From the article, everyone seems in agreement to permit the treatment to occur:

"My daughter's life is first. I know that [abortion] is a sin and that it goes against the law ... but my daughter's health is first," Hernandez said.

"How can it be possible that so much time is being wasted? That the treatment hasn't begun yet because they're still meeting, trying to decide if she has the right to receive the treatment to save her life -- that's unacceptable," Fondeur said.

Miguel Montalvo, the director of the bioethics council that rules on the application of the law, says the council is leaning toward allowing the treatment. "At the end of the day the patient may decide for himself or herself. In this case, the family may decide what's more convenient for the patient," Montalvo said.

"The constitution is going to have to be modified sooner rather than later," Terrero said. "We cannot allow under any circumstances that pregnancies that present complications for women be permitted to continue as normal."

Bautista Rojas Gomez, the Dominican minister of health, has publicly indicated he favors chemotherapy over protecting the pregnancy, but doctors are still reluctant to act for fear of prosecution.

"It's an artificial debate," Castillo said. "What we have clearly said is that in this case doctors are authorized by the constitution to treat the patient. They don't have to worry about anything. They have the mandate of protecting both lives."


The last one is one of the "architects of Article 37". I imagine all parties involved in approving the decision are simply waiting for others to act first rather than risk public or political ire by being first or by being alone should support fall away. I cannot find Article 37 itself, but I would hope, though I disagree with a ban on abortion, "abortion" is quite specific in definition to focus on actions taken purposefully to terminate a pregnancy.

I know a woman who was diagnosed with breast cancer while pregnant. Fortunately, unlike the pregnant girl in the article, it was just a couple of months until the baby was going to be born and the breast cancer wasn't super bad yet. She made the choice to delay chemo until after the baby was born because it wasn't a huge increase in risk. The woman was pro life, but she was able to make the choice herself on whether to put her health or the baby's health first.

Not all cases are as black and white as the one in the article, but it seems pretty clear in this case. They have a choice between two lives. Or, if the mom dies before the baby is born, I guess they have a choice between saving the mom or saving neither. I feel pretty pro life, but it doesn't make any sense to me to just have the mom die with no choice at all. She is a life as well, so I'm pro her life. In the case in the article, the law is deciding that the baby's life is always greater than any other life. If two lives are at stake (the mom and the baby), I don't feel like it is incompatible with pro life values to put the mom's life over the baby's life. In a case like that, you have to put one of the lives over the other which means you are sentencing the other life to dead. If that's the case, why would it be worse to kill the baby over killing the mom?

"Her situation can be saved, but we don't agree with performing an abortion directly. The most one can do is try to save the girl, but if the child dies as a result, we haven't killed the child directly," the prelate said after a mass at Santo Domingo's Cathedral.

The reaction from Dominican Republic's only Cardinal comes one day after prominent priest Luis Rosario also favored saving the girl's life, and as a heated nationwide debate surged over the adolescent's dilemma on the Constitution's "Right to Life" ban on abortion.

Doctors at the Semma Medical Center began chemotherapy treatment on the adolescent early Tuesday.

I'm from and living in Dominican Republic, so I'm getting a kick out of these replies.

Anyway...

The Constitution was modified 2 years ago (Yeah, politicians love to get constitutions tailored to their desires every approximately every 10 years) to mostly permit the current President, Leonel Fernandez, to be able to run for Pres whenever he wants (His party won the most recent election, but he decided not to run as the candidate since it was a high probability that he would lose and he's more face-saving than the Japanese).

To get support for what he needed, Fernandez had to bargain with different group of powers (the industrialists, the Catholic Church, etc). One of those bargains was the Catholic Church, represented in the island by Cardinal Lopez Rodriguez, long time desire to ban abortion on the Constitutional level. Before the modification, abortion was in a nebulous state, it was frowned upon by society, but not exactly illegal. The trick to making it into the Constitution was using this wording in Article 37: "All life should be preserved from the moment of conception until death" disguising it as a way to establish that Death Sentence is prohibited in the country. Yeah, as opposed to the American Christian Right, Catholics are "pro-life" all around: no abortions and no death sentences.

Some groups wanted the wording to be "preserved from birth until death" to make all abortions legal. A consensus was trying to be reached to leave the wording as it is (conception until death), but add some exceptions for therapeutic abortions (for example, pregnancies due to rape and guess what? pregnancies where the mother's life was in danger). The ironic thing is that women can be quite abortive here, doing it even several times a year. Also, there's exactly zero sex education at school and talking about sex with the teens is taboo in some circles. So you have a combination of high level of teen/young adult pregnancy due to low condom use + abortion happy (yet secretive) culture and that's a Molotov cocktail of suck.

But the Catholic Church played hard ball and didn't compromise. Why would they since they have so much power? Some idiot dictator named Trujillo signed a Concordat with the Vatican in the 40s, effectively making Church and State one and only. The State economically supports the Church and the Church gets to meddle in all of the State's decisions.

They're not gonna "change the law" since you can't whip up a Constition Reform just because. They're just gonna do what always happens when a stupid law clashes with reality: Disregard the damn law. Or at least work around it.
