Assholes like this Johnson piece of shiat are the reason Disneyland has stated that they will NEVER rebuild the PeopleMover into a new attraction. The Casey Jr train, the Storybook Canal Boats, Alice in Wonderland, as well as numerous other unnecessary changes are being made because of the farking ADA piece of shiat!

There are some places you just can't go, farktards!!!

Slaxl: With regard the case, what's wrong with a man only hiring attractive young women to handle him naked? If I had to have people wash me I too would rather they were attractive young women... I shouldn't be forced to hire ugly old moustachioed women if I don't want to.

If it turns out he's capable of washing himself and he just wants them to fondle him then fine, sue him, but I think he's just making the best of a bad situation.

It no doubt violates the law to discriminate by age and gender (and in some places, appearance), but he'd probably get away with it if he wasn't too obvious about it.

Having them wash him isn't a problem if that was a stated part of the job. Popping it on them later (so to speak) would be a little different, but TFA says they had to get training on "personal care," "learning to dress and undress their boss," as soon as they were hired.

The women are two 5-year employees, a 4-year employee, and a 1-1/2 year employee. So they knew about that duty from the beginning, but didn't find a new job or complain for several years?

Sounds like a shakedown to me. Isn't it awful how civil rights laws are used to harass the small businessman?

GOOD!

I've been irked since the article about Ford's Burgers shutting down because of this jerk.

I think Karma got a double-whammy on this guy (one preemptive and now this) and I hope this lawsuit cripples his bank account and he gets disbarred.

How to be scum-of-the-earth asshole lawyer.

1. New ADA law goes into effect. Something like 'wheelchair ramps must now have a 5° slope instead of a 7° slope' or 'front doors must now be at least 3 feet wide'.
2. Drive around to as many businesses as you can to find the ones that either haven't had time to change, haven't yet heard of the new law taking effect, or do not have the money to tear down their entire store front to make their doors .5 feet wider.
3. Sue them in to non-existance.
4. Profit!
4a. (who cares if you put an entire family out of business, you just made a sweet $100,000 by driving around for 3 hours until you found a business who offended you by not digging up their 6° concrete wheelchair ramp and replacing it with a 7° one!)

I remember hearing about this jackass on This American Life. Basically, ADA laws are so nitpicky you can get $5,000 for a mirror not being the right height. Here's how we make this right:

1. Take away all the money he's gotten from frivolous lawsuits.
2. Give it back to the businesses he shut down, with interest.
3. Kick him out of his wheelchair and make him crawl like the scum that he is.

//ADA laws be damned

Then I saw the headline, and I was like "oh, wow, OK".

Then I read the first sentence, and I was like "there we go".

His money has already been spent, on women desperate enough for a job that this guy was able to intimidate them into being his personal sex slaves. Are you going to take the money from the abused women, to give it to the businesses?

I guess ideally it would result in some sort of suspension of their business license until the issue is fixed, kind of like the health depts. and eateries?

Was there anyway to make it an incentive not a punishment? Or at least neutral?

My old boss is probably the happiest guy on earth right now. He's been waiting years for something like this to get a class action going against this asshat. Now this douchebag is going to know what it feels like to be sued into penury. Hey Johnson? Do us all a favor and just roll your crippled ass into the river and save us the trouble.

2012-10-03 10:53:46 AM
"Johnson told her not to interview "men, ugly women and anyone over 30," regardless of their qualifications."

More like US business SOP than a lot of people would like to admit.

RoyBatty: "The former legal assistants also offer insight into allegations that contrary to his claims, Johnson never personally visited many of the businesses he has sued under the federal Americans with Disabilities Act.

The women said they would accompany Johnson in his van for "field work" during which he would send them into a business as customers to look for ADA violations.

"He would call such actions a visit to the property even if he never left the van," the lawsuit claims.

The women said they were uncomfortable going into a business under a ruse and felt as though they were committing fraud, but said they were paid a bonus for the field work."

If this is true, any speculation on whether it is illegal, or unethical, or something that should have this guy disbarred?

I don't know about disbarment, but (ironically) he could be busted on at least two if not three different civil rights violations re discrimination in hiring (a California-specific law re appearance, as well as federal EEOC charges on age discrimination and sexual discrimination against men--yes, this is one of those rare cases of age discrimination that's provable). Which is especially hilarious seeing as he's set himself up as a Professional Attention Whore re ADA violations--you'd actually think he would know better. :D

In case you haven't noticed, our society has a surfeit of lawyers, and the economy's been in the crapper for the last five years. Not every new grad goes to work for BigLaw or the government; I'm sure they had student loans to pay, and this was work.

It's also cross-training; if lawyering doesn't work out, they can go into home care.

Except the airline industry. Those are the only people they'll hire nowadays. When was the last time you saw an attractive, young flight attendant on a U.S. airline? That's why all my flights out of the country are on Asian or Middle Eastern airlines.

I would like to say, of course it would be gamed, but that's what building inspectors, regulatory departments, etc. are for.

Are there no other programs where citizens essentially send in receipts to have them reimbursed? Like taxes? And if they game the system and are audited, they are fined or even sent to jail?

profplump: RoyBatty: Something like "Costs directly involved in bringing your facility up to code will be applied to property taxes".

Calling spending programs "tax breaks" is terrible plan. It's that kind of ridiculous obfuscation that makes the existing tax code so complicated. If we want the government to subsidize handicap access we should create a program that sends out checks to people who spend money on handicap access. Direct payments provide for more transparency in government, are economically indifferent to tax breaks, and vastly reduce the complication of tax legislation and budgeting, as well as tax forms and their processing both by the government and the taxed.

That seems to be a good point, and I'd probably be okay with that

Also incentives are nice, but when it comes to fundamental access they're really not sufficient. I doubt you'd satisfied with saying "Well, there's subsidy program to encourage lunch counters to serve blacks -- that's all we can do". It may not be economically viable to provide wheelchair access for the 1 disabled customer a store has, even with government subsidies. But disabled people still need to eat so we need grocery stores to provide access or other accommodation anyway.

But this seems different from allowing blacks access to lunch counters. There is no reason that allowing blacks access to lunch counters can't occur literally overnight, but that's not true for building elevators, restrooms, etc.

So they could have forced new construction and remodeling to be compliant, and then provided a reasonable time period of a year, five years, ten years, for older construction to be made compliant with various incentives to do so early, and fines if you don't.

In general, I would prefer to see goverment work on incentivizing good behavior not the constant criminalization and fining of bad behavior.

I wonder if there are any California based attorneys that visit FARK that need to do some pro-bono work to help clean up their profession!?
