How is this lawsuit not frivolous? I had been assured that laws do not apply to bicyclists in New York.

/Cyclist.
//Confuses motorists by stopping at stop signs.
///Confuses pedestrians by yielding right of way.

I just can't believe that a cyclist would be ignoring traffic rules or that one would be directly responsible for causing an accident.

A lot of bicyclists in NYC are assholes. They complain about asshole drivers...and then drive the exact same way except on a bicycle.

There are also a lot of good bicyclists in NYC. They're not assholes but they get affected by overzealous ticketing that sometimes occurs here in New york.

What's the difference between a bicycle-flattened lawyer and a bicycle-flattened snake?

There's skid marks in front of the snake.

The cyclist never saw it coming. Rray-ee-ayn?

While probably nowhere near as bad as the situation in NYC, I will say this: Fark Montreal cyclists. Fark them up their stupid, smug, traffic-rule-ignorin' asses.

Thank you.

That being said: I'm on a motherfarkin' biiiiiiiiiiiike (NSFW language)

I live in Michigan and have been inundated with his commercials. I would love, love, love to make fun of this guy's googly eyes (he looked like that before the accident), but he seems like a nice guy and as a fellow Michigander and a lawyer, I'll give him a little respect.

(reads TFA: broken hip and pelvis, extensive dental injuries- dude is all farked up)

New reaction: Yeah, maybe this guy has a point. I mean honestly, that biker had to be hauling ass to fark up the pedestrian like that. And good on him for not suing the biker.

You're making me choose between my hate for ambulance chasers and my hate for cyclists.

Wanna make Central Park safer for all? Ban cars from the park then. This way pedestrians and cyclists wouldn't need to share that narrow lane while the cars take the majority of the road.

Um, go ahead and sue. WTF, was the cyclist doing 70 mph? I'd be pretty pissed off if I was blind and got blind-sided (!!!) like that.

I might be able to accept that Daredevil could fire a rifle and hit someone, using his "radar sense" or whatever Marvel is calling it these days...but why would he need a scope?

Wail away! I'm currently bikeless because my Cannondale Police Cruiser, after almost 13,000 miles of shuckin' an' jiving, moving and grooving through the streets of Philly, snapped its frame clean thru a couple weeks ago. Just forward of the bottom bracket.

I am reduced to a common rage cager.

HOWEVER, Cannondale has said they intend to honor their lifetime warranty, and will be presenting me with a brand new bike this week. Old bike: Cannondale Law Enforcement bike ($1400 in 2006) New bike: Jekyll 4 (runs about $3000 today).

Once I've upgraded it with my own special mix of add ons, it will capable of all weather, day/night urban assault, and maybe I can get a solid chunk of miles going to work in October.

Then that's it. I stop the work commutes end of October, due to lack of daylight, and I retire in March. So all Jekyll will do afterwards is toodle around to the corner store, etc. No more mixing it up on the dirty mean streets of Philly.

According to the article, the cyclist was traveling an estimated 35MPH (10MPH over the posted speed limit) and riding in the pedestrian lane.

Because he makes shots that he really ought to need a scope for and doesn't want to let on that he has h4x.

Sue you......sue everybody.

2012-09-14 10:06:42 AM
tough call. biker was a douche for riding that fast in a heavily used area, but that is the fault of the city how? Failure to enforce the law? Really? You think it is going to work that way? It doesn't for cars, because drivers have to have licenses issued by the state, and have insurance...

Ohhhh....

I see where he's going with this, er, pun not intended but happy accident just the same. In order for the city to recoup its loss on this multi-million dollar settlement, now people will be required to be licensed to ride a bike, have to take state approved bike riding courses, pay for licensing exams and get an insurance policy. People who don't do so will be cited for riding without license, failure to show proof of financial responsibility. Plus they won't allow kids to ride bikes until they are 16, which will make the safety nazis happy. Then the fitness people will wonder why we just keep getting fatter. The civil service employee unions will love it because it will bloat the size of the government as an entirely new Division of Pedaled Vehicles sets up shop in the model of efficiency and customer service excellence that is the Division of Motor Vehicles. The law enforcement community will naturally need to vastly increase its personnel, facilities, equipment and detention centers to properly contend with the dramatically increased role of overseeing the enforcement of all those new regulations, and of course the court systems will need expansion as well to deal with the additional caseload.

All because some penniless douche ran his bike into a blind lawyer.

/just kidding, I hope

Coming on a Bicycle: He looks a little bit like Adam Sandler.

In his commercials I always expect Adam Sandler's goofy voice.

Oh, and little known fact: It is illegal to ride a bike on a pedestrian path / sidewalk in NYC. A judge's friend got hit by a bike on the sidewalk on the UWS and died of head injuries so the judge wrote the law and it got passed. If there is recklessness observed, the officer may charge the biker with a misdemeanor.

Did they just give you your pick of any bike in their current lineup? Not that the Jekyll 4 isn't a great bike, but doesn't Cannondale have several other models that are at least somewhat similar to the one they're replacing?

This seems a lot like his lawsuit against Michigan Stadium and one of the common ways this family makes money beside ambulance chasing. They get into a nice drawn out lawsuit with someone who has deep pockets, twist ADA around, and eventually settle where while they don't get a payout, they do get costs covered. Which is X thousands of hours at 450+ per hour. They're masterful trolls at this and use the whole "We're not suing for a payout" to win in the court of public opinion and pressure the entity to settle. They just leave out the whole part where the family firm gets some massive amount in costs.

Which, because E=MV^2, means the cyclist ran into the pedestrian twice as hard.

We visited New York in June and the only negative experience I had the whole time was some harpy on a bike screaming at us to get out of her way while we were crossing with the light in Central Park. The bicyclists were kinda crazy there.

Yeah, I suppose I should be able to sue my state and local law enforcement agencies if I get smashed up by a drunk driver, because they failed to "keep the highways a safe environment for me".
