I'm guessing it's because (inferring from the article) her boyfriend on the motorcycle hit the bicyclist, throwing her into the path of the car. Little Ms. Suck It may not have been able to avoid hitting her in the best of circumstances.

Fleeing the scene, though, that's a crime she should also be charged with.

As someone who sees things from both sides such as the judge I would like to see this story also from two sides upon which one side is that yes this is the stupid thing to do and the other side of this is perhaps there is the reason for doing this.

You see you might wish to say to the self of you HELLO SELF OF ME IF I CAUSE THE DEATH OF THE OTHER I SHOULD NOT ADVERTISE THIS UPON FACEBOOK. The reasons for this include that you might end up on the Fark.com website which to 9 of 10 people who wind up here either in the article or especially as the poster means you will not ever have the sexing again. Also it is something upon which the prosecutor attorney of the district might say to the jury to view with the consideration of the facts of the case. Also the encouragement of she could lead to the widespread outbreak of the STD diseases if people take this literally of her.

The other side of this says listen if the public of the locality will do the judging of you in some way then it is best to do all upon which you can to taint the jury pool in the area and also to get the revenge on the haters of the area through the remarkable penmanship of you. This could be the opening sentence to the next great autobiography and I do not wish to take this from she. Also some people apologize in the ways that others would find to be surprising. Perhaps this is the way in which she knows how to do the apology.

The moral of the story of this is that you should not judge the book by the cover or the person by the Facebook posting because mark the words of me she will claim someone did the account hacking.

I doubt its that much. I do quite a few divorces and it hasn't really come up for me, because most are based on separation; not adultery.

I could see it coming up in that many divorces based on adultery, however.

Well you're in luck. In the comments section of the article from the local newspaper, someone posted a screen shot of the Facebook page. You can see some of the comments. She clarifies her "get the real facts straight" part by adding "She got hit by the bike and went on front of the car I was driving, she got ran over and uk the rest". Other than that, it's mostly people saying that they hope she is ok - one of them is telling her to get sober.

Bonus: There is a picture of this chick that shows her holding a beer the night before the accident. The time stamp says it was posted 22 hours ago and the time stamp on the "suck a dick" status is 2 hours ago

My guess is she's ignorant of DUI laws and thinks that somehow the "hitting the person on the bike" part would have happened anyway.

Sort of like... lets say you're over the limit and driving. And someone runs a red light at hits you. And lets say this would have happened anyway, no matter what your state. If you're subject to a roadside test and breathalayzer... you're not getting out of it. You're probably going to be found at fault for the whole thing. Just the way it works.

I'm assuming here... not a lawyer, not a drunk driver.

So just looking up some background here: Route 250 is apparently a flat, straight country road through the northern half of Penfield (about a 2-1/2 mile stretch in town). It's got a dotted middle line (i.e, passing allowed), with what looks like at least a bike's width of shoulder outside of the travel lanes. In other words, most likely a speed zone.

We know she went drinking the night before. We know her boyfriend has been convicted of DWI, and that apparently he was showing off, most likely to remind her of how awesome he is. We know he hit the bike, and she was going too fast to stop. (And if you want to include the bonus from upthread, someone even told her to "get sober" in response to her stupid comment, which a good prosecutor would take as an invitation to ask said poster to elaborate upon in court.)

Is she really is that much of a vapid, ignorant trailer trash moran that she doesn't think she's legally screwed? She's about to see how life was for her boyfriend, who may not even survive to offer her moral support and a conjugal visit.

Typically, but not always. In my college town, a drunk girl got hit after leaving a football game a few years ago. She was crossing the highway, and ran into traffic, where she was hit by a drunk driver. However, even the cops testified that no one could have missed her, sobriety was not a factor. The driver was eventually acquitted. Or charges dismissed, don't remember. The driver was charged, but not convicted. So if it turns out she was driving in her lane, not speeding, etc. it's possible she doesn't get found guilty.

Just an example, I'm ok with torches and pitchforks too though.

I worked a case like this once in the state senate, where a developmentally disabled mother was killed in a DUI hit and run, but the county DA didn't want to bother prosecuting because it wasn't high-profile enough for him. And like this case, the woman at fault loudly and publicly proclaimed her innocence, which only made it worse for herself.

She eventually served five years for vehicular homicide.

The false reality that downing tons of alcohol, passing out at 3am and waking up at 7am makes you suddenly sober - because "it's the next day."

Round these parts, they put a bylaw in that stating that a bicycle is considered a road vehicle so they must ride on the roads at all times, no sidewalks. In some areas, it is illegal for bicycles to ride on the bike/walking trails (at least, that is what they started out as but the walkers have biatched enough about reckless riders to get them banished to the streets).

//personally I ride on the trails (respectfully) and will pay any ticket they wish to give me. My life is worth more than the ticket.

They were traveling next to eachother on a single lane road. A motorcycle counts as a car in this case. That there is reckless driving. Even if she wasn't drunk, she was at fault. They both were.

I work for a prosecuting agency. Grabbing facebook posts is pretty much a weekly or more activity.

People are total idiots. Just as a recent example, don't post pictures of your tickets and actual photos of you and your buds at an event if you're going to tell the cops you were a couple hundred miles away at the time.

It doesn't end well for you.

She eventually served five years for vehicular homicide.

Let me be clear, these two idiots need to get locked up for a long, long time. However, that's also a pretty dangerous place to ride a bike because traffic in that whole area has increased probably 100% just in the last ten years and they haven't really expanded the roads enough to handle it. I hate even driving through there in peak times and haven't ridden a bike there since I was a teenager. It sucks that this happened but I'm honestly surprised people don't get hit more often around there...

Whoops, my bad, they don't actually say if they were or weren't. Either way, it's still a bad area for cycling except in the very very early daylight times - like 6 am.

Ugh, turns out they were up in the 50-55 mph zone, I am pretty sure. Local news gave a cross-road which I looked up, and the limit goes back to 30 about another half mile north of where that is. So yeah they were probably speeding, and it's only two lanes there. In fact the shoulders aren't as wide, either... because at least on the satellite picture, they're not even marked. That might be old since I think they repaved last year, but the road is a bit narrower in that area.

AFAIK that's not true. If someone else definitely caused the accident, your drunkenness isn't their 'get out of jail free' card, at least from a criminal perspective.

Of course you're stuck with the DUI either way and I don't know how it works with insurance. You might be out a bunch of money.

We had a case locally where a drunk guy hit someone who pulled out in front of him. Police chief wished he could throw the book at the drunk guy for the whole accident, and expressed disappointment that since the fatal crash wasn't drunk guy's fault, he could only be charged with driving drunk.

/I expressed disappointment that our local police chief was more interested in throwing books than justice.

I actually differ from most of my conservative brethren in that I support the immediate restoration of civil rights upon reaching end of sentence for most crimes. Not expunging the record because a significant number will re-offend and that history is important, but otherwise remove many of the barriers to rejoining society but not in cases where the victim dies.

She was driving drunk and killed someone. There is no corrective action that will atone. The fact that she's allowed to continue breathing air is bordering on too much mercy. Not only should her record never be expunged, she should be ineligible for any social assistance at all. Not one freaking penny. Living in a box under a bridge eating out of restaurant dumpsters is still better than what her victim got.

I work for a prosecuting agency. Grabbing facebook posts is pretty much a weekly or more activity.

People are total idiots. Just as a recent example, don't post pictures of your tickets and actual photos of you and your buds at an event if you're going to tell the cops you were a couple hundred miles away at the time.

In addition to the DWI, I imagine she will be charged with hit and run resulting in death....a felony. She, and her boyfriend will likely be a guest of the state for 2-5 years as they don't appear to have means to afford the type of attorney that could negotiate a sweetheart deal. If they did, probably one of the first pieces of advice would be don't say anything to anyone about the incident that hasn't been vetted and approved by said lawyer. Clearly, she is not getting that kind of counsel. Unlike that swamp donkey that wished for the little girl's death, this chick , and her boyfriend, will likely get what is coming to them..

While I have nothing but contempt for this girl, I need to put a few things out there.

1. It was her boyfriend, not husband (not that it matters a whole lot)
2. We don't know the other side of the story (well, I think I know, but we should hear all sides)
3. The boyfriend wasn't drunk (at least that's what I got from the article)
4. If the boyfriend wasn't drunk (this time), the past DWI shouldn't be brought up. Not that I am condoning drunk drinking, but he paid his debt to society. The newspapers are just trying to demonize the guy more (he seems to be doing a fine job by himself)

Again, if you served your time, in theory, it in the past. It's not right to keep bringing it up. "Tom, the guy from accounting... and the guy who got the DWI last year... yeah, he moved into the coolest apartment last weekend."

Fleeing the scene is a misdemeanor at best, since the person died, probably a felony. DWI and committing a felony is another felony.

It's hard to say whether she would have driven more safely (not in parallel with wheelie-boyfriend) if she had been sober, but I"m guessing most juries will find her intoxication a factor in her ability to drive safely (driving alongside someone doing repeated wheelies is not safe). A responsible person would have refused to drive with wheelie-boyfriend.

Also, had her reflexes been better and her attention more focused, she would have seen the accident about to happen, slam on her brakes and the dead woman would only have hit pavement - not been run over by her.

DWI/DUI complicates everything here, as does running away.

She'll probably get 25-30 years and do about 8-10 of them in prison.

American Taxpayer: Million in paper work, court costs and prosecution. Eight to ten years of inmate holding then the subsequent welfare for a felon as she will not be able to find any sort of good work the rest of her life. She'll probably now be in and out of prison for the rest of her life -- and god help us all if she gets pregnant.

I'm not saying sterilization should be law ... but it would be nice.

1) Expressing remorse should not absolve a person of liability for one's actions, and I never suggested it should.

2) But just as a court can and should sentence more severely one who shows no remorse, so should it sentence less severely one who expresses sincere remorse.

3) Oddly, given the defiant, inflammatory manner in which this woman appears to have "expressed remorse," I find it unusually credible. She clearly wasn't out to score points with a judge here. While she doesn't accept responsibility (and the facts may yet show lack of causation), she doesn't appear to be the kind of psychopath who can kill someone and walk away psychologically unscathed. She seems to me to the feel the natural regret anyone with a developed conscience would feel upon being involved in the death of another human being.

Local news gave a cross-road which I looked up, and the limit goes back to 30 about another half mile north of where that is. So yeah they were probably speeding, and it's only two lanes there. In fact the shoulders aren't as wide, either... because at least on the satellite picture, they're not even marked. That might be old since I think they repaved last year, but the road is a bit narrower in that area.


I live a few hundred yards from Rt. 250. What was the cross road they mentioned?

My parents lived on Rt. 250 for 35 years (mom moved 2 years ago), one town south in Perinton. I've driven that piece of road thousands of times. It's usually a busy road, but not at 7:45 on a Sunday morning. That time of day it should be nearly empty. There's no way that Merkel could not have seen her, drunk or not. Despite that, Scerbo is really responsible for this. I didn't see this in the linked article (mebbe I missed it), but he was passing Merkel on the right on a 2 lane road. He hit the bicyclist and knocked her into the main lane, where Merkel ran her over.

Scerbo has been in trouble over and over again. His record includes 3 DWI's and burglary. I'm guessing the only reason he hasn't been charged with DWI for this yet is that he ended up hospitalized and they are waiting on blood alcohol tests to come back.

Merkel's no angel either. He was convicted of criminal possession of stolen property after she used a hot credit card to ring up $1900 in merchandise. She was given probation, which was promptly revoked after she was charged with assault and petty larceny. She was sentenced to a year in jail at that point (I don't know how much of that she served).

I'm surprised Merkel is not in jail at this point, I'm sure Scerbo's going there once he gets out of the hospital.

Actually you'd be surprised how much traffic there is that time of day. I used to go to Army drill in Webster every month for seven years on 250. There were even people out before 7 AM; my last unit had 7 AM report time so I've done the drive between 6:30-7:30 many times. It's not busy like rush hour or lunch break time is, but there's still some volume of traffic. Plus you'll see tons of joggers, cyclists, and motorcycles around this time of year.

One other thing, I don't know what time sunrise was or the weather on Sunday, but I always liked that drive in the morning because I got to see it without a lot of buildings around, so it's *possible* being drunk, if the sun was bright, he really didn't see her. Not that I'm excusing him for being a COMPLETE MORON. Just thought I'd mention it.

I work for a prosecuting agency. Grabbing facebook posts is pretty much a weekly or more activity.

People are total idiots. Just as a recent example, don't post pictures of your tickets and actual photos of you and your buds at an event if you're going to tell the cops you were a couple hundred miles away at the time.

It doesn't end well for you.


Out of curiosity, how do you go about getting Facebook posts from users who have set their profiles to private? I'd be curious to know how you can extract information from those who are careful about what they post and who has visibility to their posts. Surely there must be a way, or do you legally need to request permission of some sort to defy any privacy filters that may have been put into place?

I actually differ from most of my conservative brethren in that I support the immediate restoration of civil rights upon reaching end of sentence for most crimes. Not expunging the record because a significant number will re-offend and that history is important, but otherwise remove many of the barriers to rejoining society but not in cases where the victim dies.

She was driving drunk and killed someone. There is no corrective action that will atone. The fact that she's allowed to continue breathing air is bordering on too much mercy. Not only should her record never be expunged, she should be ineligible for any social assistance at all. Not one freaking penny. Living in a box under a bridge eating out of restaurant dumpsters is still better than what her victim got.


I consider myself a liberal independent and I like that notion!

The DWI on her record will force who to get a low paying job so she will have to get government assisted living. She will spend her life poor and have a few baby daddies turn to alcohol and or drug abuse. She will have at least three kids all will become pregnant or get someone pregnant before the age of 16.

...And all while voting Republican too. A truly sad state of affairs this woman's life will be.

I would very much push for manslaughter as a prosecutor.

You all are taking the case as distinct and separate components, ie. cyclist knocks woman down in front of car with not enough time to avoid vehicular impact, and cyclist and driver happen to be both drunk.

However, just like if you are a part of a robbery and didn't pull the trigger that winds up killing a clerk, you are still involved in the crime and responsible. If you did not participate in the robbery, maybe the robbery doesn't occur, and no one gets shot. This woman was drunk and driving recklessly along side her boyfriend. Sober people would tend to avoid lane-sharing for long with a cyclist. Sober people would be paying attention to the road and note someone riding a bicycle on the road (especially a long straightaway). Even if the boyfriend were to lose control and hit the bicyclist, a sober driver would have seen the potential for that to happen and been able to avoid it.

This "she came right at me!" defense is total shiat, because the only reason she didn't see her was because she was distracted, and distracted because she was drunk... not to mention entertained by the drunk distracting boyfriend. No drunk and willfully playing along with the reckless boyfriend, no death.

I mean I try not to run down people while driving, but if I ever do, and they had it coming, and people are blaming me I'd tell them to fark off. DUI thing is irrelevant unless the driver did something wrong IMO.

This was two miles from my house. I'm an avid cyclist. I was out Sunday morning (heading to church) around the time this happened. It angers, scares, and saddens me. Such a waste of what sounds like a wonderful human caused by such crude example of humanity. Stupid, stupid hotdogging showoff motorcyclists.

Note I have no problem with motorcyclists. I have a problem with stupid showoffs who happen to be on motorcycles. There are a lot of showoff motorcyclists around here. A good amount of very reasonable cool cyclists, too. But a lot of tools.

Although it's been hotter than the fifth ring of Hades here lately, and when I go out to pour bath water on the wilting and parched grass of a lawn I have the neighbor's 17 year old daughter is out there rocking some cut off dungarees she's had since she's been 14, and her thighs are bulging only so slightly out of the ripped denim. That teeshirt needs a hell of a lot of engineering to support those massive, supple, and ripe...

I got Wi-Fi on the layover in Newark, And Marshalla's face book randomly hit's my fancy. She's just like "the girl next door" but in a cocoa flavor I can't resist.
I check out the emails listed n hook up ads in the 412 area code on a social networking site, and on CL. On number keeps flashing on an addy. Marsh8679309@... well, you get the pic.
Anyway ...
Long story short...

In addition to the DWI, I imagine she will be charged with hit and run resulting in death....a felony. She, and her boyfriend will likely be a guest of the state for 2-5 years as they don't appear to have means to afford the type of attorney that could negotiate a sweetheart deal. If they did, probably one of the first pieces of advice would be don't say anything to anyone about the incident that hasn't been vetted and approved by said lawyer. Clearly, she is not getting that kind of counsel. Unlike that swamp donkey that wished for the little girl's death, this chick , and her boyfriend, will likely get what is coming to them..

He was driving impaired when a man stepped out in front of his car and he couldn't avoid him. The judge basically said that there was no way, even sober that Donte could have avoided him due to the proximity of where the guy walked in front of his car.

Same thing will most likely happen here. If it shows she had no way to avoid the biker who was HIT into the road by the guy on the motorcycle...sober or not... then she will just get charged with DWI.

Are New Yorkers the only ones who bicker about whether they're upstate or downstate (or not wanting to be called "upstate" or "downstate")?

The only other state that comes to mind with an upstate and downstate is South Carolina, but I never hear people getting territorial about it.

This woman has made a large number of poor decisions, and I don't think that will stop anytime soon.

Well Illinois there are the losers from downstate. the capital is far away and completely out of touch with the needs of a big city like Chicago. Pretty much an identical situation as NYC.

Most major cities would be better served if they were separate from the states, similar to how south korea is governed.

I think it is a fact that the Megan Merkel at issue here posted to her FB page the rant that caused all this. As you can clearly see on the left, one Shannon Abel was replying to her. My pic of MM came from that FB page.

What are the odds that there are two Megan Merkels who are both 23 and both have two kids and a friend named Shannon Abel? And a propensity on the Merkel part to post lots of partying pics?

Let me increase the odds: If you google Megan Merkel New York, you get two results that certainly look like the same person. She is listed at 2 addresses in East Rochester, which is close to where the accident occurred. That's it, in the whole state.

Isn't it conceivable that the first picture posted was of the wrong person? I think it came from the Daily Fail.

There's a HUGE difference in culture, affluence, society, etc between NYC and the rest of the state. I live near the PA/NY border and we've got our fair share of conservative redneck culture around here. Plus one of the biggest industries in the state is dairy farming (and corn and apples), as well as lots of other kinds of farming. But whenever we travel out of the immediate area around the state (so PA, VT, etc), people hear NY and think NYC which is a whole different kettle of fish. It gets pretty annoying. I've been to NYC once, but I know lots of people who have never been there and don't really care.

It's like assuming all people from FL are from Miami, or all people from Nevada are from Vegas - just think how annoying it would be to have that hanging over you when you live 300 miles away...

If I'm confusing the links you're putting up, I apologize, but the photo you posted (of the girl in glasses holding two brandy snifters) is a different, unrelated Megan Merkel. The one who should DIAF has a FB page at facebook.com/megan(dot)merkel and the one whose picture I'm mentioning is at facebook.com/megan(dot)merkel(dot)505. (I'm paraphrasing the addresses because I don't feel like arguing with Fark about syntax.)

I'm just pointing this out because I'd hate to see some random person get mixed in for having the same name of a POS.

I'll stand to be corrected, but as I understand the law where I live, if you're DUI and you're involved in any form of accident, you're at fault pretty much irrespective of the circumstances. The logic behind this is that you should not have been on the road at all until you were no longer under the influence. So if the same circumstances that occurred in this case occurred in South Australia, she'd be causing death by dangerous driving as well as DUI. But that's here, and not there from the sounds of it.

It surprises me that even after people lawyer up that they still have their Facebook profiles up. I would think in this day and age when you hire a lawyer for a criminal case one of the first things a lawyer will do is to either tell you to delete your Facebook page or make you give him your info and do it themselves. But I do imagine that there are some people who's self image is so tied into Facebook that even if it means hurting them in a trial, they still wont give it up.

Depends. It is usually quite easy. If all else fails, the prosecutor can subpoena the information but it usually doesn't come to that. You'd be surprised at the number of people that don't have their profiles set to private. There are also quite a few that will friend anybody that sends them a request. Then there's the old adage that your friends aren't really your friends. If you've got one friend then your profile isn't private. As this lady's post shows, someone will rat you out. That's what happened in the incident I mentioned. One of the perp's friend simply said 'use my account and get what you need'. My personal favorite was one where a search warrant was served and the agents seized machines. Long story short, drive was imaged and the image brought up live. Dumbass perp was posting away having never changed his password. As was noted earlier, a big part of my job exists because people are stupid.

Wow, you couldn't have messed that up much more.

No judge said he could avoid the incident even if sober. Stallworth was charged with and pleaded guilty to what Florida calls DUI Manslaughter - a felony.

He got a month in the county jail and 8 years probation. He could have got 15 years, but the prosecution cut him a plea deal based on the wishes of the victim's family.

He also settled with the victim's family (after he got out of jail) for an undisclosed amount. You can be certain it was a very large amount.

She clarifies her "get the real facts straight" part by adding "She got hit by the bike and went on front of the car I was driving, she got ran over and uk the rest". Other than that, it's mostly people saying that they hope she is ok - one of them is telling her to get sober.


Gotta wonder if she'd have the "blame the victim" attitude if she wore a cocktail skirt to a bad neighborhood and got raped.

Drunk or not, she had no driver's license. Her boyfriend has been charged with manslaughter so far and he didn't have a driver's license either. Looks like she may roll over on him, so sadly she probably won't be prosecuted, but you never know.
