They may have had a tip. I remember a case from Boston where cops broke into a bedroom with a search warrant for a woman's vagina. There was a rumor on the street she kept drugs there. Said vagina was empty. She lost her lawsuit. The court said the warrant should not have issued and vaginal search warrants should be granted only by judges, not magistrates. The court also said the ruling was prospective only, meaning the next woman raped by the war on drugs may be able to sue.

How do we know the cops didn't stop her for a DWB? It is Florida, after all.

How much information do those police laptops with license plate scanners show? Say the cop had just pulled up behind her in traffic, the license plate scanner showed that she had previous arrests for DUI/drugs, and he decided to follow her until she broke a traffic law he could pull her over for. Would it also show case reports like if in past arrests she had hidden drugs in her vagina? That's the only way I can even sort of make sense of why a traffic stop would turn into a cavity search, but still it seems like it would have been smarter to call in a female officer or take her into the station before doing a search like that.

I don't see the problem with public strip searches. We're animals. Our default state is naked. Deal with it.

What I don't like is ANY search conducted without proper 4th amendment protocol being followed. If you search my clear plastic bag beach that only contains flip flops and a towel and you can see that from 20' away because it's clear, but you without a warrant, that's 1000 times more demeaning to me than someone seeing me naked.

Well, that makes it OK, then. She's been arrested; she deserves our scorn, and forcible tampon removal by government representatives.

FTA: "Then, in a gruesome twist, a female officer "forcibly removed" a tampon from Tarantino. Presumably, the cops were looking for drugs, but the lawsuit notes that a drug-sniffing dog was never called in, and cops never found any contraband or anything illegal."

They were looking for drugs and they found crack.

Good job everyone!

I'm of the belief that no matter how skanky someone is it's inappropriate to perform a strip search on the side of the road.

Doing it in front of her kids and removing a tampon is just the icing on the cake for her lawsuit. The Cops have just bought this woman her new house. The best they can hope for is that she'll be cheap to pay off and they'll get off a little cheaper than others.

But at best if it ends up being true then they'd better just start writing checks now.

I doubt this story. There is not a tampon large enough to stay inside the vay-jay-jay of a mother of two. Unless they both were C-section.

/not mean it.

2012-08-09 08:25:13 PM
The cops exceeded their authority. If PD believed a field strip search was required, a suitable facility should have been available to preform the procedure. The suspect was detained in a police car for two hours- there was time and opportunity for other arrangements to be made. Was the reason for the strip search disclosed?

I was trying to point out the strip search was unlawful because no one was arrested. If the police start getting into the habit of arresting people just so they have an excuse for a strip search, the lawsuits are going to get expensive.

Actually find the right cop with a god complex and he may.

Granted she has a whole bunch of DWI's, but I do believe that can be handled through blowing into a tube and checking her eyes.

The fact that you are justifiying a public strip search makes me think a previous jaywalking ticket would be enough for you to defend the police in this matter.
