The intention is all good and fine, but the practical result if this passes will be economic loss in LA County and economic gain somewhere else. It's just that simple. Unless the Feds get involved and invoke similar regulations nationwide (OSHA type stuff), this initiative is completely pointless. OSHA getting involved in this issue will not be happening any time soon.

They cite the requirement to wear hard-hats as analogous. I highly doubt that is required by law. It's just a major liability issue. If it is in the law at all, I'd wager it only applies to government workers.

Is this HIV/AIDS issue unique to U.S. produced porn? It seems to me there is more voluntary condom use in U.S. porn than there is in European or Japanese productions. Also, the Japanese really go crazy with the creampies, you would think there would be similar if not worse infection rates overseas. If there isn't what are they doing differently?

There's a huge difference between OSHA requiring someone to wear a hardhat and goggles when doing construction work professionally and a government inspector popping into your garage on the weekend to make sure you're wearing proper safety equipment. One is a proper use of government power to regulate commerce. The other, not so much. Likewise with professional performers.

Corporations have shown over and over they have no regard for the safety of their workers, and one of the government's most essential functions is to protect them.

OSHA provides information, training and assistance to workers and employers. Workers may file a complaint to have OSHA inspect their workplace if they believe that their employer is not following OSHA standards or that there are serious hazards. This is a job for OSHA, I am sure they would be more than willing to help.

The hard-hat analogy is not that good, IMO. Hard hats on a construction site might prevent minor head injuries, but it is all the other safety measures that really prevent problems.

I think the pron industry needs to restructure their process for contracts and when actors are allowed to film. Since a lot of these folks do 'outside work', whether it is for another company outside the US, or escorting or things like that, I feel that is where a lot of the disease issues comes from. So setup the contracts so that an actor is under contract to film for a certain time, then have a time to be able to do outside work. And when they come back from the outside work, they get tested and have to wait for those results before they are allowed to start filming again.

I seem to recall that there are a number of reasons why moving the porn industry out of California would be problematic for the industry. They'd really rather stay in California.

For one thing, there's legal precedent that filming porn in California is legal ... it's been decided by the state supreme county, if I remember correctly. The legal status in other states of the USA is less firm.

Porn shoots are all after hours in cheap motel rooms or private residences anyways, so it's not like an inspector will be able to drop by to check. Any "offending" film that comes out could easily be claimed to have been filmed outside LA county or before the law went into place. Business as usual, with one more nonsense law on the books.

How would the law apply to amateur videos where it's a legitimate couple that wouldn't be wearing protection anyways? If there's a loophole there, are the all new porn videos just going to be labeled "amateur"?

/IIRC, some companies' contracts are set up exactly like that, but not the bigger, more exploitative players', who are more than happy to pump and dump their actors as quickly as possible. Unfortunately it's a bit of an honor system, and honor system vs cocaine orgies doesn't go far.

OR (more likely)

2. Continue exactly what they're doing and just lie about where they filmed.

Either way the goal of the proposition isn't met. It becomes a moot point.

Before each movie the stars take an STD test and usually wait a week or two before filming. HIV is included in this test.However, the scary thing about HIV-
You an test negative for 10 years while still being HIV positive. So you never know who really is HIV positive when you are filming. Things like anal sex ect where lining is so thin it always tears. Putting you at high risk. A lot of stars do not do anal for this reason.

Are you kidding? Go to one of the big sites (rhymes w/ Chazzers, Bawdy Comerica, Fatality Rings, etc) and look at the videos released in the last month or so. The vast majority are bareback. The only big site that regularly uses condoms is Fang Crows.

That's because for a lot of people (myself included) viewing porn is an empathetic experience. I personally hate the feel of wearing a condom during sex, and when I'm watching a sex video and see a man wearing a condom while he's having sex, I have the same reaction to that scene. It doesn't matter that it's politically incorrect. It's just the way it is. If they want to kill the porn industry in L.A., this will certainly be a way to do it.
