1. I don't know that that's the point. I doubt she could have avoided hitting the poor woman.
2. Her boyfriend hit the woman off the bike, not her.
3. Well, I may have an argument there...

Anyone dumb enough to be drunk that early in the morning, is also dumb enough to get scared crazy and flee...
But here's the thing... She left the scene - with her boyfriend injured?!

Something isn't adding up on that one.

I worked a case like this once in the state senate, where a developmentally disabled mother was killed in a DUI hit and run, but the county DA didn't want to bother prosecuting because it wasn't high-profile enough for him. And like this case, the woman at fault loudly and publicly proclaimed her innocence, which only made it worse for herself.

She eventually served five years for vehicular homicide.

AFAIK that's not true. If someone else definitely caused the accident, your drunkenness isn't their 'get out of jail free' card, at least from a criminal perspective.

The false reality that downing tons of alcohol, passing out at 3am and waking up at 7am makes you suddenly sober - because "it's the next day."

Maybe the guy knew not to shoot off his mouth though. I can imagine a judge throwing the book at the woman for having no empathy.

People seem to have missed the fact that she was on the bike, therefore shouldn't have been on the road at all, or something.


Round these parts, they put a bylaw in that stating that a bicycle is considered a road vehicle so they must ride on the roads at all times, no sidewalks. In some areas, it is illegal for bicycles to ride on the bike/walking trails (at least, that is what they started out as but the walkers have biatched enough about reckless riders to get them banished to the streets).

//personally I ride on the trails (respectfully) and will pay any ticket they wish to give me. My life is worth more than the ticket.

They were traveling next to eachother on a single lane road. A motorcycle counts as a car in this case. That there is reckless driving. Even if she wasn't drunk, she was at fault. They both were.

I work for a prosecuting agency. Grabbing facebook posts is pretty much a weekly or more activity.

People are total idiots. Just as a recent example, don't post pictures of your tickets and actual photos of you and your buds at an event if you're going to tell the cops you were a couple hundred miles away at the time.

It doesn't end well for you.

True - she possibly missed the negligent homicide (well depending on how the law is written), but probably will be charged with some serious offenses: fleeing the scene - a felony in NY if it results in a death, reckless driving, etc etc etc.

Yes a valuable member of society she is not. My prediction is that she will be found not guilty in the death but guilty of DWI she will have to pay a fine, probation and community service. She will become pregnant by this guy before he ends up in jail and she will have the child then not be able to support it so she will turn to welfare. The DWI on her record will force who to get a low paying job so she will have to get government assisted living. She will spend her life poor and have a few baby daddies turn to alcohol and or drug abuse. She will have at least three kids all will become pregnant or get someone pregnant before the age of 16.

Depends on the state. Some allow 'lane sharing' with cars. Even if she couldn't help hitting the cyclist she is still guilty of DWI and leaving the scene of an accident.

Route 250 actually has a lot of different speed zones. God damnit, Penfield, and Rochester in general, stop getting in the news. Anyway, yeah I used to live close to there and it was a regular drive for me. Between the north end of the Village of Fairport and that four corners Penfield area, it's a combination of 30-45 mph, mostly 45 in between them. Past the four corners (bunch of lanes, gas stations, McDs, if you're on the Google Maps), and go about a half mile north, it goes up to 55, because it heads into a bunch of farm land at this time. I say at this time because they're all trying to sell out to housing developers, but at least as recently as a few months ago I think it was all still 55ish.

However since the article says they were both in separate lanes, I expect they were somewhere close to the four corners since the rest of that road is just two lanes. The local news says it happened Sunday morning which is about the lightest time for traffic through that area during daylight, but it would still have been pretty busy as there's a big shopping center entrance there.

Let me be clear, these two idiots need to get locked up for a long, long time. However, that's also a pretty dangerous place to ride a bike because traffic in that whole area has increased probably 100% just in the last ten years and they haven't really expanded the roads enough to handle it. I hate even driving through there in peak times and haven't ridden a bike there since I was a teenager. It sucks that this happened but I'm honestly surprised people don't get hit more often around there...

It could be argued that it really wasn't her fault. Her shiat-ass boyfriend was the one who knocked the woman off her bike, then she didn't have time to react. Problem is, she was drunk too, and ran away from the scene. Killed a woman, then bailed on it, then fronts about it on Facebook.

This should be delicious.

Whoops, my bad, they don't actually say if they were or weren't. Either way, it's still a bad area for cycling except in the very very early daylight times - like 6 am.

This happened in our area, and I have friends in the cycling community who knew the victim well. The details of the accident were so horrible that it made me nauseous. This facebook post only proves what I originally thought of this dirtbag. She (and her a$$hole boyfriend: may he ROT in jail, with his new boyfriend Bubba) are A) Stupid B) Childish and C) Selfish. If she had a shred of decency, she would be publicly begging for the forgiveness of the family that she DESTROYED.

FARK her, I hope they find something significant to charge her with, she should never see the light of day.

Ugh, turns out they were up in the 50-55 mph zone, I am pretty sure. Local news gave a cross-road which I looked up, and the limit goes back to 30 about another half mile north of where that is. So yeah they were probably speeding, and it's only two lanes there. In fact the shoulders aren't as wide, either... because at least on the satellite picture, they're not even marked. That might be old since I think they repaved last year, but the road is a bit narrower in that area.
