I've long been curious about the reason for this. While other regions embraced their past, Arizona seems to have wanted to be more like 'back east'. I read about an entire ad campaign in the 1920s called 'green the desert' where they encouraged grass and palm trees and anything so they could show people back east it was a perfect place to invest in, move to, visit. This is just one aspect of it, but Arizona has a history of doing this. A map of historic Phoenix shows it perfectly- the town is laid out, with the surrounded lands all green.

That's the best part of the whole farking thing: nothing. She was arrested because she was trying to get a passport for her daughter and then BAM: she's arrested because her documents had her legal name on them, rather than "Carla Gomez" which wasn't her name... but they thought it was.

She wasn't even jaywalking. An actual, honest-to-goodness victim.

What was she originally arrested for?

She showed her valid driver's license to a cop. The cop didn't believe the name on it was really hers, so arrested her for forgery.

That's the real beauty of the situation: once the cop accuses you, demonstrating your innocence becomes a crime.


Whereas if you're a prosecutor you are evidently allowed to commit perjury before a grand jury with no penalty. Unless you decide to take your own conduct before the grand jury so they can consider it.

My prediction? This is the court case that was needed to strike down the one statute that got away from the Supreme Court when they judged Arizona. Well, I hope that for the woman's sake, that it will be a speedy and clean trial. But it is a possibility.

Apparently. The link refers to a person who is a citizen. She was arrested for no other reason than she was hispanic. See, here in Arizona, they do that. Sheriff Joe has been on trial the past few weeks because of this. The DoJ is still waiting their day with him in court. The problem isn't with illegal immigrants coming north, thought that is an issue that must be addressed on both sides of the border, the problem is with the people here who equate hispanic with illegal immigrant. Sorry, they aren't the same. We've native peoples here and we've migrants who've been settled here for longer than Arizona was a territory or state. They weren't native, they were settlers.

I gladly admit I don't know the entire history of this region. It is why I keep studying, learning. I wish I could make that my career, but it isn't likely to be.

I never said TX was perfect, it's why I live in the Bay Area, but Texas is diverse and isn't known for being anti-Mexican, especially compared to Arizona and anywhere in the SE (not too sure about the situation in Florida). I also think it's more open to Mexicans than any of the lily white places in the north.

I seriously doubt that it will be a speedy lawsuit. Especially there. I suppose it could possibly be moved to another county but I sort of doubt that it will be.

Texas culture, yes it actually has one, in my experience is heavily influenced by the Mexicans. Maricopa aspires to the more seperate but persecuted ideal. Texas maybe functionally retarded on many levels, but the way they have adopted and mixed cultures has been very progressive, don't tell them though or they will surely stop.

I'm still puzzled - why is Oberly not in jail pending a perjury investigation? Why is someone in the MCAO not in front of news cameras, providing a heartfelt apology to this woman for essentially destroying her life? No house, no job, separated from her family for months, and for what?

It's clear here that somebody lied, and that the only person who didn't actually lie to authorities is the person who was arrested and accused of lying to authorities. Why is it that it took four and a half months for someone to get off their damned asses and confirm a few pieces of paperwork?

svenge: The underlying statute is sound, as on average illegal immigrants aren't exactly likely to make court appearances or respect the law to begin with. Their mere presence here affirms that.

However, the county really screwed the pooch on this one. If you are going to incarcerate someone for being an illegal immigrant, you'd better make sure that you're right and do some due diligence lest you look like idiots and end up liable for $$$.


I wondered how long it would be until someone came along and defended the policy that would even allow this.

Arizona's categorical denial of bail solely because of alleged immigration status is headed to the Eighth Circuit. Since Yick Wo v. Hopkins non-citizens are due equal protection under the 14th Amendment so it seems impossible that immigration status can be used as a basis to infringe the right to bail.

I'd be so screwed if I was in Arizona right now.

My middle name on my driver's license is not the same as the one on my birth certificate (the California DMV somehow gotten the idea I spell my middle name with an "e" on the end, although I never have). And my last name was legally changed when I was five. My license doesn't match my birth certificate at all!

Good thing I'll never go to that misbegotten state.

Guess what country that was in the middle of? Mexico. Mexico owned that land for 20 years. Before that? Spain. For hundreds of years. Spanish owned, bred and settled.


And when the United States annexed that land from Mexico, there were only around 80,000 non-Indian citizens residing there. That's half the population of Tempe spread over 500,000+ square miles. So sure, Mexico may have had territorial claims on the land. But it was mostly uninhabited. And after the Treaty of Guadalupe Hidalgo was signed, the vast majority of Mexican nationals living in the area renounced their Mexican citizenship and stayed to become US citizens.

But that's all moot. One of the benefits of defeating an enemy is that you get to enjoy the spoils of the war. So once the US purchased the land at gunpoint, they were the ones who could dictate the rules. And the rules today say that you have to abide by US immigration law. If the Mexican people have a problem with that, they are free to request that their government declare war against the US and forcibly reclaim the land for themselves. Until that happens, they can all drink a frosty mug of STFU.
