How about technology patents in general. I believe that there should be a use it or lose it provision and an "obvious conclusion" clause. Like if 2 different inventors around the same time discover that 1+1=2, no one get's that patent. Oh, also...processes. Unless the process is HIGHLY proprietary and highly specific to a specific device, component, etc, then sure. But describing how to open a jar of peanut butter or turn on a light switch should not be something that is granted a patent.

I really hope that there is a massive overhaul in the US patent laws soon. This infighting among tech companies is costing a lot of money, stagnating innovation and possibly leading to inferior products.

I would like to see how much things would cost less if there was not a litany of patent suits flying around everywhere.

apple wasnt actually stupid enough to think that was design copying. they just wanted any excuse they could use to get a competitor out of the market. i already would never buy an apple product. that was just fuel to the fire for me. i vote with my dollar and apple doesnt get my vote.

i know, the choices are always the lesser of two evils, google or amazon or apple for the tablet markets but apple is still the worst to me. i might get an Asus transformer or maybe a kindle but even then they arent really necessary to my life. when i become more mobile i'll want something like that but not right now.

Apple, as always, just copies other people. They just put a different case on it, their logo, and call it a day.

So why does the aesthetics of others change afterwards? The cult of apple is strong. They market it as a fashion accessory and convince people that they need it to be cool. The rest of the market sees it and goes, "Well, I guess if that's what they want...". If someone is willing to buy it, then someone else is wiling to sell it. No matter how inane it may be.

So you are saying they can sue over being close in design to the ipad? Does that mean philco should be able to sue everyone for copying their square shaped TV design?

Apple sees the writing on the wall and they don't want to get steamrolled like they did with PCs, smaller companies make their products more user friendly and controlled.

The dispute wasn't about how similar the two devices look, but similarities in internal components and functionality. Did Samsung rip Apple off? In all probability, yes. This is the way the technology business works and Samsung has always introduced cheaper knock-off products that mimic successful products of their competition. They aren't alone in this. Was Apple's suit ill-advised? Absolutely. Samsung has a completely different market target than Apple. But worse, proving patent infringement on these devices is a very hard thing to do. In this case, it probably wasn't worth the effort. Apple may have lost a handful of iPad sales, but Samsung cannot put a real dent in Apple's share of this market sector. I've seen a Galaxy. It ain't an iPad.

Actually, we're still on a "first to invent" system until 2013. Things are farked in part for that reason.

If I were Apple, I'd make sure that my court-ordered notices quoted what Judge Birss had to say about Samsung's tablets: "They are not as cool." After all, they were ordered to reference the court case as well.
