Too bad the Prosser court will either overturn the decision on appeal or rule the plaintiffs have no standing to challenge the law (probably citing the very law they're challenging as the reason).

Considering that Prosser's reelection went to his own court, he didn't exclude himself from the case due to the obvious conflict of interest, ruled in his own favor and said his opponent didn't have standing to challenge his former secretary's "finding" of enough ballots to change the outcome of the election from "Prosser loses, but it's close enough that he would not have to pay the cost of a recount" to "Prosser wins, and the margin of victory is just barely big enough that his opponent would have to pay for the cost of the recall," I would not be terribly surprised if my prediction at the top of this thread holds true.

Anyone know what part of the constitution the court says the law violated? The only one I could think of is the 1st Amendments right of freedom of assembly

Although I found the law to be bitter tasting I do believe in the process of Democracy. I hope this ruling was factually correct and not some knee-jerk reaction pushing an agenda.

So this means that Tom Barrett is automatically governor and the residents of Wisconsin are to deposit 85% of their bank accounts to the local Teamsters union and the remaining 15% directly to the WI chapter of the DNC (cuts out the middle-man), right?

Does anyone know what provisions of the Wisconsin and US Constitution the judge said this violated? I've read 3-4 articles. They seem to all just be cut-and-paste jobs of each other that simply say that judge found it violated the 2 constitutions and is, therefore, null and void. I'd like to know why the judge thought so, because I hope he has a really good legal basis.

Because equal bargaining power is presumed in both contract law and efficient economic transactions, and one person can't bargain on a level playing field against an entire tax base.

Probably, the State Supreme Court already ruled the law constitutional once though the challenge that time was on different grounds.

The state Supreme Court in June 2011 ruled that the law was constitutional after it had been blocked by a different Dane County judge on a challenge over its passage being a violation of open meetings law.

Just so you all know, the Supreme Court of the United States doesn't have jurisdiction to hear this case. It will inevitably go to the Wisconsin Supreme Court, but that will be the end of the line.

Has the ban on federal employee collective bargaining been challenged this way? I can't see the ruling standing given that the federal ban has held all these years.

Largely, legitimate curiosity and a little sarcasm.

One of the most interesting and persuasive anti-public union arguments I've heard is that the union negotiates with lawmakers and government employees and not the people paying for anything new granted. Whereas in a company, the union negotiates with the owners/operators who also have to pay for any concessions. In the latter, the people granting concessions/acquiescing also have to pay for it, so they have reason to fight for limits. In the former, the people giving things do not have to pay.
