In criminal prosecutions, mental retardation should be an aggravating circumstance rather than a mitigating circumstance. It should be the responsibility of the government to prove, beyond a reasonable doubt, that the defendant is retarded.

A first degree felony with an affirmative finding of retardation should be enhanced to a capital offense. So a defendant found guilty of a crime like murder or aggravated sexual assault would be eligible for the death penalty if the State could also prove that the defendant was retarded.
The theory is that we, as a society, are quick to "put down" other sub-human species when they become a nuisance or harm people. If a human has the mental capacity of a dog then the threshold for extermination should be lower. You can't rehabilitate a mad dog or a retard.
