You can calm down now, Dub. With all the crap happening in the news lately, I think we need to find ways to share some laughs. And quite frankly, this is the kind of thing George Carlin would have joked about.

And if I may play Devil's advocate for a moment. From what I've seen, there's no evidence a rape took place, outside of her saying so. One of the neighbors even implies she's a hooker. So, if she is indeed lying in order to get back at a John that didn't like her prices, it sounds to me as if she just raped his livelyhood. Should there not be consequences for that, or is it only unacceptable if it's physical?

Uh, well, I'm not really sure how the perception of rape, or the stigma of being a rapist, can ever be worse than being raped, so I'm not sure how hyper-demonized it is.

I *am* a bit unsure of why we're OK with the justice system releasing the names of people who've been arrested. There's a public interest in disseminating names and descriptions of wanted fugitives, but ... is there a reason to believe wheelchair guy or his Moaning neighbor are serial rapists?


Bearing in mind that unsubstantiated rape allegations - not false, but unsubstantiated - is something like 11 or 12% of all rape allegations, a lot of the "unsubstantiated" ones don't get prosecuted as filing a false report because it can't be proven that the victim knowingly filed a false report. I see the social value in not pursuing a prosecution of every unsubstantiated rape allegation for a false-claim conviction; a false rape allegation is not as big of a deal as rape.


But it is a big deal, and arresting someone on an allegation with no other evidence - if, in fact, it is the case that there is no other evidence and it is not merely the case that the police failed to disclose or allude to other evidence - seems like an abrogation of 14th Amendment expectation of due process.

I wouldn't have a problem with rape suspects - or suspects of any crime - being charged and held on the sworn testimony of the victim, pending further investigation, evidence-gathering (if you're alleged to have raped somebody with a mop handle, it's in the public interest to dust all your mop handles for finger prints, and if the state needs to charge you with rape in order to get a warrant to confiscate your mop handles, I'm kind of OK with you being held on bail for a day or two) etc - on two conditions:

1.) The DA swears under penalty of perjury to prosecute filing a false report - or whatever legal wrangling needs to be done so the DA takes a personal responsibility - and risks jail time, loss of license, and/or a civil suit from the suspect - for the decision to proceed with a lower standard of evidence. (The Constitution doesn't permit violation of the 4th Amendment because "poppa feels lucky," but if you're willing to bet your career and freedom on a hunch I feel like maybe it should.)
2.) The suspect's name, photo, etc, are not released unless and until the grand jury reviews the DA's "extra" evidence and returns an indictment for the crime. If the GJ returns a lesser indictment or remands the suspect to a lower court, no mention of the higher charge is ever made to the press or maybe even entered into public record. All records of that earlier evidence is kept and can be subpoenaed by the victim or the suspect in case one or both try to write tell-all books and someone wants to sue someone to shut everybody the hell up.


Total nonsense, never happen, but I feel like we could resolve a lot of the controversial "he-said, she-said" cases if we made something like the "cut the baby in half" thing a formal part of judicial principle.
