Mugato: "She smelled like weed" is pretty weak PC for a warrant. A cop could just say anyone smelled like weed. There's really no way to prove it one way or the other.


If only there was some sort of animal with a keen sense of smell that could be trained to signal the presence of narcotics....

With the previlence of usage, merely smelling like marijuanna should not be probable cause. A simple ride on public transport, attending a concert, having an aquaintance that does use may be enough to pick up the scent.

Personally- if I wasn't a user, I'd get it out of the way and invite the officer in for a look see. There's no point wasting time and public moneys delaying the inevitable search over the time it takes to get a warrant, plus a show of goodwill toward the police actually goes a long way.

The whole thing reeks of small time dealers selling t o smalltime users and getting busted out in a small time way by small time officers. A $25 fine and 3 hours of picking up trash in an orange vest should be all thats needed to repair this mess.

They can't call the police if someone holds them up and steals their money or merchandise.

They can't sue their customers for non-payment of debt, or their suppliers for non-delivery of product.

They do pay a variety of other taxes, just like everyone else.

I have much more interesting solutions for the cell phone/ driver user that- IMHO-- pose far more of a threat to the community than a bonehead on foot would. Want to subscribe?

In all seriousness, meh issues require meh solutions. We don't need to clog up the legal system with a couple of harmless boneheads even if you do just live in Nowhere, USA. Fine 'em for the officer's time, make 'em pick up trash or give back to the community whom they have inconvenienced. They make a regular habit of this, then you can toss them in the local pokey for a few days.

What you're talking about is called Jury Nullification and it is your right, but don't mention it before the trial... unless you want to get out of jury duty.

I am confused by this article, subby's headline does not help.

According to an affidavit from Detective Loren Grensteiner, Robin Haider told an officer he and his brother were going to get some marijuana from the woman who lives in the apartment. They were hoping she would "front" them the drugs, because they didn't have any money. The woman was not home. Robin Haider told the officer his brother broke a window to get into the apartment, then gave the drug paraphernalia to him. Robin Haider said he couldn't fit a large baggie of marijuana in his pants, so his brother kept that.

Grensteiner's affidavit said she smelled like marijuana, so officers obtained a search warrant for her apartment. She had not been charged as of Wednesday afternoon.

So two guys expected to find drugs in this apartment and the occupant smelled of pot. What is the problem here?

Weed wouldn't be cheaper if it was legal. Aside from taxes, government would drive up the cost with all sorts of regulations and conditions. In some places, dispensaries have to be more secure than bank vaults.
