The patent system in the US is FUBAR. It needs a major overhaul, but with so much else that needs to be fixed, I don't think it'll get any attention until somewhere around 2525.

This actually seems like a legit patent that HTC is holding. If they went out and spent the time/money to develop a data transmission method for LTE, they actually do deserve compensation.

As opposed to patenting round corners on rectangles.

The original point of patent law was to protect innovation, not protect profit. That patent law is now stifling innovation in the name of profit in a new era where patents are procured for the akin to intellectual property, isn't a good thing.

I agree 100%.

F*ck Apple in their stupid asses. They're the Microsoft of the 90's now. Microsoft became too evil, Apple swooped in and took the throne. Now Microsoft has found a comfortable home and is nice again. Meanwhile Apple has become too evil, and it'll be Google swooping in for the win. Android already outsells iOS devices by a landslide.

Not sure who it'll be when Google becomes too evil. Despite the "don't be evil", it'll happen. You get too big, too many interests, etc.

Patents on IP should.

If you physically build a device that does something you should be able to patent that machine. If you take a bunch of OEM parts and slap something together and claim you patented swipe to unlock, fark you.

I'm actually ok with Apples suit against Samsung for blatantly ripping off their form factor. Samsung can easily change several small things in their design, or even innovate, and achieve the same rip off that isn't infringing.

Swipe to unlock is code driven. You could code 1000's different ways to do it. Apples code should be copyrighted, but the idea of slide to unlock should not.

Hell, the physical slide lock version has been around forever (been used on some laptops for a while), so a suit like that should be dismissed on prior art/use anyways.

HTC bought these, from ADC. But ADC spent the time/money to develop them, so yes.

What we're seeing here is the Mutually Assured Destruction (MAD) doctrine in full force. Not with physical destruction between nations with nuclear armaments, but economic ones , and I quote, "because the other guys are a bunch of assholes and we don't want our customers to buy their shiat because the other guy may have ripped off our patent over making a silly sliding thingy that does something on a wireless cellular device."

FFS, even the microprocessor industry scaled this shiat back because they found it counter-productive. Remember when D.E.C, Cyrix, and others went after Intel in the mid 90s? Yeah. You make your shiat, I'll make mine, and we'll let the customers sort it out.

Incidentally, I've always wondered. If the cost of a lawsuit or settlement is greater than those 999 man hours, can I tell you you're wrong, and your whole profession is a parasite on those of us who actually create tech?

Actually, I'd be kinda interested to know what their market share is once business machines are removed from the figures.

Enterprise machines are the largest chunk of the current numbers which does tend to skew things all over the place when trying to figure out consumer/home use.

And why would I want to do this? Morbid curiosity.

Nope.

Once a major piece of open source software goes past a closed source one, it's very hard for the closed source one to defeat it. You have an army of developers out there who can adapt it to different needs.

What's really going to hurt Apple is that people are reaching the point where they're happy with the level of phone technology. Very few people are going to throw out a phone with an 8mp camera to get a 12mp camera. And that means that the battle is not going to be about features, but about price.

On a similar but separate note - I have the Samsung S3 now, and replaced a Thunderbolt. I really liked the Thunderbolt, but you had to have an extended battery in order to get use out of it and not have it die halfway through the day.

With the Samsung, I spend a day at work, watch a couple hours of Netflix over 4G, listen to music, etc. Still at 40% at the end of the day.

Also, last two android phones were HTC, and both had hardware failures after the 1 year mark, but before the 2 year upgrade mark.

/I have insurance now.

There is, perhaps an upside. It Apple appears to be losing or indeed does lose these patent cases (which I agree is bullshiat and the legislation never designed for this sort of thing) they most certainly have the money to lobby for new legislation to be drafted...

I'm not saying that legislation would be good mind you, but at least it'd be a starting point for getting the various laws and treaties in order for the 'digital age'.
