But, a McDonald's employee Facebooking about the death of this President wouldn't be looked at with as much scrutiny. Losing faith in a corporation or your local chain or restaurant isn't as detrimental to society as losing faith in your local Law Enforcement Agency.

The Secret Service follows up on stuff like this all the time and has done so since before there was an Internet. It's a total judgment call which threats they take seriously enough to do something about it besides a cursory investigation.


Hard to imagine the SS was spying on people's facebook pages before the internet existed...

For those that are still confused as to why an off-duty cop would have corrective action taken upon them by their agency, cops generally take an oath to serve the pubic. This is just a suggested form of an oath from the International Association of Chiefs of Police:

and others accountable for our actions.
I will always uphold the constitution
my community and the agency I serve.

On August 4, 2000, when Bush won the Republican nomination (but before he was president), Craig Kilborn on CBS's The Late Late Show with Craig Kilborn ran a graphic of the words "SNIPERS WANTED" under George Bush as he gave his acceptance speech. Although CBS belatedly apologized five days later, Kilborn was never investigated, questioned or punished, and continued to host the show for four more years.

TL;DR: you can't fire a government employee for off-duty speech not directly pertaining to job, as it would be the government curtailing general freedom of expression. Also, IANAL, but I can read and this is pretty plain.

Very specifically,

"In Rankin, on the other hand, a 5 to 4 majority concluded that the statement "If they go for him again, I hope they get him," made immediately following news of Hinckley's attempt to assassinate President Reagan, was speech on a matter of public concern. So the question is that once it's on Facebook, would it have interfered with ability to perform? My guess is it would not--if the government hadn't publicized it themselves.
