Threats are difficult to prove in court. We all say crap like "I'm gonna kill that SOB" and post even worse things online all the time; and yet none of us could be prosecuted for same. One has to say "I'm going to kill that SOB, on this date at this time, at this location, and here's the gun I've gotten to do it with" for it to be actionable.
