/I figured the cop was in the right and that the woman was crazy in the original article, but yeah. I think having personal recording devices (including a camera) on every officer is a wonderful idea.

Garay said he then grabbed Claudia Ambroziak's hand "before she was able to apply any more pressure to my neck," and charged her with battery on a law enforcement officer, according to his report.


Seems to me that he wrote in his report that he asked for her to demonstrate it, and did not object when she put her hands up to his neck. It wasn't until she applied a bit of pressure that he freaked out and arrested her. On the recording, it sounds like it all happened pretty fast, but it still sounds like a gross overreaction by the officer - she wasn't trying to hurt him (intent is a large part of the law) - I would think a warning and simply pushing down the arms would have sufficed.

I seem to remember an article where some guy was asked to come out of his house (or something) by an officer, and he slipped on his steps and fell against the officer, breaking the officers name plate off. He was charged with distruction of police property.

At what point does he state that he feels threatened? Under what interpretation of the law is it required for you to feel threatened for an assault to occur? If this lady had walked up to a bystander and did the exact same thing in front of a cop, would you prefer it if the cop did nothing with the logic of 'She's old, so she can't really commit a crime of violence'?

She was dumb to put her hands on a cop even if that's what she thinks he wanted, but he was a complete a**h*** to arrest her when it was perfectly obvious that she was just trying to comply and was not actually trying to choke him. Jesus, why couldn't he say "Ma'am, I didn't actually want you to demonstrate on ME; please do not touch me again"?

LEO here...I would NEVER ask a victim of assault "How did he (hurt) you?" while standing in their vicinity, because I know that they may very well put their hands on me to "show" me.
-The cop should have known better to ask that way,but he didn't.
-When she got up/moved toward him he should have said "don't touch me", but he didn't.
-After she did it, he should have just thanked her and asked her not to touch him againt, but he didn't.
-When he thought about charging her with a crime, he should have squashed that thought, but he didn't.

Even if she was abusive, drunk and a career criminal, he didn't handle this situation right.

Yes, if a cop touches a civilian unnecesarily in a way that would consititute assault, they should be arrested. Every time.

If someone moves aggressively and puts you in a choke hold, that is assault. Are you saying it is not?

Be sure to check out the audio at the bottom of TFA---the way *I* heard it, it seemed like she was demonstrating "physically" what was done to her after being asked to do so. I can imagine that in her state of mind she was probably acting aggressively BUT I can't imagine her intending to do any harm. I can't imagine a way for realistically pantomime "being choked", nor any way for her to "demonstrate" what was done to her without her using her hands. Even at the most extreme, maybe the gal was still freaked out about what happened and truly thought that "applying pressure" was the best way to demonstrate what happened (rather than, say, placing her hands inches or feet from the officers neck and making fake throttling motions).

I think the cop overreacted. Would have been better if he simply immediately told the woman "Whoa! I meant describe it 'figuratively'!"

Well the woman is most likely a bit loony, but I doubt she meant any harm to the officer. Most likely the charges will be dropped. The cop should have just hand cuffed her, told her not to do what she did and let her go after he took her statement. Right or wrong, he was still being a dick by charging her.

He's charging her because as a cop the more charges you make the better and more pro active you look to your higher ups come promotion time. This is basically the same as meeting a monthly quota for traffic fines. It puts the cops in the position of being overly eager to charge for every and any perceived offense. He's just trying to be "top cop"
