It depends on whether the S40 is among the "various types and sizes of models" from which to choose. If it is not, then I would say she has a case, and could probably win damages. Which she better, seeing as how by suing her modeling agency, and she isn't that hot, she has just commited professional suicide.

If the S40 is among the group, then it will be ruled that she is a useless coont, and will be curbstomped until she at least gets a boob job.

My guess is that Ford told her to get some airbags because she just isn't that hot, and she used this tongue-in-cheek "model" wordplay to trump up some bogus outrage because she could see her modeling expiration date on the horizon, and she is trying to make as much money as she can. My guess is that her indignation will will subside with an out-of-court settlement in the $150,000 range.

She's pissing off Ford Models and Volvo. When Ford dumps her over this (and they will), no other agency will touch her because they'll be afraid of getting sued, and she wouldn't be producing any kind of revenue for them anyway because the Volvo people will get the word out to stay away from her. And why? Because she's complaining about a common practice and something that she didn't understand in a contract she signed.

In case you forgot, Carolyn, you were hired to be a prop.

Did you look at that picture, especially her dress? Bad choice for A|AA cups. One or two percent of body fat wouldn't hurt, either, although it helps if she always has her friend do the left with her. She makes my car antenna look pudgy.

It seems to me that if the "paid $2,000 unlimited usage for Volvo for their S40 model" stands up in court (which is probably will if were getting the proper wording) then she has a copyright violation on her hands. And Ford/Volvo owe her the going rate of an "unlimited use" package for the other car. Which means they owe her $2,000.

I for one am against fake boobs. Flat chested girls have nothing to play with true, hard man chest isn't my thing; but girls mostly just have small boobs. Squeeze 'em, they're soft. Skinny girls look cute and fun with small boobs. Huge tits are fun to look at in shirts ... not so much flopping everywhere, but some girls really do carry DDs and bigger VERY well. Some girls don't.

Fake boobs though? seriously I want the real deal here.

Except that the picture was showing up in ads for things completely unrelated to Volvo. Sounds like Ford Models (totally unrelated to Ford Motor Company) took the photo, which she agreed to it ONLY being used in ads for the Volvo S40, and started selling it for use by other entities. Volvo probably had nothing to do with it, but since they probably have much larger purse strings than Ford Models, and the picture was taken for a Volvo ad, her lawyer told her to throw Volvo on the lawsuit, as well, to try and get a bigger settlement out of the deal.

When you read what it says, you will note that one of the models they are talking about is the Volvo S40.

Possibly related: really hate people who skate through life because of their looks. I dated this chick once, and took her to a club. Walking in the door, they pulled us aside and offered her a job, which she took. Working a beer cooler.. her job was to open beer bottles, and take money for them. 4 hours a night, 3 nights a week.

That biatch brought home 3x my salary doing that, not counting all the free shiat and fringe benefits she ended up getting from rich people all the time.

However, she does have a point. They apparently paid her for unlimited usage for a specific model of vehicle. If they have used the image(s) in other ways or with other models she is due. Not the ridiculous amount in the lawsuit but she should have been paid.

without reading the article, all I can say is that, even if the language of the contract is very expansive, parties cannot contract beyond the intent of the contract.

Not sure about the merits of this case, but the whole practice of "unlimited" use really has to stop (and models need to stop accepting it). With unlimited use they can use you as the face/image of products and organizations that are totally against your principles. Lots of people are learning this the hard way when they let their image be used as stock photos. You can end up as the poster image for KKK or something and there is nothing you can do about it.

ONE of the "offensive" ads was for the dating site, which was sponsored by Volvo. You're right about that part. But the article seems to imply that not all of them involved Volvo. (though the video, which I hadn't watched before) does.
And even still, the contract she signed stated that the picture could be used an "unlimited" number of times to promote the Volvo S40. It COULD be argued that Volvo was using the picture to promote the S40 in the dating site ad. After all, the picture is of her sitting in an S40, and it's used for promoting Volvo cars, one of which is the S40, and they're not going to use a pic of their least- expensive car to promote their more expensive models. The Hertz ad is for renting the S40, as well.

I also think she's being a bit over the top in saying the dating site ad "made her look like an escort." The ad said nothing about escorts or prostitution. It "invited you to spend an evening with 4 Swedish models." Not 4 Swedish whores, which is what the term "escort" is usually used for.

Now, could one still say that Ford Models/ Volvo were a little bit sneaky with the contract? Yeah... You could. But the contract DID explicitly say that Volvo could have UNLIMITED use of the picture to promote its S40 model, and that seems to be what Volvo is doing with it. If she didn't want the image used in certain contexts, she could have asked that that be included in the contract. As for any other, non- Volvo ads that may exist, she certainly DOES have a case.

Disclosure time: I might have a pro- Volvo bias, since I own 3 of them and I also make quite a bit of my living servicing and maintaining Volvos. I'm a mechanic who specializes in European cars, and a good portion of my business is work on Volvos.
