The judge remarked that the documents on file with Vital Records had been "available to the state," and in oral arguments, the prosecutor had to admit that he'd never bothered to pull the file and inspect it.

More troubling still was Passamonte's observation that the MCAO's lone witness, Detective Chris Oberly of the Arizona Department of Transportation's Office of the Inspector General, told the grand jury this:

In 1999, Vital Records discovered that Torres' birth certificate, in his words, had been "falsely created" by Torres' mother and so the department "canceled it."

This was not true, according to Vital Records. Torres' birth certificate never was canceled and remains as valid as the day it was issued.

The massive influx many have written about never happened." Among other myths being propagated by the rabidly anti-immigrant set.

cops set up innocent victims and file false charges all the f*cking time and have been doing it since the beginning of society I'm sure.
this cop didn't do it for a kickback from the Omni Consumer Products. he didn't do it because his cousin is a guard at the county lockup and he wanted to get him an extra shift.
he did it because he is an antisocial abusive f*ck who gets a kick out of smashing people he can.

the authoritarian nature of this country or marijuana possession or unpaid traffic tickets being a jailable offense has anything to do with private prisons.
christ, I had a marshal come to my house when I was 21 and pick me up for unpaid parking tickets. it wasn't the private prison that they didn't take me to that was making the money, it was the sweet liberal city I lived. christ, you hear something that sounds half way plausible and maybe has a little truth to it but you get so damn excited you grab it in your teeth and then run off full speed head first into a wall. the cops are the f*cking ones that are arresting people.

You are correct. I'm a firm believer that any authority (police, DA) that purposely present false evidence in any case, should be punished at LEAST as much as the innocent person that was subjected to punishment because of it.

There was no reason for this case. It tied up resources that could have kept real criminals off the street, and punished an innocent woman. Seriously... how the fark does this sort of thing happen? What was this guy thinking when he falsely testified? What did he hope to accomplish?

Keep in mind, I'm not against the death penalty, or harsh treatment for real criminals... but when a DA or policeman railroad a person who is innocent of that particular crime to a conviction, they have done TWO unforgivable crimes: Framed an innocent, of course, but they have also allowed the real perpetrator to walk free. Forcng such authority figures to answer for their own crimes would go a long way to eliminating this sort of crap from our judicial system.

Black-Nosed Buddha

A nun who was searching for enlightenment made a statue of Buddha and covered it with gold leaf. Wherever she went she carried this golden Buddha with her.

Years passed and, still carrying her Buddha, the nun came to live in a small temple in a country where there were many Buddhas, each one with its own particular shrine.

The nun wished to burn incense before her golden Buddha. Not liking the idea of the perfume straying to the others, she devised a funnel through which the smoke would ascend only to her statue. This blackened the nose of the golden Buddha, making it especially ugly.

There's a country in Europe that tried the similar tactics in the early 1930s. I won't name names, else I'll instantly be accused of hyperbole, and we can't point out warning signs until they fire up the ovens.

Which isn't to say this will lead to the later 1930s, or worse, the early 40s, but it would be nice if we could nip this shat in the bud.

If we only had a list of traits that could warn us????

And what have you done with it since sticking flags into it?

I wonder with the lack of upkeep, what would international salvage laws say? What if one comes across a vessel that has clearly been abandoned for 40 years? Now, lets say some other country manages to have an actual colony established by 20 years? Can they claim the materials left behind, since then it would be 60 years of abandonment?

I'm too lazy to remind myself of the specifics of the laws and conventions regarding space salvage by looking them up again, but IIRC the Apollo landing sites are fair game to anyone who lands there and wants to snip bits off to - say - flog on eBay. The Smithsonian ostensibly has dibs on all NASA stuff, so they'd likely take umbrage and write a very stern note to the would-be entrepreneur (especially if said entrepreneur were not from the USA), or get all snarky and official on anyone who was from the USA and try to take it off them.

In a nutshell, as the items have been abandoned in place on territory that is not the USA (existing international treaties agree the moon can't be owned by anyone), they are fair game.

Either way only dicks would willingly interfere with historical sites such as the Apollo landing sites, but given the nature of the individuals in TFA this thread is attached to, there appears to be an ample sufficiency of dicks, so I'd suggest it's only a matter of time.

Mix in the Mormons, silver hairs and some Teabaggers and you get a county that consistently leans right.

This is in stark contrast to Tucson and Flagstaff that both lean to the left. But then both are university towns with a bit of an artist culture, not unlike Santa Fe.

Dinjiin: Nadie_AZ: See that map? Yeah, the one of the Mexican American war? The one America started in the 1840s? See that spot where I live? Where the Gila river is? Yeah, that's Phoenix. Guess what country that was in the middle of? Mexico. Mexico owned that land for 20 years. Before that? Spain. For hundreds of years. Spanish owned, bred and settled.

And when the United States annexed that land from Mexico, there were only around 80,000 non-Indian citizens residing there. That's half the population of Tempe spread over 500,000+ square miles. So sure, Mexico may have had territorial claims on the land. But it was mostly uninhabited. And after the Treaty of Guadalupe Hidalgo was signed, the vast majority of Mexican nationals living in the area renounced their Mexican citizenship and stayed to become US citizens.

But that's all moot. One of the benefits of defeating an enemy is that you get to enjoy the spoils of the war. So once the US purchased the land at gunpoint, they were the ones who could dictate the rules. And the rules today say that you have to abide by US immigration law. If the Mexican people have a problem with that, they are free to request that their government declare war against the US and forcibly reclaim the land for themselves. Until that happens, they can all drink a frosty mug of STFU.

Read that underlined sentence you wrote then read the fark headline and the linked article the headline refers to.

You see the problem yet?

The name has nothing to do with legal status, the skin color has nothing to do with legal status nor does anything else except the legal status itself!

If Arizona wishes to concern itself with illegal immigrants, it's best for them to be able to tell the difference between the descendants of those that has lived on the land since the treaty and the illegal immigrants themselves - besides, this entire problem would be most easily enforced by fining the businesses that hires illegal immigrants, which is already required by law to have documentation for taxation purposes!

In essence, the solution is already there - it is simply not being enforced. If you want to be mad at anyone for causing issues about illegal immigration, look to the people that are not enforcing the law through simpler and more effective means, not mass harassment for anyone that is not the right name or skin color.

If you're still in the dark about what effective solution I am referring to, It is simply auditing the businesses and making it very expensive for anyone to have 'unseen hands' working for them.

At what point did it become ok for a gigantic country created by immigrants to decide that it was full, and didn't want any more people? Any excuses the US government uses to defend its closed-door policies (such as the economy or lack of jobs) are just politically-correct disguises for nationalistic and often racist policies.

Texas culture, yes it actually has one, in my experience is heavily influenced by the Mexicans. Maricopa aspires to the more seperate but persecuted ideal. Apparently. The link refers to a person who is a citizen. She was arrested for no other reason than she was hispanic. See, here in Arizona, they do that. Sheriff Joe has been on trial the past few weeks because of this. The DoJ is still waiting their day with him in court. The problem isn't with illegal immigrants coming north, thought that is an issue that must be addressed on both sides of the border, the problem is with the people here who equate hispanic with illegal immigrant. Sorry, they aren't the same. We've native peoples here and we've migrants who've been settled here for longer than Arizona was a territory or state. They weren't native, they were settlers.

I've long been curious about the reason for this. While other regions embraced their past, Arizona seems to have wanted to be more like 'back east'. I read about an entire ad campaign in the 1920s called 'green the desert' where they encouraged grass and palm trees and anything so they could show people back east it was a perfect place to invest in, move to, visit. This is just one aspect of it, but Arizona has a history of doing this. A map of historic Phoenix shows it perfectly- the town is laid out, with the surrounded lands all green.

USA was, of course, the only country in the history of the world to ever take territory. Just ask the Aztecs.

Arizona wasn;t that hateful until the illegals started crossing the border in droves.

Just because there aren't any foreigners around to arrest, harass, and spew bigotry at doesn't make 3/4ths of Arizona's population any less racist. It's still a worthless state run and supported by worthless people.

So you kinda sound like a bigot. It might surprise you to learn that every single negative story on arizona originates from one county heavily populated by people from other states.

Not all of them. Quartzsite is a bit further west.

Quartzite has like a population of 2 for 11 months out of the year. The one month where the population goes over million is when they have the rock festival, which is almost all old RV' ers, again from other states. I believe it the largest population variation of any city in the US. From what I've seen it may vary well be the largest variation in the world.

svenge: The underlying statute is sound, as on average illegal immigrants aren't exactly likely to make court appearances or respect the law to begin with. Their mere presence here affirms that.

However, the county really screwed the pooch on this one. If you are going to incarcerate someone for being an illegal immigrant, you'd better make sure that you're right and do some due diligence lest you look like idiots and end up liable for $$$.

Can't agree more. Detective Chris Oberly should be brought up on perjury charges at the least. And outside of a judge, I hope that it takes more than one or two people to invalidate a birth certificate.

According to a Princeton researcher, "We are not being flooded with illegal Mexican migrants. The total number of migrants from Mexico has varied very little since the 1950s.The massive influx many have written about never happened." Among other myths being propagated by the rabidly anti-immigrant set.

that's complete bullshiat. and you are basically brain dead if you can't tell it is bullshiat. seriously. brain dead. no ability to even correctly judge whether it is raining or someone is pissing on your face.

we haven't had this high immigration levels since the 1920s. the 1950s when everyone had a nice job that paid well? yeah, that had something to do with the lowest immigration in 80 years either side of it. more people, more competition for jobs, lower wages. that's why the u.s. chamber of commerce is rabidly pro immigration. the democrats don't give a f*ck because they are concerned with power, not decent jobs for americans.
when did the middle class start to stagnate? 1970, right when the flood gates were opened because the democrats were interested in bringing in poor people to become the next generations democrats. the 165 immigration bill completely revamped the u.s. immigration policies and since then we have been the largest importer of foreign workers in world history.

No, no it isn't. This is *exactly* what a lot of us predicted. And oh, look, it actually happened. The fact is that in AR and GA you can be pulled off the street and disappeared because of what you look like.

Someone's life is ruined and "oh sorry" doesn't farking cut it.

Exactly. I just love (note sarcasm) that I am expected to put together an identification kit for my child/children to carry with them at all times in case one of them, while not in my company, happens to be asked by a police officer to prove citizenship. I wonder if Mr. Statute-is-sound realizes that in absence of such ID, which white children do not have to carry, my child/children could be detained until I can arrive with appropriate documents?

It is now a crime to be a child while brown.

Well I live here and I can tell you that there are not nearly as many as there used to be. They got the hell out of this shiathole when they began cracking down on employers. With no jorbs, they moved to Cali, Oregon and New Mexico.

I'm in Tucson, maricopa county is an island into itself. I did live in Phoenix for two years, that was as long as I could stand. It really wasn't that bad at the time, but it has almost nothing but cookie cutter homes and corporate business, I swear it's like they took the same block and copied it a million times over.

kapaso: poe_zlaw: and why do brown people continue to live there?

The Mexicans who haven't left Phoenix or the surrounding areas yet, must stay inside a lot. Seriously I bet they are afraid to leave thier homes. Of course that's just how the right wingers like it. I'm that sounds like hyperbole, but I don't believe it is. They know how the Mexicans get treated now, and the dog whistle phrases are almost constant from guys like sheriff joe, and they are winning elections by huge margins. Hating on the mexicans means you can't lose in maricopa county. The part that really sucks is that a lot of those voters are old retires from all over the country. Arizona wasn't this hateful until all your parents started coming here for the winter.

Florida is like that also. My in-laws live down there. Visiting them is creepy. Despite the fact that Florida is a fairly diverse state, my in-laws manage to live a segregated life. They live in an all-white neighborhood, belong to an all-white pool, and so on. The only time you see someone who is Asian, Black, or Hispanic is if they are waiting on tables at a restaurant the in-laws like. I wonder what my non-white child/children think of the situation. Sometimes I look around and cringe inside. And like your snowbirds in Arizona, my in-laws are transplants as well.

NutWrench: The judge remarked that the documents on file with Vital Records had been "available to the state," and in oral arguments, the prosecutor had to admit that he'd never bothered to pull the file and inspect it.

Detective Chris Oberly of the Arizona Department of Transportation's Office of the Inspector General should be in a farking jail cell.
