If he did shoot himself (no matter how awkward) it should be easy to prove. There should be powder burns and residuals from firing the gun on his hands and back.

Ok, either these cops are the dumbest police to ever walk the earth because they couldnt come up with a better excuse why they executed a criminal, or they are the dumbest police to ever walk the earth because they allowed a criminal to shoot himself while cuffed missing the gun after three pat downs.

I know that the dude had to have been a hell of a lot more flexible than I am. The only way I'm shooting myself in the head with my hands cuffed behind my back is if the bullet goes through my back or shoulder.

He would have powder burns from a close execution style shot and the putting the gun in his hand and firing into the ground would put residuals on his hands.

Yates says Carter was frisked once and put in the back of the patrol car. Carter could have stashed the gun, which would explain how officers missed the gun the second time he was frisked.

I remember the story being, he was frisked twice then put in the car. now, they frisked him, put him in the car, and frisked him again (i guess in the car, or did they take him out of the car?)... then he JFK'd himself?

you know, this is one of those instances where, if criminal law had a doctrine of res ipsa loquitur, it would probably apply.

In my line of work, insurance, if we make a mistake like missing a pedestrian being hit on a police report... we can face jail time. The seriousness of their mistake is way beyond simply making a mistake at work. Plus, they originally said two officers frisked him. Again, not a simple "mistake". Either they didn't frisk him (in truth) or they killed him (still possible). Either way it should cost them their jobs at the minimum.

Exactly. Everybody is jumping on the cops, but the short headline "handcuffed man shoot himself in back of patrol car" doesn't give all the details. Don't they have dashcam footage of the cops standing in front of the car when it happens? I believe they have witnesses as well. A freak accident, but let's go after these cops anyway, because two states over there were some corrupt cops.

In 1994 a Houston police officer was shot by a handcuffed prisoner in the back seat. The gun was missed by all who searched him. He was able to wriggle his way around and get himself into a position to shoot him in the head. Of course, he didn't stop to think what would happen when he killed the driver of a moving car (it crashed into a house), and how to get out of the locked back seat.

This suspect shot the pursuing officer and made into the interrogation room with a loaded weapon in the front of his pants.

Only if the gun was so easily positioned. If it was missed after a pat-down, and then the gun was "stashed" so it would be missed upon a second investigation, would it be right there so easily placed to be grabbed?

The video also assumes similarities in flexibility and the like.

If the gun was stashed in plain site on the seat where he was sitting. They should have stashed the gun in the car someplace else where it would have been missed and see if he could retrieve it from there.

Of course, if these cops couldn't find the gun after two searches, then they probably are blind anyways.

Plausible they did miss it depending on where he had it stashed - it's a small pistol, 5.4" overall length, only 22 oz with no rounds
