The underlying statute is sound, as on average illegal immigrants aren't exactly likely to make court appearances or respect the law to begin with. Their mere presence here affirms that.

However, the county really screwed the pooch on this one. If you are going to incarcerate someone for being an illegal immigrant, you'd better make sure that you're right and do some due diligence lest you look like idiots and end up liable for $$$.

You don't hear this much in the public arena, but this is what happens when you privatize the penal system. This is why we have the largest incarceration rate per capita in the world.

Why the hell do we need to have private prisons? They are just monopsonies riddled with greed and corruption. The level of corruption is really quite impressive, I sincerely believe that if prisons were publicly owned this whole stupid system would reform practically overnight, no more putting people in jail for smoking a joint, parking tickets, etc...

Florida is like that also. My in-laws live down there. Visiting them is creepy. Despite the fact that Florida is a fairly diverse state, my in-laws manage to live a segregated life. They live in an all-white neighborhood, belong to an all-white pool, and so on. The only time you see someone who is Asian, Black, or Hispanic is if they are waiting on tables at a restaurant the in-laws like. I wonder what my non-white child/children think of the situation. Sometimes I look around and cringe inside. And like your snowbirds in Arizona, my in-laws are transplants as well.

You are correct. I'm a firm believer that any authority (police, DA) that purposely present false evidence in any case, should be punished at LEAST as much as the innocent person that was subjected to punishment because of it.

There was no reason for this case. It tied up resources that could have kept real criminals off the street, and punished an innocent woman. Seriously... how the fark does this sort of thing happen? What was this guy thinking when he falsely testified? What did he hope to accomplish?

Keep in mind, I'm not against the death penalty, or harsh treatment for real criminals... but when a DA or policeman railroad a person who is innocent of that particular crime to a conviction, they have done TWO unforgivable crimes: Framed an innocent, of course, but they have also allowed the real perpetrator to walk free. Forcng such authority figures to answer for their own crimes would go a long way to eliminating this sort of crap from our judicial system.

cops set up innocent victims and file false charges all the f*cking time and have been doing it since the beginning of society I'm sure.
this cop didn't do it for a kickback from the Omni Consumer Products. he didn't do it because his cousin is a guard at the county lockup and he wanted to get him an extra shift.
he did it because he is an antisocial abusive f*ck who gets a kick out of smashing people he can.

the authoritarian nature of this country or marijuana possession or unpaid traffic tickets being a jailable offense has anything to do with private prisons.

Well I live here and I can tell you that there are not nearly as many as there used to be. They got the hell out of this shiathole when they began cracking down on employers. With no jorbs, they moved to Cali, Oregon and New Mexico.

christ, I had a marshal come to my house when I was 21 and pick me up for unpaid parking tickets. it wasn't the private prison that they didn't take me to that was making the money, it was the sweet liberal city I lived. christ, you hear something that sounds half way plausible and maybe has a little truth to it but you get so damn excited you grab it in your teeth and then run off full speed head first into a wall. the cops are the f*cking ones that are arresting people.

Well I live here and I can tell you that there are not nearly as many as there used to be. They got the hell out of this shiathole when they began cracking down on employers. With no jorbs, they moved to Cali, Oregon and New Mexico.


I'm in Tucson, maricopa county is an island into itself. I did live in Phoenix for two years, that was as long as I could stand. It really wasn't that bad at the time, but it has almost nothing but cookie cutter homes and corporate business, I swear it's like they took the same block and copied it a million times over.

Can't agree more. Detective Chris Oberly should be brought up on perjury charges at the least. And outside of a judge, I hope that it takes more than one or two people to invalidate a birth certificate.

Saw Estrella was the jail and thought "I'm starting to get behind the idea of an Arizona tag." Kinda hard to move from the place where the entirety of the family you like lives, though. I should move north, you don't find crazy stories like this in Flagstaff (that I'm aware of).

Quartzite has like a population of 2 for 11 months out of the year. The one month where the population goes over million is when they have the rock festival, which is almost all old RV' ers, again from other states. I believe it the largest population variation of any city in the US. From what I've seen it may vary well be the largest variation in the world.

parking is hell at the university. total was only about $350 or so. but the city constable/marshal said she had never got a warrant for under $500 prior to that.

I've long been curious about the reason for this. While other regions embraced their past, Arizona seems to have wanted to be more like 'back east'. I read about an entire ad campaign in the 1920s called 'green the desert' where they encouraged grass and palm trees and anything so they could show people back east it was a perfect place to invest in, move to, visit. This is just one aspect of it, but Arizona has a history of doing this. A map of historic Phoenix shows it perfectly- the town is laid out, with the surrounded lands all green.

I never said TX was perfect, it's why I live in the Bay Area, but Texas is diverse and isn't known for being anti-Mexican, especially compared to Arizona and anywhere in the SE (not too sure about the situation in Florida). I seriously doubt that it will be a speedy lawsuit. Especially there. I suppose it could possibly be moved to another county but I sort of doubt that it will be.

Texas culture, yes it actually has one, in my experience is heavily influenced by the Mexicans. Maricopa aspires to the more seperate but persecuted ideal. Texas maybe functionally retarded on many levels, but the way they have adopted and mixed cultures has been very progressive, don't tell them though or they will surely stop.

I'm still puzzled - why is Oberly not in jail pending a perjury investigation? Why is someone in the MCAO not in front of news cameras, providing a heartfelt apology to this woman for essentially destroying her life? No house, no job, separated from her family for months, and for what?

It's clear here that somebody lied, and that the only person who didn't actually lie to authorities is the person who was arrested and accused of lying to authorities. Why is it that it took four and a half months for someone to get off their damned asses and confirm a few pieces of paperwork?

However, the county really screwed the pooch on this one. If you are going to incarcerate someone for being an illegal immigrant, you'd better make sure that you're right and do some due diligence lest you look like idiots and end up liable for $$$.

Arizona's categorical denial of bail solely because of alleged immigration status is headed to the Eighth Circuit. Since Yick Wo v. Hopkins non-citizens are due equal protection under the 14th Amendment so it seems impossible that immigration status can be used as a basis to infringe the right to bail.

My middle name on my driver's license is not the same as the one on my birth certificate (the California DMV somehow gotten the idea I spell my middle name with an "e" on the end, although I never have). And my last name was legally changed when I was five. My license doesn't match my birth certificate at all!

Good thing I'll never go to that misbegotten state.

Sheriff Joe is an attention whore at best and a thug at worst. He can EABODs. His crime suppression sweeps are mostly for show and do little to attack the root of the problem, which are employers who hire illegal immigrants.

If the feds started treating companies who hire massive numbers of illegal immigrants like the organized crime syndicates they are, slapping them with RICO charges and seizing assets, then you might see a decline. In my city, they can impound your vehicle if you have 3 or more overly delinquent tickets. I think it should be more, since I've gotten 2 tickets (1 legit, 1 "they didn't bother to look for my residential parking pass that made it legit") that weren't on my car when I got back to it. And it was registered to my parent's address, so I didn't know about both of 'em until I got a "WTF YOU OWE THE CITY $60" call from my Mom.

If they made it even 5 I'd understand. And impounding the vehicle til you pay it off with a certain reasonable fee per day storage is fair - too many rich douchebags in this town for 4 years would just park wherever the f--k they felt like otherwise, as long as it wasn't in front of a hydrant*.

Arrest is a stupid, stupid waste of resources though.

* A friend's roommate did get a tow and $150 ticket for parking in front of a hydrant. "It was just 5 minutes!". Yeah, my eyes almost rolled into the back of my head since he had just mentioned he had driven into downtown because he was late for class.

What the fark would you call what happened to her? The state basically said that valid exculpatory evidence does not get you out of jail until the prosecutor was forced to admit being a fraud. If she did not have anyone who would speak up for her (and there are many in this country who do not have that luxury) she would still be in jail.

Old people white people. The Phoenix metro area is surrounded by retirement communities such as Sun City, Anthem, Sun Lakes / Ocotillo, and so on. They all still have a hard-on for the 1950s and do their best to vote in people who will keep the area like it was.

Then you have the Mormons in the east valley (mostly Mesa, but also in Gilbert and Chandler). Jeff Flake who is running for the Senate is a Mormon, as are many politicians that represent the area. They're not as bad as the lunatics that control SLC with an iron fist, but they do help the county lean right.

The name has nothing to do with legal status, the skin color has nothing to do with legal status nor does anything else except the legal status itself!

If Arizona wishes to concern itself with illegal immigrants, it's best for them to be able to tell the difference between the descendants of those that has lived on the land since the treaty and the illegal immigrants themselves - besides, this entire problem would be most easily enforced by fining the businesses that hires illegal immigrants, which is already required by law to have documentation for taxation purposes!

In essence, the solution is already there - it is simply not being enforced. If you want to be mad at anyone for causing issues about illegal immigration, look to the people that are not enforcing the law through simpler and more effective means, not mass harassment for anyone that is not the right name or skin color.

If you're still in the dark about what effective solution I am referring to, It is simply auditing the businesses and making it very expensive for anyone to have 'unseen hands' working for them.

The Phoenix metro is one giant suburb and tends to attract the sort of people who enjoy that sort of community. So while the City of Phoenix leans a bit to the left, most of the surrounding cities are filled with white flight from California, Washington, Illinois and the like, who all tend to be center-right. Mix in the Mormons, silver hairs and some Teabaggers and you get a county that consistently leans right.

This is in stark contrast to Tucson and Flagstaff that both lean to the left. But then both are university towns with a bit of an artist culture, not unlike Santa Fe.

I encounter a few problems by having a hyphenated last name (which I know Fark tends to frown upon) -- I try to do as much as possible with my legal, hyphenated name, but some things unavoidably get one or the other (I had a job years ago where the manager didn't feel like filling out my full last name and just chose one for the paperwork. Fortunately, I got a new manager within a few weeks, but I was already in the system with just one surname). But then, I'm Scandahoovian white, so I'm safe to travel in Arizona.

/Seriously, though, this story is outrageous. She should sue and bring as much attention to this issue as she can. This isn't guaranteeing the freedom of American citizens; it's infringing upon it.

I'm too lazy to remind myself of the specifics of the laws and conventions regarding space salvage by looking them up again, but IIRC the Apollo landing sites are fair game to anyone who lands there and wants to snip bits off to - say - flog on eBay. The Smithsonian ostensibly has dibs on all NASA stuff, so they'd likely take umbrage and write a very stern note to the would-be entrepreneur (especially if said entrepreneur were not from the USA), or get all snarky and official on anyone who was from the USA and try to take it off them.

In a nutshell, as the items have been abandoned in place on territory that is not the USA (existing international treaties agree the moon can't be owned by anyone), they are fair game.

Either way only dicks would willingly interfere with historical sites such as the Apollo landing sites, but given the nature of the individuals in TFA this thread is attached to, there appears to be an ample sufficiency of dicks, so I'd suggest it's only a matter of time.

The rains started early thIs year and have been a bit heavier then usual I believe. Tucson Is pretty good, I live just off 4th ave now close to the univeristy. I still believe maricopa gives AZ it's bad name though, flagstaff, Jerome, And bisbee are at least as liberal as tucson. Prescott and the verde valley lean right but not extreme, well maybe Prescott is little on the extreme side. All the rural ranching areas are pretty far right. I guess it just depends on how you look at it. Typed on a mobile so excuse the funky caps.

Yeah, I lived in that general vicinity, too. It's a great area. I also lived in Sam Hughes, on the other side of campus. It's great, too, but relatively pricey compared to other areas around the university.

My favorite joints in Tucson:

It would be interesting to know what the demographic breakdown was in the southwest at the time of annexation. You had many Castizos and Españoles who owned land and acted as missionaries (since they had the most influence and money), but I wonder how many Mestizos, Cholos and African descendants were working as laborers.

No need. I grew up in a state (Tejas) that is in the middle of the southeast and southwest, but as it stands, California (mostly SoCal but also the Bay and Sac), New Mexico, south Texas, and west Texas (as well as DFW in the north) are pretty cool with Mexicans. That was my whole point and I am still fascinated with why Arizona bucked the southwestern trend of being cool with our Mexican brothers and neighbors. Going back to the post that started our discussion, the main difference Arizona seems to have with the other SW states is that it has a bunch of carpet bagging old people (no offense to northerners, but I am a Texan and that is what we call it). I (obviously) like sociology and anthropology, so don't take offense, I just find the politics in Arizona to be interesting on that level. Then again Florida also has carpet bagging old people but they seem more open minded than Arizona is.

1981: Born in Arizona.
1994: Sent to live with her dad in Mexico as a teenager. He called her by a different name for who knows what reason. Mexican men are weird.
1999: Came back to the US, had problems at the border because she had her official name and her nickname and border patrol harassed her over it until her mom drove down with her birth certificate. Probably couldn't handle it because hey, she's only 18 and thought that as a dual citizen she wouldn't have those problems.
2012: Applies for a passport for her daughter. Told to go to the courthouse, where she's detained, questioned, and locked up. Officer Perjury tells the grand jury that she and her family forged everything and he has all the documentation that she's illegal. She goes to jail for months until the legal wheels exonerate her with the truth about the birth certificate; in the meantime losing her house and car to repo men.
2013: Officer Perjury is lynched. (We can only hope.)

I like how in these cases when the state farks up, they just say "Okay, we've decided not to charge you for that thing you didn't do. You can leave now." without so much as a 'sorry'. Yeah, the article was poorly written, but the second page does a little bit to describe what she was in for. Mainly the "unrelated felony" she was accused of amounted to "being an illegal immigrant", so I wouldn't exactly call it unrelated.

RTFA. The felony was forgery. The Good Ol' Boy cop didn't think her documents were real and on that basis locked her up for 4 1/2 months and since she was Mexican, she was denied bail. Due process delayed being due process denied is a sentiment I believe the Supreme Court has expressed, so it's true.

But neither was this woman disappeared. Disappeared means that they come and get someone, and when you ask the government, "What happened to Mark Markson?" officials respond with, "Who? And asking questions can get bad things to happen to you - just look at what happened to that Mark Markson guy." In this case, they would say, "Torres? Yeah - she's locked up in cell 428b in the Jail. Visiting days are every other Wednesday. Her lawyer, of course, can always request a visit."

What happened is outrageous, though, and officer perjury needs to sit in prison for quite some time. I'd say 4.5 years is reasonable so I want 10. The immigration law is subject to too much abuse and if they're serious about protecting people and only going after illegals, they have to make some examples of misbehaving officials. But they're not - they're just racist farkwads.

The hell are you talking about? Its written clear as day. She was being held for a Class 4 felony or above, and her bail was denied because they didnt think she was a citizen. Article writer then completely glosses over this fact, and words it so everyone thinks she was only being held because they thought she was mexican. No, she was being held because she committed some other unrelated felony, which the article never even bothers to mention what felony she had committed. This leads me to believe that the sensationalist writer is bending the truth in their own agenda to attack the immigration law.

For the last century, US farmers and anyone else in need of cheap seasonal laborers have been helping Mexicans cross the border to work. When immigration became regulated, they kept doing it without following the law. And despite all the rhetoric about Mexicans "taking our jobs", they are still doing it. And you know what? Why should any American care? This cheap labor keeps the cost of certain things low, and they do necessary jobs that no American wants to do for any amount of money. They do, in fact, pay taxes, as well as spend their money locally.
What it really comes down to is not that they are unfairly benefiting from all that the USA has to offer its citizens. Nobody is complaining about all the illegal immigrants from central Europe who don't come here for jobs and are here all year round. What it is really about, is racism.

I'm not going to read through 6 pages, but this was the whole reason she was arrested. The woman's obviously innocent at this point, but why the fark someone would do this? It's incredibly shady.

I didn't read all 6 pages either, but on the first page its says that she submitted her legal birth certificate when her daughter applied for a passport, and then the Detective Chris Oberly of the Arizona Department of Transportation's Office of the Inspector General, perjured himself before a grand jury by falsely testifying that "In 1999, Vital Records discovered that Torres' birth certificate, in his words, had been 'falsely created' by Torres' mother and so the department 'canceled it'." THAT sounds fishy. Why aren't you calling for the perjurer to face charges and be held without bail?

But the constitutional Right of Habeas Corpus is the line in the sand that blocks your slippery slope argument. She was not disappeared or anything close to it.

I would like to see lawsuits replaced with criminal prosecutions. In this case against Oberly and possibly against the prosecutor who didn't bother to look at the evidence. Of course, we would first have to do away with prosecutorial immunity.

You know, under the Detainee Treatment Act, judges aren't allowed to hear habeus motions, right? So, doesn't matter if yer a citizen, if they classify you as an illegal. For instance, by flat-out lying about it.

Habeas Corpus has been systematically under attack since 2001. Suspending it for "enemy combatants" was one of the first things Bush did by executive order in November 2001. And he did it again in 2006. And right up through the NDAA in 2011 and beyond, Habeas Corpus is a "sort of right" to be revoked at the whim of the executive branch. While Obama made his signing statement on the NDAA, that statement is non binding and does not affect his successor.

I think that Glenn Greenwald has a shrill writing style, even more-so than mine, but I have to agree with him sometimes about this crap. It disgusts me.
