Why does this have a stupid tag? I wish more of this would happen. These dang parents raising these psychopaths crying that their little snowflake "is a good boy", "was turning his life around", "not his fault because he had a mean daddy" etc. This protecting enables these thugs to have a safe house to turn to and allows them an easier time inflicting their horrors on the public longer than if they were given the boot and contacted by the police on the street planning, selling, hiding their crimes.

Just like these parents that are fine with their gang banger kids crime when it is bringing in the $$ but the minute they get shot committing a crime they cry foul and sue the police.

She was responsible for what happened there.... welcome to home ownership. She needs to know what's going on at property she owns and do something to correct any problems.

With all the idiotic lawsuits from greedy family members when their criminal offspring gets killed by police, its good to see the tables turned. Make her pay for letting this crap happen.

America has a huge problem with wanting to blame everybody. The person responsible for shooting the cop was the guy that shot the cop. This obsession we have with blaming everybody and anybody for the actions of one person is getting out of control and really hit its peak with the Sandusky incident.

There is a huge difference between suing the police and the police suing somebody else. When you sue the police its like suing a corporation because the money doesn't come from the persons own pockets but rather the taxpayers which have unlimited money. An old lady does not have unlimited money. She has to think about things like living and eating.

Property ownership carries with it absolute liability. If someone trespasses and breaks and enters into your home, YOU are liable for any injuries that they might occur. Just like if a neighbor's kid falls out of your tree at 2 AM. Or if an invited guest slips and falls. Fault, intent or any other circumstance has nothing to do with it. The only two facts that matter is A) you own the property and B) someone got hurt or died.

Best part? Residential insurance typically excludes coverage of law enforcement damages and this might extend to liability coverage as well. Not sure about that last bit, but I know that if the police break down your wall with a tank your insurance company won't pay for it.

To those who keep saying that there is a responsibility as a homeowner, note...there are already laws in place for this.

If illegal activity is happening in your house, you are responsible for this. But there isn't a need to sue, there is a need for you to be arrested and face actual charges. And here is where the burden of proof is on the state.

Apparently the state doesn't have a case enough to convict so they are grasping at that civil court straw.

There lies the problem. Well, just one of the many problems we have with 'law enforcement' in this modern age.

Depends....did she have reason to believe her son was dangerous, and did she either have the means to control him, or reason to believe he would listen to her? Then, yes, she could be liable for failing to take action.

/IANALY, but did recently cover just such a scenario in torts.
