I'm perplexed. If found guilty of Fraudulent Schemes then it should be assumed there was a conspiracy to commit. If found not guilty of Fraudulent Schemes, can still convict on conspiracy? Just because you heard someone say, "I'm gonna fraudulently scheme someone?"

I expect it has to do with your level of involvement. For example, if you're swindling someone and I know about your plans and offer to help drive you to the scene and hide the cash, I didn't really commit fraud myself. So they make these various conspiracy and accessory laws to catch the supporting roles.

Generally speaking, "conspiracy to commit" crimes are not lesser included offenses like "attempted" crimes are. While it seems that they're all along the causal chain of talking about it, trying to do it, and actually doing it, conspiracy crimes usually have additional elements that make them chargeable as a separate offense.

Basically, it's thrown in as a backup charge that the prosecution knows it can prove so even if the elements of the actual crime are a bit shaky, there's an accomplice who's ready to sing like a bird to put away the suspect.

The example I always remember is a basic murder fact pattern. I tell you I want to kill somebody and ask you to get me a gun. You do so. There, we've committed conspiracy to commit murder. Next, I go track down the guy I want to kill, aim the gun at him, and pull the trigger. There, I've committed attempted murder, whether the gun works, or you loaded it with blanks without telling me, or the sights are so far off I break a window halfway down the block instead of hitting him. But let's say that the gun fires, the bullet leaves the barrel, and hits the guy in the heart, killing him. There, I've committed murder.

Now, why is conspiracy a separate charge? It isn't necessary that there be a conspiracy in order for there to be a murder. What if I got the gun myself and never told you what I was doing? There's no conspiracy at that point. Now, is there any way for me to murder the guy without attempting to murder him? Nope, which is why attempted murder is a lesser included offense and cannot be charged separately from murder.
