The man was charged with drug equipment possession. His court date is July 31.


Based on the article it sounds like there wasn't enough coke to charge him with drug possession so they got him on having a straw...

It takes a special kind of tard to allow police to perform a search of your home when you know that you have drugs in there. Well, not that special, I suppose, since it seems to happen every day. What goes through the mind of these people? Why do you let police in your house?

If they have to ask your permission to come in, that means that they have no legal authority to come in.

Plain view really isn't relevant when you give the cops permission to rummage through your house.

In all honesty you'd be surprised what gets overlooked when it's sitting in plain view.

Waaay back when I was in high school we were having a party and got the cops called on us, because someone reported the "odor of marijuana" they searched the apartment and despite being very thorough they didn't look in the McDonald's bag on the end table that had about four ounces of pot in it. If we had tried to hide it somewhere they most likely would have found it and looked inside, they didn't "toss" the place but they looked everywhere I would have hidden anything and some places I wouldn't have even thought of.

Just sayin.

Good thing we didn't have any cut straws, though.

You don't need to also state it is out in the open. You've already stated it's in plain view. It wouldn't be in plain view if it wasn't out in the open.

You don't need to also state it is out in the open. You've already stated it's in plain view. It wouldn't be in plain view if it wasn't out in the open.

That's because the cop does not say "Hey do you mind if I search your apartment for drugs?". They say something like "Hey it's cold/raining outside, mind if I step in for a second?".
Let em in and Bam! you just consented to having your place searched, Joe Blow doesn't know that.
