.

You know the job and what it entails, if you have a problem getting loads on your face you shouldn't be doing it.

2012-10-22 02:53:39 PM
Ginger Lynn mentioned this on her show with Christy Canyon on SiriusXM spice channel the other day. her and her husband like to do impromptu webcam shows from home. Under this act/measure, they could potentially charged unless they use condoms.

2012-10-22 03:09:09 PM
Maybe this is a good idea. I'm sure the people behind it have the absolutely best interests of other people in mind. Doesn't matter. The only effect it will have is that people will either:
1. Go film somewhere else.

OR (more likely)

2. Continue exactly what they're doing and just lie about where they filmed.

Either way the goal of the proposition isn't met. It becomes a moot point.

Here's the thing or the story of why I did not do porn.
Before each movie the stars take an STD test and usually wait a week or two before filming. HIV is included in this test. However, the scary thing about HIV-
You an test negative for 10 years while still being HIV positive. So you never know who really is HIV positive when you are filming. Things like anal sex ect where lining is so thin it always tears. Putting you at high risk. A lot of stars do not do anal for this reason.
Yeah you want to get off. But is that porn stars dick really going to turn you off if it has a rubber on it? No--but will the porn industry enforce safe sex. NO because they think people think it matters. It actually doesn't.
All this said is the porn industry even relevant anymore? Why yes I did just find that free search engine. LOL

So we start up a company - Industrial Junk and Magic, and we either cgi on rubbers, or cgi them off depending on where it was filmed. You can just put out two versions of the same movie (protected vs. bareback). Time to put this new technology to use. If a car can transform into a robot then wrapping or unwrapping a weiner should be easy as hair pie.

Look closely at your porn---you will see more condoms then you think are there.. So really it's a non issue

Are you kidding? Go to one of the big sites (rhymes w/ Chazzers, Bawdy Comerica, Fatality Rings, etc) and look at the videos released in the last month or so. The vast majority are bareback. The only big site that regularly uses condoms is Fang Crows.

darth_badger: This law will take all the fun out of ATM.

And felching.
And snowballing.
Cum swallowing.
Bukkake.
Creampies.

So, I guess if they pass this law, it will just drive the porn industry out of Los Angeles County... which is probably the real intent of this ballot measure.

2012-10-23 12:09:36 AM
FTFA: James Lee, spokesman for Measure B's opponents, said the porn industry tried in 1998 to mandate condom use after sex film actresses tested positive for HIV. But the industry found that film sales fell by 30% across the board.

That's because for a lot of people (myself included) viewing porn is an empathetic experience. I personally hate the feel of wearing a condom during sex, and when I'm watching a sex video and see a man wearing a condom while he's having sex, I have the same reaction to that scene. It doesn't matter that it's politically incorrect. It's just the way it is. If they want to kill the porn industry in L.A., this will certainly be a way to do it.
