The only thing they did was *reinstate* the case. It had been tossed out of court completely by the original judge, they say the trial should proceed.

*That's it.*

The gun manufactuers will almost certainly win. But if the case is held, that means there will be a DEFINATIVE PRECEDENT that can be pointed to in future cases as to why they cannot be held accountable.

So you pro-gun people who are ranting and raving without having the slightest clue what you're talking about, are actually hurting your own cause.

Ahem. The purpose of the judicial branch is to adjudicate the law and determine the constitutionality of the law. I see nothing wrong with what they're doing here.

That's just the name for each Federal Appeals court. Different "circuits" handle appeals cases from different areas of the country. The 9th, for example, handles the West Coast area, Hawaii, and Alaska.

Here is a map showing the various circuits if you're really curious.

We should sue automakers for anyone killed by a drunk driver.

We also should sue the U.S. Treasury for the lack of warning labels on coins because they are a choking hazard.

There is definitive precedent, Hamilton v. Beretta:

"Persons killed or injured by illegally obtained handguns are not owed a duty by handgun manufacturers to exercise reasonable care in the marketing and distribution of their handguns."
Somewhat more narrow, but you can see how a normal court will come down on this...

They ignored laws about restrictions on how many you could own. You can't do that. If they did (and it hasn't been proven, that's why it's a COURT CASE, fark heads), they DESERVE to be sued.

honestly...this sh*t is just a waste of teh Supreme Courts time...now we'll have to spend money for the Court to overturn this utter nonsense.

Underdog: They are called circuits because the judges used to travel from locale to locale in order to handle appeals cases (at a time when we had more open territory and far fewer federal judges). Hell...back in the very beginning the Supreme Court Justices handled these things when the court was not in session. Nowadays it just denotes the territory the cover.

Hold on, the case wasn't decided in favor of the plaintiffs. There's excessive emoting going on here. The jury is, literally and figuratively, still out. SF Court just said the case could be heard-- they didn't freakin' say that anybody won or lost.

And THAT is exactly why the democrats keep blocking the presidents judicial nominees. They know that any judge he appoints will be more likely to adhere to the constitution rather than legislate from the bench.

They're the most overturned because they're the most reasonable, and the levels above them are the most conservative courts since the 1940's. The 9th would have fit right in in the landmark legal years of the 50's and 60's, when thousands of stupid laws felll by the wayside under the twin lights of logic and compassion.

I will suggest that the Gunpowder makers need to be sued instead of the gun makers or maybe the inventer of the gun or maybe Earth needs to be sued since thats where all the "evil" guns are.. maybe the star>supernova that fused and then spread the iron and sulfur atoms and other "evil" matter into the cosmos should be held accountable. Because certainly the hoodlum who pulls the trigger and shoots gas station employees is not responsible for his actions. Evil guns are possesing the hoodlums with ultimate power and ultimate power corupts ultimately. Funny that this never happens to law abiding citizens. Soon people will no longer be in Prisons, instead it will be Guns in prison, factories that make guns will be in prison. Then when we have no guns Aliens will come and attack us just like in an episode of The Simpsons.

How can we stop the madness?
How did these judges escape their insane asylum?
I am so thankful that I am not in California, but I feel sorry for all the farkers that are :'(
