Anyone would be justified in calling me an Apple fanboy, but I thought they were way out of line on this one. Glad to see some justice.

FTFA: A statement from Samsung said: "Should Apple continue to make excessive legal claims based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited."

How about technology patents in general. I believe that there should be a use it or lose it provision and an "obvious conclusion" clause. Like if 2 different inventors around the same time discover that 1+1=2, no one get's that patent. Oh, also...processes. Unless the process is HIGHLY proprietary and highly specific to a specific device, component, etc, then sure. But describing how to open a jar of peanut butter or turn on a light switch should not be something that is granted a patent.

I really hope that there is a massive overhaul in the US patent laws soon. This infighting among tech companies is costing a lot of money, stagnating innovation and possibly leading to inferior products.

I would like to see how much things would cost less if there was not a litany of patent suits flying around everywhere.

Trademarks aren't patents.

2012-07-19 12:38:47 PM
apple wasnt actually stupid enough to think that was design copying. they just wanted any excuse they could use to get a competitor out of the market. i already would never buy an apple product. that was just fuel to the fire for me. i vote with my dollar and apple doesnt get my vote.

i know, the choices are always the lesser of two evils, google or amazon or apple for the tablet markets but apple is still the worst to me. i might get an Asus transformer or maybe a kindle but even then they arent really necessary to my life. when i become more mobile i'll want something like that but not right now.

Endive Wombat: How about technology patents in general. I believe that there should be a use it or lose it provision

So, research universities like MIT, Cornell, Johns Hopkins, etc. shouldn't be able to license their research and earn money to pay for more research?

and an "obvious conclusion" clause.

There is one. The difficulty is proving something is obvious. Patents are quasi-judicial decisions, so they're bound by the constitutional requirement of due process. You can't simply throw out a patent, without evidence, by claiming in hindsight years later that it's obvious. It'd be the same as throwing someone in jail without evidence because they "look guilty".

Oh, also...processes. Unless the process is HIGHLY proprietary and highly specific to a specific device, component, etc, then sure. But describing how to open a jar of peanut butter or turn on a light switch should not be something that is granted a patent.

If the process is HIGHLY proprietary, then you could keep it as a trade secret forever. Why bother patenting it? And who cares - if it's that proprietary, no one is going to infringe it.

I really hope that there is a massive overhaul in the US patent laws soon.

There was. See, e.g., last year.

This infighting among tech companies is costing a lot of money, stagnating innovation and possibly leading to inferior products.

It's true. There's been nothing innovated since the 1980s when software was first being patented.

I would like to see how much things would cost less if there was not a litany of patent suits flying around everywhere.

Likewise. Until then, it's just baseless speculation.
Mind you, who says it would cost less at all? When the price of crude drops, does Exxon pass the savings on to the consumer, or do they give the executives huge bonuses and report record profits?

Actually, we're still on a "first to invent" system until 2013. Things are farked in part for that reason.

They could put up an entire page summarizing the lawsuits and how judges in Germany, Australia, and the US have found Samsung to have copied the iPad, while one judge in the UK instead states that Samsung's tablets aren't as cool and therefore don't infringe.

But it's so simple looking and pretty compared to other computers. That alone makes it worth twice as much. That Apple logo easily makes it worth 3x as much. You all just fail to see the big picture here.

I have been wanting a tablet computer for a while. I was actually going to head to Micro Center after work today to pick one up. Anyone have any recommendations? I want an android tablet and I like ASUS but am flexible I'm the brand.

"They do not have the same understated and extreme simplicity which is possessed by the Apple design," said the judge at the time.

"They are not as cool. The overall impression produced is different."

Well hell, there's your ad right there. Just quote the judge and Apple still comes out on top.

Bah..... Yes, I'm an Apple fanboy.... But most computer companies have multiple lawsuits they've filed against other companies who produce a product similar to theirs. Yes..... Apple seems to be lawsuit-happy.... But they aren't alone.
