Meh, IQ of 61 or not, I'm not in favor of the death penalty as a punishment for a number of reasons.

1. Putting one innocent person to death negates the death penalty (right now at a 140, but that doesn't help someone like Cameron Todd Willingham. You can't undo the death penalty.
2. It costs more than life in prison.
3. It has no effect as a deterrent.

So while people may yammer on that so and so deserved it...and there are people that DO deserve it, it's just not worth the cost both financially and as a society.

Does Texas use M'Naughten as its standard? That's the only one that still uses "difference between right and wrong" as the only standard for capital murder. Most other states are using either the Model Rules or irresistible impulse tests. And even M'Naughten allows that the person must understand both that killing was wrong AND be unable to appreciate the outcome of their actions.

Whichever way you slice it, executing a retarded man for killing a drug dealer is just asinine.

I knew a guy who was a capital offense defense attorney. He once told us about a case where his defendant, more or less, raped his girlfriend, killed her, raped her dead body, chopped her up, raped the dead parts, buried the dead parts, dug up the dead parts, then raped the dead parts again. I asked (eagerly) if the defendant was given the death penalty. He proudly said, "no." He explained his job was to make sure this guy got an iron-clad defense. He had no chance of appeal and because he wasn't given the death penalty, it limited his appeal options. This would save the tax payers a great deal of money.

You can't un-kill someone. Grats, Texas. You executed another retarded guy. Good on you. Assholes.

The odds of recieving capital punishment in Texas decrease greatly if you don't kill anyone. They really, really don't like that.

Alternately, mistakes are made, which flies in the face of justice.
